《中华人民共和国人民检察院组织法》已由中华人民共和国第十三届全国人民代表大会常务委员会第六次会议于2018年10月26日修订通过，现将修订后的《中华人民共和国人民检察院组织法》公布，自2019年1月1日起施行。

The Organic Law of People's Procuratorates of the People's Republic of China, revised and adopted at the Sixth Session of the Standing Committee of the 13th National People's Congress of the People's Republic of China on 26 October 2018, is hereby promulgated, effective 1 January 2019.

第一章 总 则

Chapter 1 General Provisions

第一条   为了规范人民检察院的设置、组织和职权，保障人民检察院依法履行职责，根据宪法，制定本法。

Article 1 This Law is enacted in accordance with the Constitution in order to regulate the establishment, organization and functions and powers of people's procuratorates and ensure that people's procuratorates perform their duties according to law.

第二条   人民检察院是国家的法律监督机关。

Article 2 People's procuratorates are state organs for legal supervision.

人民检察院通过行使检察权，追诉犯罪，维护国家安全和社会秩序，维护个人和组织的合法权益，维护国家利益和社会公共利益，保障法律正确实施，维护社会公平正义，维护国家法制统一、尊严和权威，保障中国特色社会主义建设的顺利进行。

People's procuratorates shall, through exercising their procuratorial power, prosecute crimes, maintain national security and public order, safeguard the legitimate rights and interests of individuals and organizations, safeguard national interests and public interests, ensure the correct implementation of law, safeguard social fairness and justice, maintain the unity, dignity and authority of the country, and ensure the smooth progress of the construction of socialism with Chinese characteristics.

第三条   人民检察院依照宪法、法律和全国人民代表大会常务委员会的决定设置。

Article 3 People's procuratorates shall be established in accordance with the Constitution, laws, and decisions of the Standing Committee of the National People's Congress.

第四条   人民检察院依照法律规定独立行使检察权，不受行政机关、社会团体和个人的干涉。

Article 4 People's procuratorates exercise their procuratorial power independently, in accordance with the provisions of law, and are not subject to interference by any administrative organ, public organization or individual.

第五条   人民检察院行使检察权在适用法律上一律平等，不允许任何组织和个人有超越法律的特权，禁止任何形式的歧视。

Article 5 In the exercise of procuratorial power by people's procuratorates, the law shall be applied equally, no organization or individual may have the privilege of transcending the law, and discrimination, in any form, is not allowed.

第六条   人民检察院坚持司法公正，以事实为根据，以法律为准绳，遵守法定程序，尊重和保障人权。

Article 6 People's procuratorates shall uphold judicial fairness, base themselves on facts, take law as the criterion, observe statutory procedures, and respect and protect human rights.

第七条   人民检察院实行司法公开，法律另有规定的除外。

Article 7 People's procuratorates shall practise judicial transparency, unless otherwise stipulated by the law.

第八条   人民检察院实行司法责任制，建立健全权责统一的司法权力运行机制。

Article 8 People's procuratorates implement a judicial responsibility system, and establish a sound mechanism for exercise of the judicial power which features the integration of power and responsibility.

第九条   最高人民检察院对全国人民代表大会及其常务委员会负责并报告工作。地方各级人民检察院对本级人民代表大会及其常务委员会负责并报告工作。

Article 9 The Supreme People's Procuratorate shall be responsible and report on its work to the National People 's Congress and its Standing Committee. Local people's procuratorates at various levels shall be responsible and report on their work to the people's congresses and their standing committees at corresponding levels.

各级人民代表大会及其常务委员会对本级人民检察院的工作实施监督。

People's congresses at various levels and their standing committees shall exercise supervision over the work of people's procuratorates at corresponding levels.

第十条   最高人民检察院是最高检察机关。

Article 10 The Supreme People's Procuratorate is the highest procuratorial organ.

最高人民检察院领导地方各级人民检察院和专门人民检察院的工作,上级人民检察院领导下级人民检察院的工作。

The Supreme People's Procuratorate directs the work of the people's procuratorates at various local levels and of the special people's procuratorates. People's procuratorates at higher levels direct the work of those at lower levels.

第十一条   人民检察院应当接受人民群众监督，保障人民群众对人民检察院工作依法享有知情权、参与权和监督权。

Article 11 People's procuratorates shall accept public supervision, and guarantee the people's right to know, participate and supervise the work of people's procuratorates.

第二章 人民检察院的设置和职权

Chapter 2 Establishment, and Functions and Powers of People's Procuratorates

第十二条   人民检察院分为：

Article 12 People's procuratorates are divided into:

（一）最高人民检察院；

1. the Supreme People's Procuratorate;

（二）地方各级人民检察院；

2. the local people's procuratorates at various levels;

（三）军事检察院等专门人民检察院。

(III) special people's procuratorates such as military procuratorates.

第十三条   地方各级人民检察院分为：

Article 13 People's procuratorates at various local levels are divided into:

（一）省级人民检察院，包括省、自治区、直辖市人民检察院；

1. People's procuratorates at the provincial level, including the people's procuratorates of provinces, autonomous regions and municipalities directly under the Central Government;

（二）设区的市级人民检察院，包括省、自治区辖市人民检察院，自治州人民检察院，省、自治区、直辖市人民检察院分院；

2. People's procuratorates at the level of city divided into districts, including people's procuratorates of provinces and autonomous regions, people's procuratorates of autonomous prefectures, and branches of people's procuratorates of provinces, autonomous regions and municipalities directly under the Central Government;

（三）基层人民检察院，包括县、自治县、不设区的市、市辖区人民检察院。

(III) Basic people's procuratorates, including the people's procuratorates of counties, autonomous counties, cities not divided into districts and municipal districts.

第十四条   在新疆生产建设兵团设立的人民检察院的组织、案件管辖范围和检察官任免，依照全国人民代表大会常务委员会的有关规定。

Article 14 The organization, scope of jurisdiction, appointment and removal of procurators of people's procuratorates set up by Xinjiang Production & Construction Corps shall be subject to the relevant provisions of the Standing Committee of the National People's Congress.

第十五条   专门人民检察院的设置、组织、职权和检察官任免，由全国人民代表大会常务委员会规定。

Article 15 The establishment, organization, functions and powers, and appointment and removal of procurators of special People's Procuratorates shall be stipulated by the Standing Committee of the National People's Congress.

第十六条   省级人民检察院和设区的市级人民检察院根据检察工作需要，经最高人民检察院和省级有关部门同意，并提请本级人民代表大会常务委员会批准，可以在辖区内特定区域设立人民检察院，作为派出机构。

Article 16 People's procuratorates at the provincial level or the level of city divided into districts may, according to the requirements of their procuratorial work, upon consent of the Supreme People's Procuratorate and the relevant department at the provincial level and upon approval of the standing committee of the people's congress at the corresponding level, establish people's procuratorates as their agencies in special areas within their jurisdictions.

第十七条   人民检察院根据检察工作需要，可以在监狱、看守所等场所设立检察室，行使派出它的人民检察院的部分职权，也可以对上述场所进行巡回检察。

Article 17 People's procuratorates may, according to the requirements of their procuratorial work, set up procuratorial rooms in the places such as prisons and detention houses, and such procuratorial rooms may exercise some functions and powers of the dispatching people's procuratorates, and may also conduct patrol inspection over the aforesaid places.

省级人民检察院设立检察室，应当经最高人民检察院和省级有关部门同意。设区的市级人民检察院、基层人民检察院设立检察室，应当经省级人民检察院和省级有关部门同意。

Where people's procuratorates at the provincial level set up procuratorial rooms, the consent of the Supreme People's Procuratorate and the relevant department at the provincial level is required. Where people's procuratorates at the level of city divided into districts or the grassroots level set up procuratorial rooms, the consent of people's procuratorates and the relevant departments at the provincial level is required.

第十八条   人民检察院根据检察工作需要，设必要的业务机构。检察官员额较少的设区的市级人民检察院和基层人民检察院，可以设综合业务机构。

Article 18 People's procuratorates may, according to the requirements of their procuratorial work, set up necessary professional agencies. People's procuratorates at the level of city divided into districts or the grassroots level with a small number of procurators may establish comprehensive professional agencies.

第十九条   人民检察院根据工作需要，可以设必要的检察辅助机构和行政管理机构。

Article 19 People's procuratorates may, according to the requirements of their procuratorial work, set up necessary auxiliary agencies or administrative agencies.

第二十条   人民检察院行使下列职权：

Article 20 People's procuratorates exercise the following functions and powers:

（一）依照法律规定对有关刑事案件行使侦查权；

1. to exercise the power of investigation into criminal cases according to law;

（二）对刑事案件进行审查，批准或者决定是否逮捕犯罪嫌疑人；

(II) to examine the criminal case, and approve or decide whether to arrest the criminal suspect;

（三）对刑事案件进行审查，决定是否提起公诉，对决定提起公诉的案件支持公诉；

3. to examine criminal cases, decide whether to initiate a public prosecution, and support the public prosecution of the cases for which the public prosecution decision has been made;

（四）依照法律规定提起公益诉讼；

(IV) Instituting public interest litigation in accordance with the law;

（五）对诉讼活动实行法律监督；

(V) to exercise legal supervision over the litigation activities;

（六）对判决、裁定等生效法律文书的执行工作实行法律监督；

(VI) To carry out legal supervision of the enforcement of judgments, rulings and other effective legal documents;

（七）对监狱、看守所的执法活动实行法律监督；

(VII) to exercise legal supervision over the law enforcement activities of prisons and detention houses;

（八）法律规定的其他职权。

(VIII) other functions and powers as prescribed by law.

第二十一条   人民检察院行使本法第二十条规定的法律监督职权，可以进行调查核实，并依法提出抗诉、纠正意见、检察建议。有关单位应当予以配合，并及时将采纳纠正意见、检察建议的情况书面回复人民检察院。

Article 21 In the exercise of legal supervision as provided for in Article 20 hereof, people's procuratorates may make investigations to verify facts, and make a protest or put forward corrective opinions or procuratorial suggestions pursuant to law. The entities concerned shall cooperate and inform the people's procuratorate in writing of the acceptance of correction opinions or procuratorial suggestions in a timely manner.

抗诉、纠正意见、检察建议的适用范围及其程序，依照法律有关规定。

The scope of application of and procedures for protest, corrective opinions or procuratorial suggestions shall be subject to the relevant provisions of the law.

第二十二条   最高人民检察院对最高人民法院的死刑复核活动实行监督；对报请核准追诉的案件进行审查，决定是否追诉。

Article 22 The Supreme People's Procuratorate shall supervise the review of death penalty by the Supreme People's Court; review the application for approval of prosecution, and decide whether to prosecute.

第二十三条   最高人民检察院可以对属于检察工作中具体应用法律的问题进行解释。

Article 23 The Supreme People's Procuratorate may interpret the issues relating to the application of law which fall under the scope of its procuratorial work.

最高人民检察院可以发布指导性案例。

The Supreme People's Procuratorate may release guiding cases.

第二十四条   上级人民检察院对下级人民检察院行使下列职权：

Article 24 People's procuratorates at higher levels shall exercise the following functions and powers on people's procuratorates at lower levels:

（一）认为下级人民检察院的决定错误的，指令下级人民检察院纠正，或者依法撤销、变更；

1. where they consider the decision of the people's procuratorates at lower levels is wrong, order the people's procuratorates at lower levels to make corrections, or revoke or alter the decision in accordance with the law;

（二）可以对下级人民检察院管辖的案件指定管辖；

2. may designate the jurisdiction of the cases that are under the jurisdiction of the people's procuratorate at the lower level;

（三）可以办理下级人民检察院管辖的案件；

(III) May handle cases under the jurisdiction of the people's procuratorates at lower levels; and

（四）可以统一调用辖区的检察人员办理案件。

(IV) Procuratorial personnel within the jurisdiction may be assigned in a unified manner to handle cases.

上级人民检察院的决定，应当以书面形式作出。

A people's procuratorate at a higher level shall make a decision in writing.

第二十五条   下级人民检察院应当执行上级人民检察院的决定；有不同意见的，可以在执行的同时向上级人民检察院报告。

Article 25 People's procuratorates at lower levels shall execute any decision made by people's procuratorates at higher levels; in the case of having different opinion, they may report such opinion to people's procuratorates at higher levels at the time of executing the decision.

第二十六条   人民检察院检察长或者检察长委托的副检察长，可以列席同级人民法院审判委员会会议。

Article 26 The chief procurator of a people's procuratorate or the deputy chief procurator entrusted thereby may attend meetings of the judicial committee of the people's court at the same level.

第二十七条   人民监督员依照规定对人民检察院的办案活动实行监督。

Article 27 People's supervisors shall exercise supervision over the case-handling activities of people's procuratorates according to the relevant provisions.

第三章 人民检察院的办案组织

Chapter III Case-handling Organization of People's Procuratorates

第二十八条   人民检察院办理案件，根据案件情况可以由一名检察官独任办理，也可以由两名以上检察官组成办案组办理。

Article 28 A people's procuratorate may, in accordance with the circumstances of a case, appoint a sole procurator, or appoint two or more procurators to form a case-handling group to handle the case.

由检察官办案组办理的，检察长应当指定一名检察官担任主办检察官，组织、指挥办案组办理案件。

If a case is handled by the procurator case-handling group, the chief procurator shall designate a procurator to serve as the procurator in charge, who shall organize and direct the case-handling group to handle the case.

第二十九条   检察官在检察长领导下开展工作，重大办案事项由检察长决定。检察长可以将部分职权委托检察官行使，可以授权检察官签发法律文书。

Article 29 Procurators shall carry out their work under the leadership of the chief procurator, and major case-handling matters shall be determined by the chief procurator. The chief procurator may entrust the procurators to exercise some of his/her functions and powers or authorize the procurators to issue legal documents.

第三十条   各级人民检察院设检察委员会。检察委员会由检察长、副检察长和若干资深检察官组成，成员应当为单数。

Article 30 People's procuratorates at all levels shall set up procuratorial committees. The procuratorial committee shall be composed of a chief procurator, deputy chief procurators and several senior procurators, and the members shall be odd in number.

第三十一条   检察委员会履行下列职能：

Article 31 A procuratorial committee shall perform the following functions:

（一）总结检察工作经验；

1. sum up the experience gained in procuratorial work;

（二）讨论决定重大、疑难、复杂案件；

(II) discussing and deciding major, difficult or complicated cases;

（三）讨论决定其他有关检察工作的重大问题。

(III) to discuss and decide other major issues relating to procuratorial work.

最高人民检察院对属于检察工作中具体应用法律的问题进行解释、发布指导性案例，应当由检察委员会讨论通过。

If the Supreme People's Procuratorate intends to interpret any issue relating to the application of law in its procuratorial work or issue any guiding case, the approval of its procuratorial committee is required.

第三十二条   检察委员会召开会议，应当有其组成人员的过半数出席。

Article 32 A meeting to be held by the procuratorial committee shall be attended by more than half of its members.

检察委员会会议由检察长或者检察长委托的副检察长主持。检察委员会实行民主集中制。

The meetings of the procuratorial committee shall be presided over by the chief procurator or the deputy chief procurator entrusted thereby. The procuratorial committee practices democratic centralism.

地方各级人民检察院的检察长不同意本院检察委员会多数人的意见，属于办理案件的，可以报请上一级人民检察院决定；属于重大事项的，可以报请上一级人民检察院或者本级人民代表大会常务委员会决定。

If the chief procurator of a local People's Procuratorate at any level disagrees with the opinion of the majority of its procuratorial committee, the case which is to be handled may be reported to the People's Procuratorate at the next higher level for decision; if the case which is to be handled is a major matter, it may be reported to the People's Procuratorate at the next higher level for decision.

第三十三条   检察官可以就重大案件和其他重大问题，提请检察长决定。检察长可以根据案件情况，提交检察委员会讨论决定。

Article 33 The procurators may request the chief procurator to make decisions on important cases and other important issues. The chief procurator may, in accordance with the circumstance of a case, submit the case to the procuratorial committee for discussion and decision.

检察委员会讨论案件，检察官对其汇报的事实负责，检察委员会委员对本人发表的意见和表决负责。检察委员会的决定，检察官应当执行。

When the procuratorial committee discusses a case, the procurators shall be responsible for the facts reported by them, and members of the procuratorial committee shall be responsible for the opinions expressed by them and their voting. The procurators shall execute the decision of the procuratorial committee.

第三十四条   人民检察院实行检察官办案责任制。检察官对其职权范围内就案件作出的决定负责。检察长、检察委员会对案件作出决定的，承担相应责任。

Article 34 People's procuratorates implement a case-handling responsibility system for procurators. Procurators shall be responsible for the decisions they make on cases within the scope of their authority. The chief procurator or the procuratorial committee shall bear the corresponding responsibility if they make a decision on the case.

第四章 人民检察院的人员组成

Chapter 4 Composition of People's Procuratorates

第三十五条   人民检察院的检察人员由检察长、副检察长、检察委员会委员和检察员等人员组成。

Article 35 The procuratorial personnel of a people's procuratorate include chief procurator, deputy chief procurators, members of the procuratorial committee and procurators.

第三十六条   人民检察院检察长领导本院检察工作，管理本院行政事务。人民检察院副检察长协助检察长工作。

Article 36 The chief procurator of a people's procuratorate exercises leadership over the work of the procuratorate, and takes charge of the procuratorate's administrative affairs. The deputy chief procurators of the people's procuratorates shall assist the chief procurators in their work.

第三十七条   最高人民检察院检察长由全国人民代表大会选举和罢免，副检察长、检察委员会委员和检察员由检察长提请全国人民代表大会常务委员会任免。

Article 37 The Procurator -General of the Supreme People's Procuratorate shall be elected or removed by the National People 's Congress. The Deputy Procurators-General, members of the procuratorial committee and the procurators shall be appointed or removed by the Standing Committee of the National People's Congress upon the recommendation of the Procurator-General of the Supreme People's Procuratorate.

第三十八条   地方各级人民检察院检察长由本级人民代表大会选举和罢免，副检察长、检察委员会委员和检察员由检察长提请本级人民代表大会常务委员会任免。

Article 38 The chief procurators of the local People's Procuratorates at various levels shall be elected or removed by the people's congresses at the corresponding levels. The deputy chief procurators, members of the procuratorial committees and procurators shall be appointed or removed by the standing committees of the people's congresses at the corresponding levels upon the recommendation of the chief procurators.

地方各级人民检察院检察长的任免，须报上一级人民检察院检察长提请本级人民代表大会常务委员会批准。

The appointment or removal of the chief procurators of the local People's Procuratorates at the various levels must be reported to the chief procurators of the People Procuratorates at the next higher level, who shall submit the matter to the standing committee of the people's congress at the corresponding level for approval.

省、自治区、直辖市人民检察院分院检察长、副检察长、检察委员会委员和检察员，由省、自治区、直辖市人民检察院检察长提请本级人民代表大会常务委员会任免。

The chief procurators, deputy chief procurators, members of the procuratorial committees and procurators of the branches of the People's Procuratorates of the provinces, autonomous regions or municipalities directly under the Central Government shall be appointed and removed by the standing committees of the people's congresses at corresponding levels upon the recommendation of the chief procurators of the People's Procuratorates of the provinces, autonomous regions or municipalities directly under the Central Government.

第三十九条   人民检察院检察长任期与产生它的人民代表大会每届任期相同。

Article 39 The term of office of the chief procurators of people's procuratorates shall be the same as that of the people's congresses which appointed them.

全国人民代表大会常务委员会和省、自治区、直辖市人民代表大会常务委员会根据本级人民检察院检察长的建议，可以撤换下级人民检察院检察长、副检察长和检察委员会委员。

The Standing Committee of the National People's Congress and the standing committees of the people's congresses of provinces, autonomous regions, and municipalities directly under the Central Government may, upon proposals put forward by the Procurator-General and chief procurators of people's procuratorates at the corresponding level, replace the chief procurators, deputy chief procurators and members of the procuratorial committees of people's procuratorates at lower levels.

第四十条   人民检察院的检察官、检察辅助人员和司法行政人员实行分类管理。

Article 40 The procurators, procuratorial assistants and administrative personnel of people's procuratorates shall be subject to categorized management.

第四十一条   检察官实行员额制。检察官员额根据案件数量、经济社会发展情况、人口数量和人民检察院层级等因素确定。

Article 41 A quota system shall be adopted for procurators. The quota of procurators shall be determined according to the factors such as the quantity of cases, economic and social development, population, and level of people's procuratorate.

最高人民检察院检察官员额由最高人民检察院商有关部门确定。地方各级人民检察院检察官员额，在省、自治区、直辖市内实行总量控制、动态管理。

The quota of procurators of the Supreme People's Procuratorate shall be determined by the Supreme People's Procuratorate through consultation with other relevant departments. The quota of procurators of people's procuratorates at all levels shall be subject to total quantity control and dynamic management within the respective provinces, autonomous regions and centrally-administered municipalities.

第四十二条   检察官从取得法律职业资格并且具备法律规定的其他条件的人员中选任。初任检察官应当由检察官遴选委员会进行专业能力审核。上级人民检察院的检察官一般从下级人民检察院的检察官中择优遴选。

Article 42 Procurators shall be selected from the persons who have acquired the legal profession qualification and meet other conditions as provided by law. Persons to be appointed procurators for the first time shall be subject to professional competence examination by the procurator selection committee. The procurators of people's procuratorates at higher levels are generally selected from the procurators of people's procuratorates at lower levels.

检察长应当具有法学专业知识和法律职业经历。副检察长、检察委员会委员应当从检察官、法官或者其他具备检察官、法官条件的人员中产生。

The chief procurators shall have professional knowledge of law and experience in the legal profession. Deputy chief procurators and members of the procuratorial committee shall be selected from procurators, judges or other persons who are qualified for the post of procurator or judge.

检察官的职责、管理和保障，依照《中华人民共和国检察官法》的规定。

The duties, management and quality guarantee of procurators shall be subject to the provisions of the Procurators Law of the People's Republic of China.

第四十三条   人民检察院的检察官助理在检察官指导下负责审查案件材料、草拟法律文书等检察辅助事务。

Article 43 Procurator assistants of people's procuratorates shall, under the direction of procurators, take charge of reviewing case files, drafting legal documents and other assistant affairs.

符合检察官任职条件的检察官助理，经遴选后可以按照检察官任免程序任命为检察官。

Procurator assistants who are qualified for the post of Procurator may be selected and appointed as procurators according to the Procurator appointment and removal procedures.

第四十四条   人民检察院的书记员负责案件记录等检察辅助事务。

Article 44 Clerks of people's procuratorates shall be responsible for keeping case records and other assistant affairs.

第四十五条   人民检察院的司法警察负责办案场所警戒、人员押解和看管等警务事项。

Article 45 Judicial policemen of a people's procuratorate shall be responsible for security control at case-handling sites, escort and watch of suspects and other police affairs.

司法警察依照《中华人民共和国人民警察法》管理。

Judicial police shall be administered in accordance with the People's Police Law of the People's Republic of China.

第四十六条   人民检察院根据检察工作需要，可以设检察技术人员，负责与检察工作有关的事项。

Article 46 People's procuratorates may, according to the requirements of their procuratorial work, set up the post of procuratorial technician, which shall be responsible for the matters relating to the procuratorial work.

第五章 人民检察院行使职权的保障

Chapter 5 Guarantee of the Exercise of Functions and Powers of People's Procuratorates

第四十七条   任何单位或者个人不得要求检察官从事超出法定职责范围的事务。

Article 47 No entity or individual may require any procurator to engage in any affairs beyond the scope of his/her statutory duties.

对于领导干部等干预司法活动、插手具体案件处理，或者人民检察院内部人员过问案件情况的，办案人员应当全面如实记录并报告；有违法违纪情形的，由有关机关根据情节轻重追究行为人的责任。

If a leading cadre intervenes in any judicial activity or the handling of any case, or a staff member of the people's procuratorate make inquiries about any case, the case- handling personnel shall make complete and faithful records and report the matter; if the act constitutes a violation of law or discipline, the relevant organ shall, according to the seriousness of the act, hold the violator accountable.

第四十八条   人民检察院采取必要措施，维护办案安全。对妨碍人民检察院依法行使职权的违法犯罪行为，依法追究法律责任。

Article 48 People's procuratorates shall take necessary measures to ensure safety in case handling. Any person who commits an illegal or criminal act that obstructs the lawful exercise of powers by a people's procuratorate shall be investigated for legal liability in accordance with the law.

第四十九条   人民检察院实行培训制度，检察官、检察辅助人员和司法行政人员应当接受理论和业务培训。

Article 49 People's procurators are subject to a training system, under which procurators, procuratorial assistants and administrative personnel shall receive theoretical and professional training.

第五十条   人民检察院人员编制实行专项管理。

Article 50 The staff size of people's procuratorates shall be subject to specialized management.

第五十一条   人民检察院的经费按照事权划分的原则列入财政预算，保障检察工作需要。

Article 51 The funds of people's procuratorates shall be included in the financial budgets according to the principle of division of powers and responsibilities, so as to guarantee the needs of procuratorial work.

第五十二条   人民检察院应当加强信息化建设，运用现代信息技术，促进司法公开，提高工作效率。

Article 52 People's procuratorates shall strengthen information construction, and use modern information technology to promote judicial transparency and improve work efficiency.

第六章 附 则

Chapter 6 Supplementary Provisions

第五十三条   本法自2019年1月1日起施行。

Article 53 This Law shall come into force as of January 1, 2019.
