Law of the People’s Republic of China on State Medals and State Titles of Honor

《中华人民共和国国家勋章和国家荣誉称号法》已由中华人民共和国第十二届全国人民代表大会常务委员会第十八次会议于2015年12月27日通过，现予公布，自2016年1月1日起施行。

The Law of the People's Republic of China on State Medals and State Titles of Honor, adopted at the 18th session of the Standing Committee of the 12th National People's Congress of the People's Republic of China on December 27, 2015, is hereby promulgated, effective on January 1, 2016.

第一条   为了褒奖在中国特色社会主义建设中作出突出贡献的杰出人士，弘扬民族精神和时代精神，激发全国各族人民建设富强、民主、文明、和谐的社会主义现代化国家的积极性，实现中华民族伟大复兴，根据宪法，制定本法。

Article 1 This Law is formulated in accordance with the Constitution in order to praise and award outstanding persons who have made outstanding contributions to the construction of socialism with Chinese characteristics, promote the national spirit and the spirit of the times, motivate people of all ethnic groups of the country to build a prosperous, democratic, civilized and harmonious modern socialist country, and realize the great rejuvenation of the Chinese nation.

第二条   国家勋章和国家荣誉称号为国家最高荣誉。

Article 2 State medals and State titles of honor are the highest honors of the State.

国家勋章和国家荣誉称号的设立和授予，适用本法。

This Law applies to the establishment and granting of State medals and State titles of honor.

第三条   国家设立“共和国勋章”，授予在中国特色社会主义建设和保卫国家中作出巨大贡献、建立卓越功勋的杰出人士。

Article 3 The State sets up "republic medals" and grants them to outstanding persons who have made tremendous contribution and performed outstanding meritorious service in constructing the socialism with Chinese characteristics and defending the country.

国家设立“友谊勋章”，授予在我国社会主义现代化建设和促进中外交流合作、维护世界和平中作出杰出贡献的外国人。

The State sets up "friendship medals" to commend foreigners that have made outstanding contribution to constructing the socialist modernization of the country and promoting exchanges and cooperation between China and foreign countries, and maintaining world peace.

第四条   国家设立国家荣誉称号，授予在经济、社会、国防、外交、教育、科技、文化、卫生、体育等各领域各行业作出重大贡献、享有崇高声誉的杰出人士。

Article 4 The State sets up State titles of honor, and grants them to outstanding persons who have made significant contribution and enjoyed high reputation in such fields and industries as economy, society, national defense, foreign affairs, education, science and technology, culture, health and sports.

国家荣誉称号的名称冠以“人民”，也可以使用其他名称。国家荣誉称号的具体名称由全国人民代表大会常务委员会在决定授予时确定。

The word "People" shall be used in names of State titles of honor, and other names may also be used. The specific names of State titles of honor shall be determined by the Standing Committee of the National People's Congress when it decides to grant such titles.

第五条   全国人民代表大会常务委员会委员长会议根据各方面的建议，向全国人民代表大会常务委员会提出授予国家勋章、国家荣誉称号的议案。

Article 5 The Council of Chairmen of the Standing Committee of the National People's Congress will put forward proposals on the granting of State medals and State titles of honor to the Standing Committee of the National People's Congress according to suggestions of all parties.

国务院、中央军事委员会可以向全国人民代表大会常务委员会提出授予国家勋章、国家荣誉称号的议案。

The State Council and the Central Military Commission may put forward proposals on the granting of State medals and State titles of honor to the Standing Committee of the National People's Congress.

第六条   全国人民代表大会常务委员会决定授予国家勋章和国家荣誉称号。

Article 6 The Standing Committee of the National People's Congress will make decisions on the granting of State medals and State titles of honor.

第七条   中华人民共和国主席根据全国人民代表大会常务委员会的决定，向国家勋章和国家荣誉称号获得者授予国家勋章、国家荣誉称号奖章，签发证书。

Article 7 The President of the People's Republic of China will grant State medals and medals for State titles of honor and issue certificates to winners of State medals and State titles of honor according to the decision of the Standing Committee of the National People's Congress.

第八条   中华人民共和国主席进行国事活动，可以直接授予外国政要、国际友人等人士“友谊勋章”。

Article 8 The President of the People's Republic of China may directly grant "friendship medals" to foreign dignitaries and foreign friends and other persons at state functions.

第九条   国家在国庆日或者其他重大节日、纪念日，举行颁授国家勋章、国家荣誉称号的仪式；必要时，也可以在其他时间举行颁授国家勋章、国家荣誉称号的仪式。

Article 9 The State will holds ceremonies of the awarding of State medals and State titles of honor on the National Day, other significant festivals or days of commemoration, or if necessary, at other times.

第十条   国家设立国家功勋簿，记载国家勋章和国家荣誉称号获得者及其功绩。

Article 10 The State will set up a book of meritorious services to record winners of State medals and State titles of honor and their merits.

第十一条   国家勋章和国家荣誉称号获得者应当受到国家和社会的尊重，享有受邀参加国家庆典和其他重大活动等崇高礼遇和国家规定的待遇。

Article 11 Winners of State medals and State titles of honor shall be respected by the State and society, and enjoy treatment with high respect such as being invited to national celebrations and other major events as well as other treatment as provided by the State.

第十二条   国家和社会通过多种形式，宣传国家勋章和国家荣誉称号获得者的卓越功绩和杰出事迹。

Article 12 The State and the society will publicize the remarkable services and outstanding achievements made by winners of State medals and State titles of honor.

第十三条   国家勋章和国家荣誉称号为其获得者终身享有，但依照本法规定被撤销的除外。

Article 13 Winners of State medals and State titles of honor may enjoy such medals and titles for life, unless they are revoked in accordance with this Law.

第十四条   国家勋章和国家荣誉称号获得者应当按照规定佩带国家勋章、国家荣誉称号奖章，妥善保管勋章、奖章及证书。

Article 14 Winners of State medals and State titles of honor shall wear State medals and medals for State titles of honor according to relevant rules, and properly keep the State medals, medals for State titles of honor and certificates.

第十五条   国家勋章和国家荣誉称号获得者去世的，其获得的勋章、奖章及证书由其继承人或者指定的人保存；没有继承人或者被指定人的，可以由国家收存。

Article 15 Where a winner of a State medal or State title of honor deceases, his State medal or medal for State title of honor and the certificate thereof shall be kept by his successor or a person designated by him, or by the State if there is no such successor or designated person.

国家勋章、国家荣誉称号奖章及证书不得出售、出租或者用于从事其他营利性活动。

State medals and medals for State titles of honor and the certificates thereof may not be sold, leased, or used for other profit-making activities.

第十六条   生前作出突出贡献符合本法规定授予国家勋章、国家荣誉称号条件的人士，本法施行后去世的，可以向其追授国家勋章、国家荣誉称号。

Article 16 In the event of the death of a person who has made outstanding contributions and meets the conditions for being awarded a State medal or State title of honor as stipulated in this Law, the State medal or State title of honor may be granted to him posthumously.

第十七条   国家勋章和国家荣誉称号获得者，应当珍视并保持国家给予的荣誉，模范地遵守宪法和法律，努力为人民服务，自觉维护国家勋章和国家荣誉称号的声誉。

Article 17 Winners of State medals and State titles of honor shall cherish and maintain the honors granted by the State, exemplarily abide by the Constitution and law, strive to serve the people, and consciously maintain the reputation of State medals and State titles of honor.

第十八条   国家勋章和国家荣誉称号获得者因犯罪被依法判处刑罚或者有其他严重违法、违纪等行为，继续享有国家勋章、国家荣誉称号将会严重损害国家最高荣誉的声誉的，由全国人民代表大会常务委员会决定撤销其国家勋章、国家荣誉称号并予以公告。

Article 18 Where a winner of a State medal or State title of honor is subject to criminal penalties in accordance with the law for having committed a crime or has committed any other act in serious violation of laws or discipline, and the reputation of the State's highest honor will be damaged if such person continues to enjoy the State medal or State title of honor, the Standing Committee of the National People's Congress shall make a decision to revoke the State medal or State title of honor granted to the person and publicly announce the same.

第十九条   国家勋章和国家荣誉称号的有关具体事项，由国家功勋荣誉表彰有关工作机构办理。

Article 19 The specific matters relating to State medals and State titles of honor shall be subject to the State's working body for commending meritorious services with State titles of honor.

第二十条   国务院、中央军事委员会可以在各自的职权范围内开展功勋荣誉表彰奖励工作。

Article 20 The State Council and the Central Military Commission may commend meritorious services and reward honors within their respective functions and powers.

第二十一条   本法自2016年1月1日起施行。

Article 21 This Law shall come into force as of January 1, 2016.
