Amendment III to the Criminal Law of the People's Republic of China

《中华人民共和国刑法修正案(三)》已由中华人民共和国第九届全国人民代表大会常务委员会第二十五次会议于  2001年12月29日通过，现予公布，自公布之日起施行。

The Amendment Act (III) to the Criminal Law of the People's Republic of China, adopted at the 25th Meeting of the Standing Committee of the Ninth National People's Congress on December 29, 2001, is hereby promulgated, and shall come into force as of the date of its promulgation.

为了惩治恐怖活动犯罪，保障国家和人民生命、财产安全，维护社会秩序，对刑法作如下补充修改：

The Criminal Law is supplemented and amended as follows in order to punish terrorist crimes, safeguard the security of the State and of people's lives and property, and maintain the public order:

一、将刑法第一百一十四条修改为：“放火、决水、爆炸以及投放毒害性、放射性、传染病病原体等物质或者以其他危险方法危害公共安全，尚未造成严重后果的，处三年以上十年以下有期徒刑。”

I、 Article 114 is amended as: "Whoever commits arson, breaches a dike, causes explosion, spreads pathogens of infectious diseases, poisonous or radioactive substances or other substances, or uses other dangerous means, thereby endangering public security but causing no serious consequences, shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years."

二、将刑法第一百一十五条第一款修改为：“放火、决水、爆炸以及投放毒害性、放射性、传染病病原体等物质或者以其他危险方法致人重伤、死亡或者使公私财产遭受重大损失的，处十年以上有期徒刑、无期徒刑或者死刑。”

II、 1st paragraph of Article 115 is amended as: "Whoever commits arson, breaches a dike, causes explosion, spreads pathogens of infectious diseases, poisonous or radioactive substances or other substances, or uses other dangerous means, thereby inflicting serious injury or death on people or causing heavy losses of public or private property, shall be sentenced to fixed-term imprisonment of no less than 10 years, life imprisonment or death."

三、将刑法第一百二十条第一款修改为：“组织、领导恐怖活动组织的，处十年以上有期徒刑或者无期徒刑；积极参加的，处三年以上十年以下有期徒刑；其他参加的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利。”

III、 Paragraph 1 of Article 120 of the Criminal Law is amended to read: "Whoever forms or leads a terrorist organization shall be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment; persons who actively participate in a terrorist organization shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; other participants shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights."

四、刑法第一百二十条后增加一条，作为第一百二十条之一：“资助恐怖活动组织或者实施恐怖活动的个人的，处五年以下有期徒刑、拘役、管制或者剥夺政治权利，并处罚金；情节严重的，处五年以上有期徒刑，并处罚金或者没收财产。

IV、 One article is added after Article 120 as Article 120A: "Whoever provides funds to any terrorist organization or individual who engages in terrorist activities shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention, public surveillance or deprivation of political rights, and shall also be fined; if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years, and shall also be fined or be sentenced to confiscation of property.

“单位犯前款罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，依照前款的规定处罚。”

"Where an organization commits the crime mentioned in the preceding paragraph, it shall be fined, and the persons directly in charge of the organization and other persons directly liable shall be punished in accordance with the provisions of the preceding paragraph."

五、将刑法第一百二十五条第二款修改为：“非法制造、买卖、运输、储存毒害性、放射性、传染病病原体等物质，危害公共安全的，依照前款的规定处罚。”

V、 2nd paragraph of Article 125 is amended as: "Whoever illegally manufactures, trades, transports or stores pathogens of infectious diseases, poisonous or radioactive substances or other substances, thereby endangering public security, shall be punished in accordance with the provisions of the preceding paragraph."

六、将刑法第一百二十七条修改为：“盗窃、抢夺枪支、弹药、爆炸物的，或者盗窃、抢夺毒害性、放射性、传染病病原体等物质，危害公共安全的，处三年以上十年以下有期徒刑；情节严重的，处十年以上有期徒刑、无期徒刑或者死刑。

VI、 Article 127 is revised to read: "Whoever steals or forcibly seizes any guns, ammunition or explosives, or steals or forcibly seizes pathogens of infectious diseases, poisonous or radioactive substances or other substances, thereby endangering public security, shall be sentenced to fixed-term imprisonment of not less than three years but not more than 10 years; if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death.

“抢劫枪支、弹药、爆炸物的，或者抢劫毒害性、放射性、传染病病原体等物质，危害公共安全的，或者盗窃、抢夺国家机关、军警人员、民兵的枪支、弹药、爆炸物的，处十年以上有期徒刑、无期徒刑或者死刑。”

"Whoever robs any gun, ammunition or explosive, or robs pathogens of infectious diseases, poisonous or radioactive substances or other substances, thereby endangering public security, or steals or forcibly seizes any gun, ammunition or explosive from State organs or members of the armed forces, the police or the people's militia, shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death."

七、将刑法第一百九十一条修改为：“明知是毒品犯罪、黑社会性质的组织犯罪、恐怖活动犯罪、走私犯罪的违法所得及其产生的收益，为掩饰、隐瞒其来源和性质，有下列行为之一的，没收实施以上犯罪的违法所得及其产生的收益，处五年以下有期徒刑或者拘役，并处或者单处洗钱数额百分之五以上百分之二十以下罚金；情节严重的，处五年以上十年以下有期徒刑，并处洗钱数额百分之五以上百分之二十以下罚金：(一)提供资金帐户的；(二)协助将财产转换为现金或者金融票据的；(三)通过转帐或者其他结算方式协助资金转移的；(四)协助将资金汇往境外的；(五)以其他方法掩饰、隐瞒犯罪的违法所得及其收益的来源和性质的。

VII、 Article 191 of the Criminal Law is amended as: "If anyone who is clearly aware that the proceeds are obtained from drug-related crimes, gangland crimes, terrorist crimes, or smuggling crimes, and that the proceeds are generated therefrom, commits any of the following acts so as to conceal or disguise the source or nature thereof, the illegal proceeds obtained from the commission of the aforementioned crimes and the proceeds generated therefrom shall be confiscated, and the criminal shall be sentenced to not more than five years of fixed-term imprisonment or criminal detention, and/or shall be imposed upon to a fine of not less than 5% but not more than 20% of the amount of money-laundering. If the circumstances are serious, he shall be sentenced to not less than five years but not more than 10 years in prison, and shall be imposed upon to a fine of not less than 5% but not more than 20% of the amount of money-laundering: (1) Providing any fund account; (2) Assisting in converting any property into cash or any financial instrument; (3) Assisting in the transfer of funds by way of account transfer or any other form of settlement; (4) Assisting in the remittance of funds abroad; (5) Disguising or concealing the source or nature of illegal proceeds obtained from any crime by any other means.

“单位犯前款罪的，对单位判处罚金，并对其直接负责的主管人员和其他直接责任人员，处五年以下有期徒刑或者拘役；情节严重的，处五年以上十年以下有期徒刑。”

"Where an organization commits the crime mentioned in the preceding paragraph, it shall be fined, and the persons directly in charge of the organization and other persons directly liable shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention; if the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not less than five years but not more than 10 years."

八、刑法第二百九十一条后增加一条，作为第二百九十一条之一：“投放虚假的爆炸性、毒害性、放射性、传染病病原体等物质，或者编造爆炸威胁、生化威胁、放射威胁等恐怖信息，或者明知是编造的恐怖信息而故意传播，严重扰乱社会秩序的，处五年以下有期徒刑、拘役或者管制；造成严重后果的，处五年以上有期徒刑。”

VIII、 One article is added after Article 291 as Article 291 (A): "Whoever spreads hoaxes of explosive, poisonous or radioactive substances, of infectious-disease pathogens or of other substances, fabricates terrorist information invoking explosive, biochemical, radioactive or other threats, or intentionally disseminates terrorist information while clearly knowing that it is fabricated, thereby seriously disturbing public order, shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance; if the consequences are serious, he shall be sentenced to fixed-term imprisonment of not less than five years."

九、本修正案自公布之日起施行。

IX、 This Amendment shall come into force as of the date of promulgation.
