《中華人民共和國國防交通法》已由中華人民共和國第十二屆全國人民代表大會常務委員會第二十二次會議於201693日通過,現予公布,自201711日起施行。

The Law of the People's Republic of China on Transportation for National Defense, adopted at the 22nd session of the Standing Committee of the 12th National People's Congress of the People's Republic of China on September 3, 2016, is hereby promulgated for implementation as of January 1, 2017.

第一章

Chapter 1 General Provisions

第一條   為了加強國防交通建設,促進交通領域軍民融合發展,保障國防活動順利進行,制定本法。

Article 1 This Law is enacted to strengthen the construction of national defense traffic, promote military-civilian integration in the traffic sector, and ensure the smooth progress of national defense activities.

第二條   以滿足國防需要為目的,在鐵路、道路、水路、航空、管道以及郵政等交通領域進行的規劃、建設、管理和資源使用活動,適用本法。

Article 2 This Law shall be applicable to the planning, construction, management and resource utilization in railways, roads, waterways, aviation, pipelines, postal services and other transportation areas, for the purpose of satisfying the needs of national defense.

第三條   國家堅持軍民融合發展戰略,推動軍地資源優化配置、合理共享,提高國防交通平時服務、急時應急、戰時應戰的能力,促進經濟建設和國防建設協調發展。

Article 3 The State insists on the development strategy of military and civilian integration, promotes the optimized allocation and reasonable sharing of military and local resources, enhances the capability of defense traffic in peacetime services, emergencies and wartime responses, and promotes the coordinated development of economic and defense construction.

國防交通工作遵循統一領導、分級負責、統籌規劃、平戰結合的原則。

National defense traffic shall be carried out under the principle of unified leadership, hierarchical responsibility, overall planning, and combination of wartime with peacetime.

第四條   國家國防交通主管機構負責規劃、組織、指導和協調全國的國防交通工作。國家國防交通主管機構的設置和工作職責,由國務院、中央軍事委員會規定。

Article 4 The central national defense traffic authority is responsible for planning, organizing, guiding, and coordinating national defense traffic. The organization and responsibilities of the central national defense traffic authority shall be defined by the State Council and the Central Military Commission.

縣級以上地方人民政府國防交通主管機構負責本行政區域的國防交通工作。

Responsible organs of transportation for national defense of the local people's governments above the county level shall be in charge of the transportation for national defense within their respective administrative regions.

縣級以上人民政府有關部門和有關軍事機關按照職責分工,負責有關的國防交通工作。

Relevant departments of the local governments above the county level and relevant military organs shall be in charge of relevant national defense traffic according to their respective responsibilities.

省級以上人民政府有關部門和軍隊有關部門建立國防交通軍民融合發展會商機制,相互通報交通建設和國防需求等情況,研究解決國防交通重大問題。

Relevant government departments and military organs above the provincial level shall establish a consultation mechanism for the integrated development of the military and civilian for national defense transportation, to communicate traffic construction and national defense demands, and study and solve major issues on national defense transportation.

第五條   公民和組織應當依法履行國防交通義務。

Article 5 Citizens and organizations shall fulfill their obligations of transportation for national defense according to law.

國家鼓勵公民和組織依法參與國防交通建設,並按照有關規定給予政策和經費支持。

The State encourages citizens and organizations to participate in the construction of transportation for national defense according to law, and shall provide policy and funding support in accordance with relevant provisions.

第六條   國防交通經費按照事權劃分的原則,列入政府預算。

Article 6 National defense traffic funds shall be included in the government budget based on the division of powers.

企業事業單位用於開展國防交通日常工作的合理支出,列入本單位預算,計入成本。

Reasonable expenses incurred in daily work of transportation for national defense by enterprises and public institutions shall be included into their respective budgets as cost.

第七條   縣級以上人民政府根據國防需要,可以依法征用民用運載工具、交通設施、交通物資等民用交通資源,有關組織和個人應當予以配合,履行相關義務。

Article 7 Governments above the county level may commandeer civil transportation resources, such as civil carriers, traffic facilities and traffic supplies. Relevant organizations and individuals shall cooperate to fulfill relevant obligations.

民用交通資源征用的組織實施和補償,依照有關法律、行政法規執行。

The implementation of and compensation for the requisition of civil traffic resources shall be conducted in line with relevant laws and administrative regulations.

第八條   各級人民政府應當將國防交通教育納入全民國防教育,通過多種形式開展國防交通宣傳活動,普及國防交通知識,增強公民的國防交通觀念。

Article 8 Governments at all levels shall include national defense traffic in national defense education, and carry out various activities to publicize national defense traffic, spread relevant knowledge, and enhance citizens' awareness of national defense traffic.

各級鐵路、道路、水路、航空、管道、郵政等行政管理部門(以下統稱交通主管部門)和相關企業事業單位應當對本系統、本單位的人員進行國防交通教育。

Administrative departments of railways, roads, waterways, airways, pipelines and postal services at all levels (hereinafter referred to as competent transportation authorities) and relevant enterprises and public institutions shall educate their personnel on the transportation for national defense.

設有交通相關專業的院校應當將國防交通知識納入相關專業課程或者單獨開設國防交通相關課程。

Universities with transport-related majors shall integrate national defense traffic into related majors or offer separate courses concerning national defense traffic.

第九條   任何組織和個人對在國防交通工作中知悉的國家秘密和商業秘密負有保密義務。

Article 9 Any organizations or individuals shall keep national and business secrets learned in national defense traffic work confidential.

第十條   對在國防交通工作中作出突出貢獻的組織和個人,按照國家有關規定給予表彰和獎勵。

Article 10 Organizations and individuals with outstanding contributions to the transportation for national defense shall be commended and awarded in accordance with the relevant national regulations.

第十一條   國家加強國防交通信息化建設,為提高國防交通保障能力提供支持。

Article 11 The State will strengthen information construction of national defense traffic, to provide support for improving the guarantee capacity of such traffic.

第十二條   戰時和平時特殊情況下,需要在交通領域采取行業管制、為武裝力量優先提供交通保障等國防動員措施的,依照《中華人民共和國國防法》、《中華人民共和國國防動員法》等有關法律執行。

Article 12 Traffic control during wartime and special situations in peacetime for the armed forces' prioritized provision of transportation, and other national defense mobilization measures shall be subject to the Law of the People's Republic of China on National Defense, the National Defense Mobilization Law of the People's Republic of China, and other applicable laws.

武裝力量組織進行軍事演習、訓練,需要對交通采取臨時性管制措施的,按照國務院、中央軍事委員會的有關規定執行。

Temporary traffic control due to drills and training of military forces shall be conducted in line with relevant regulations of the State Council and the Central Military Commission.

第十三條   戰時和平時特殊情況下,國家根據需要,設立國防交通聯合指揮機構,統籌全國或者局部地區的交通運輸資源,統一組織指揮全國或者局部地區的交通運輸以及交通設施設備的搶修、搶建與防護。相關組織和個人應當服從統一指揮。

Article 13 During wartime and under special circumstances during peacetime, a joint command authority of transportation for national defense shall be established by the State according to relevant needs to coordinate the transportation resources throughout the country or in certain areas, organize and command in a unified manner the transportation and urgent repair, construction and protection of transportation facilities across the country or in certain areas. Relevant organizations and individuals shall follow the unified command.

第二章 國防交通規劃

Chapter 2 Transportation Planning for National Defense

第十四條   國防交通規劃包括國防交通工程設施建設規劃、國防交通專業保障隊伍建設規劃、國防交通物資儲備規劃、國防交通科研規劃等。

Article 14 Transportation planning for national defense shall include the construction plan for the transportation engineering facilities for national defense, the construction plan for the professional guarantee teams for the transportation for national defense, the plan for material reserves for the transportation for national defense, scientific research plan for the transportation for national defense.

編制國防交通規劃應當符合下列要求:

The transportation plan for national defense shall be prepared according to the following requirements:

(一)滿足國防需要,有利於平戰快速轉換,保障國防活動順利進行;

1. satisfying the needs of national defense, favorable to the rapid conversion between wartime and peacetime, and ensuring the smooth implementation of national defense activities;

(二)兼顧經濟社會發展需要,突出重點,注重效益,促進資源融合共享;

2. emphasizing both economic and social development by highlighting key points and profits to promote resource integration and sharing;

(三)符合城鄉規劃和土地利用總體規劃,與國家綜合交通運輸體系發展規劃相協調;

(III) complying with the urban and rural planning and the overall planning on land utilization, and coordinating with the national comprehensive development planning of the transport system;

(四)有利於加強邊防、海防交通基礎設施建設,扶持沿邊、沿海經濟欠發達地區交通運輸發展;

(IV) benefiting the traffic infrastructure construction in border and coastal defense, and supporting the traffic development in the less developed border and coastal areas; and

(五)保護環境,節約土地、能源等資源。

(V) protecting the environment by saving land, energy and other resources.

第十五條   縣級以上人民政府應當將國防交通建設納入國民經濟和社會發展規劃。

Article 15 Governments above the county level shall include the construction of transportation for national defense into the national economic and social development plan.

國務院及其有關部門和省、自治區、直轄市人民政府制定交通行業以及相關領域的發展戰略、產業政策和規劃交通網絡布局,應當兼顧國防需要,提高國家綜合交通運輸體系保障國防活動的能力。

The State Council and relevant departments thereof as well as governments of provinces, autonomous regions and municipalities directly under the Central Government shall consider the needs of national defense to improve the national comprehensive transportation system so as to safeguard national defense activities when formulating transportation industry and related development strategies, industrial policies and traffic network planning.

國務院有關部門應當將有關國防要求納入交通設施、設備的技術標準和規範。有關國防要求由國家國防交通主管機構征求軍隊有關部門意見後匯總提出。

Relevant departments of the State Council shall include national defense requirements in the technical standards and specifications for traffic facilities and equipment. The national defense requirements shall be summarized and proposed by the central national defense traffic authority upon consultation with relevant military organs.

第十六條   國防交通工程設施建設規劃,由縣級以上人民政府國防交通主管機構會同本級人民政府交通主管部門編制,經本級人民政府發展改革部門審核後,報本級人民政府批準。

Article 16 The construction plan for national defense traffic engineering facilities shall be jointly prepared by the national defense traffic authority of the government at or above the county level and the traffic authority of the government at the same level, be reviewed by the development and reform department of the government at the same level, and be submitted to the government at the same level for approval.

下級國防交通工程設施建設規劃應當依據上一級國防交通工程設施建設規劃編制。

The construction plan for the engineering facilities of national defense transportation at lower levels shall be based on the construction plan for the engineering facilities of national defense transportation at higher levels.

編制國防交通工程設施建設規劃,應當征求有關軍事機關和本級人民政府有關部門的意見。縣級以上人民政府有關部門編制綜合交通運輸體系發展規劃和交通工程設施建設規劃,應當征求本級人民政府國防交通主管機構的意見,並納入國防交通工程設施建設的相關內容。

The preparation of the construction plan of national defense traffic engineering facilities shall consult relevant military organs and relevant departments of the government at the same level. Relevant departments of the people's governments above the county level that compile the development plan for the comprehensive transportation system and the construction plan for the engineering facilities of national defense transportation shall consult with the responsible organs of national defense transportation of the people's governments at the same level and include such opinions into the relevant content concerning the engineering facilities of national defense transportation.

第十七條   國防交通專業保障隊伍建設規劃,由國家國防交通主管機構會同國務院有關部門和軍隊有關部門編制。

Article 17 The construction plan for professional guarantee teams on national defense traffic shall be jointly prepared by the central national defense traffic authority, relevant departments of the State Council and relevant military organs.

第十八條   國防交通物資儲備規劃,由國防交通主管機構會同軍地有關部門編制。

Article 18 The reservation plan of national defense traffic supplies shall be jointly prepared by the national defense traffic authority and relevant military organs.

中央儲備的國防交通物資,由國家國防交通主管機構會同國務院交通主管部門和軍隊有關部門編制儲備規劃。

For materials for national defense transportation reserved by the Central Government, the reserve plan thereof shall be jointly prepared by the State's responsible organ for national defense transportation together with the competent organ of transportation under the State Council and relevant military departments.

地方儲備的國防交通物資,由省、自治區、直轄市人民政府國防交通主管機構會同本級人民政府有關部門和有關軍事機關編制儲備規劃。

The reservation plan of national defense traffic supplies by local governments shall be jointly prepared by the national defense traffic authority of provincial, autonomous regional, or municipal people's governments, relevant departments of the government at the same level and relevant military organs.

第十九條   國防交通科研規劃,由國家國防交通主管機構會同國務院有關部門和軍隊有關部門編制。

Article 19 The scientific research plan of national defense traffic shall be jointly prepared by the central national defense traffic authority, relevant departments of the State Council and military organs.

第三章 交通工程設施

Chapter III Traffic Engineering Facilities

第二十條   建設國防交通工程設施,應當以國防交通工程設施建設規劃為依據,保障戰時和平時特殊情況下國防交通暢通。

Article 20 The construction of national defense traffic engineering facilities shall be based on the construction plan of national defense traffic engineering facilities to ensure smooth traffic during wartime and under special circumstances during peacetime.

建設其他交通工程設施,應當依法貫徹國防要求,在建設中采用增強其國防功能的工程技術措施,提高國防交通保障能力。

The construction of other traffic engineering facilities shall be in line with the national defense requirements, and engineering measures that can enhance the national defense functions shall be adopted to improve the national defense traffic guarantee ability.

第二十一條   國防交通工程設施應當按照基本建設程序、相關技術標準和規範以及國防要求進行設計、施工和竣工驗收。相關人民政府國防交通主管機構組織軍隊有關部門參與項目的設計審定、竣工驗收等工作。

Article 21 The design, construction, and acceptance of national defense traffic engineering facilities shall follow basic construction procedures, relevant technical standards and specifications, and national defense requirements. Responsible organs of national defense transportation of relevant governments shall organize relevant military departments to participate in the design, approval and acceptance of projects.

交通工程設施建設中為增加國防功能修建的項目應當與主體工程同步設計、同步建設、同步驗收。

Projects constructed to enhance national defense functions in the construction of transportation engineering facilities shall be designed, constructed, and accepted simultaneously with the main projects.

第二十二條   國防交通工程設施在滿足國防活動需要的前提下,應當為經濟社會活動提供便利。

Article 22 The national defense traffic engineering facilities shall also be able to facilitate economic and social activities after meeting the needs of national defense activities.

第二十三條   國防交通工程設施管理單位負責國防交通工程設施的維護和管理,保持其國防功能。

Article 23 Management entities of the transportation engineering facilities for national defense shall be responsible for the maintenance and management of such facilities to maintain their national defense functions.

國防交通工程設施需要改變用途或者作報廢處理的,由國防交通工程設施管理單位逐級上報國家國防交通主管機構或者其授權的國防交通主管機構批準。

For transportation engineering facilities for national defense that need to change their use or be discarded as useless, management entities of the transportation engineering facilities for national defense shall report level by level to the State's responsible organ for national defense transportation or its authorized responsible organs for national defense transportation for approval.

縣級以上人民政府應當加強對國防交通工程設施維護管理工作的監督檢查。

Governments above the county level shall strengthen their supervision and inspection of the maintenance and management of national defense traffic engineering facilities.

第二十四條   任何組織和個人進行生產和其他活動,不得影響國防交通工程設施的正常使用,不得危及國防交通工程設施的安全。

Article 24 The production and other activities of any organization or individual shall not affect the normal operation of and endanger the security of national defense traffic engineering facilities.

第二十五條   縣級以上人民政府國防交通主管機構負責向本級人民政府交通主管部門以及相關企業事業單位了解交通工程設施建設項目的立項、設計、施工等情況;有關人民政府交通主管部門以及相關企業事業單位應當予以配合。

Article 25 Responsible organs of national defense transportation of the people's governments above the county level shall inquire about approval, design and construction situations of transportation engineering facilities construction projects from competent transportation authorities of the people's governments at the same level and relevant enterprises and public institutions shall cooperate.

第二十六條   縣級以上人民政府國防交通主管機構應當及時向有關軍事機關通報交通工程設施建設情況,並征求其貫徹國防要求的意見,匯總後提出需要貫徹國防要求的具體項目。

Article 26 Responsible organs of national defense transportation of the people's governments above the county level shall inform relevant military organs of the construction situation of the transportation engineering facilities in a timely manner, seek their opinions on the implementation of national defense requirements, and determine the specific projects that need to implement the national defense requirements.

第二十七條   對需要貫徹國防要求的交通工程設施建設項目,由有關人民政府國防交通主管機構會同本級人民政府發展改革部門、財政部門、交通主管部門和有關軍事機關,與建設單位協商確定貫徹國防要求的具體事宜。

Article 27 For construction projects of transportation engineering facilities that implement the requirements for national defense, responsible organs of national defense transportation of relevant governments together with the development and reform department, finance department, competent transportation authority of the people's government at the same level and relevant military organs shall negotiate with the construction unit to determine specific matters concerning the implementation of national defense requirements.

交通工程設施新建、改建、擴建項目因貫徹國防要求增加的費用由國家承擔。有關部門應當對項目的實施予以支持和保障。

The additional expenses of newly built, renovated and expanded traffic engineering facilities for carrying out national defense requirements will be borne by the State. Relevant departments shall support and guarantee the implementation of such projects.

第二十八條   各級人民政府對國防交通工程設施建設項目和貫徹國防要求的交通工程設施建設項目,在土地使用、城鄉規劃、財政、稅費等方面,按照國家有關規定給予政策支持。

Article 28 People's governments at all levels shall provide policy support in terms of land use, urban and rural planning, finance, tax and other aspects to the construction projects of transportation engineering facilities for national defense and to the construction projects of transportation engineering facilities that implement national defense requirements in accordance with relevant national provisions.

第四章 民用運載工具

Chapter 4 Civil Carriers

第二十九條   國家國防交通主管機構應當根據國防需要,會同國務院有關部門和軍隊有關部門,確定需要貫徹國防要求的民用運載工具的類別和範圍,及時向社會公布。

Article 29 The central national defense traffic authority shall determine the types and range of civil carriers that need to implement national defense requirements together with relevant departments of the State Council and relevant military organs based on the national defense needs, and promptly disclose the information to the public.

國家鼓勵公民和組織建造、購置、經營前款規定的類別和範圍內的民用運載工具及其相關設備。

The State encourages citizens and organizations to build, purchase and operate civil carriers and related equipment within the aforesaid types and scope.

第三十條   縣級以上人民政府國防交通主管機構應當向民用運載工具登記管理部門和建造、購置人了解需要貫徹國防要求的民用運載工具的建造、購置、使用等情況,有關公民和組織應當予以配合。

Article 30 Responsible organs of transportation for national defense under the people's governments above the county level shall inquire about situations on the construction, purchase and use of civil carriers that implement the requirements of national defense from competent authorities for civil carrier registration and producers or purchasers of such carriers, and citizens and organizations concerned shall cooperate.

第三十一條   縣級以上人民政府國防交通主管機構應當及時將掌握的民用運載工具基本情況通報有關軍事機關,並征求其貫徹國防要求的意見,匯總後提出需要貫徹國防要求的民用運載工具的具體項目。

Article 31 The national defense traffic authority of the government at or above the county level shall promptly inform relevant military organs of the basic information of civil carriers, and seek their opinions on implementing the national defense requirements, and determine specific projects of civil carriers that need to implement the national defense requirements.

第三十二條   對需要貫徹國防要求的民用運載工具的具體項目,由縣級以上人民政府國防交通主管機構會同本級人民政府財政部門、交通主管部門和有關軍事機關,與有關公民和組織協商確定貫徹國防要求的具體事宜,並簽訂相關協議。

Article 32 For specific items of civil carriers that need to implement national defense requirements, the national defense traffic authority of the government at or above the county level shall, together with the fiscal department, traffic department and relevant military organs of the government at the same level, negotiate with citizens and organizations to determine specific matters for the implementation of national defense requirements, and sign relevant agreements.

第三十三條   民用運載工具因貫徹國防要求增加的費用由國家承擔。有關部門應當對民用運載工具貫徹國防要求的實施予以支持和保障。

Article 33 The additional expenses of civil carriers for carrying out the national defense requirements shall be borne by the State. Relevant departments shall provide support and guarantees for civil carriers' implementation of national defense requirements.

各級人民政府對貫徹國防要求的民用運載工具在服務采購、運營範圍等方面,按照有關規定給予政策支持。

Governments at all levels shall provide civil carriers that implement national defense requirements with policy support in the service procurement and operation scope in accordance with relevant provisions.

第三十四條   貫徹國防要求的民用運載工具所有權人、承租人、經營人負責民用運載工具的維護和管理,保障其使用效能。

Article 34 Owners, lessees, and operators of civil carriers that implement national defense requirements shall be responsible for maintenance and management of such civil carriers to ensure their effectiveness.

第五章 國防運輸

Chapter 5 National Defense Transportation

第三十五條   縣級以上人民政府交通主管部門會同軍隊有關交通運輸部門按照統一計劃、集中指揮、迅速準確、安全保密的原則,組織國防運輸。

Article 35 Responsible organs of transportation for national defense under the people's governments above the county level shall organize the transportation for national defense together with related military transportation departments in accordance with the principle of unified planning, centralized command, swiftness and accuracy, security and confidentiality.

承擔國防運輸任務的公民和組織應當優先安排國防運輸任務。

Citizens and organizations responsible for transportation tasks of national defense shall prioritize such transportation tasks.

第三十六條   國家以大中型運輸企業為主要依托,組織建設戰略投送支援力量,增強戰略投送能力,為快速組織遠距離、大規模國防運輸提供有效支持。

Article 36 The State relies mainly on large and medium transportation enterprises, to organize and builds up the strategic projection support force and enhance strategic projection capability, so as to provide effective support for rapidly organizing long-distance and large-scale national defense transportation.

承擔戰略投送支援任務的企業負責編組人員和裝備,根據有關規定制定實施預案,進行必要的訓練、演練,提高執行戰略投送任務的能力。

Enterprises undertaking strategic projection support tasks shall organize personnel and equipment, formulate implementation plans in line with relevant regulations, and conduct necessary training and drills to improve the capacity to execute strategic projection tasks.

第三十七條   各級人民政府和軍事機關應當加強國防運輸供應、裝卸等保障設施建設。

Article 37 Governments and military organs at all levels shall strengthen the construction of national defense transportation supply, loading and unloading, and other support facilities.

縣級以上地方人民政府和相關企業事業單位,應當根據國防運輸的需要提供飲食飲水供應、裝卸作業、醫療救護、通行與休整、安全警衛等方面的必要的服務或者保障。

Local people's governments at or above the county level and relevant enterprises and public institutions shall provide food and drinking water supply, loading and unloading operations, medical aid, transit and rest, security guards and other necessary services and guarantees in light of the needs of national defense transportation.

第三十八條   國家駐外機構和我國從事國際運輸業務的企業及其境外機構,應當為我國實施國際救援、海上護航和維護國家海外利益的軍事行動的船舶、飛機、車輛和人員的補給、休整提供協助。

Article 38 National institutions functioning abroad and enterprises engaged in international transportation and their overseas offices shall provide assistance in the supply, rest and reorganization of ships, airplanes, vehicles and personnel engaged in international rescue, maritime escort, and military actions safeguarding the national interests abroad.

國家有關部門應當對前款規定的機構和企業為海外軍事行動提供協助所需的人員和運輸工具、貨物等的出境入境提供相關便利。

Relevant departments of the State shall facilitate the exit or entry of personnel, means of transport, and goods needed by the institutions and enterprises specified in the preceding paragraph to provide assistance for overseas military operations.

第三十九條   公民和組織完成國防運輸任務所發生的費用,由使用單位按照不低於市場價格的原則支付。具體辦法由國務院財政部門、交通主管部門和中央軍事委員會後勤保障部規定。

Article 39 Expenses incurred by citizens and organizations for transportation tasks of national defense shall be paid by the using entities at a price not lower than the market price. The specific measures shall be formulated by the finance department of the State Council, the communications administrative department and the Logistics Department of the Central Military Commission.

第四十條   軍隊根據需要,可以在相關交通企業或者交通企業較為集中的地區派駐軍事代表,會同有關單位共同完成國防運輸和交通保障任務。

Article 40 The military may station military representatives at relevant transportation enterprises or at such places where a large number of transportation enterprises are concentrated to work with relevant entities for safeguarding the transportation tasks of national defense.

軍事代表駐在單位和駐在地人民政府有關部門,應當為軍事代表開展工作提供便利。

Entities and relevant departments of local people's governments at which military representatives are stationed shall provide convenience to military representatives for their work.

軍事代表的派駐和工作職責,按照國務院、中央軍事委員會的有關規定執行。

The military representatives shall fulfill their stationing and responsibilities in accordance with the relevant provisions of the State Council and the Central Military Commission.

第六章 國防交通保障

Chapter 6 National Defense Traffic Guarantee

第四十一條   各級國防交通主管機構組織人民政府有關部門和有關軍事機關制定國防交通保障方案,明確重點交通目標、線路以及保障原則、任務、技術措施和組織措施。

Article 41 National defense traffic authorities at all levels shall organize relevant government departments and military organs to formulate guarantee plans for national defense traffic, specifying key traffic targets, routes, guarantee principles, tasks, technical measures, and organization methods.

第四十二條   國務院有關部門和縣級以上地方人民政府按照職責分工,組織有關企業事業單位實施交通工程設施搶修、搶建和運載工具搶修,保障國防活動順利進行。有關軍事機關應當給予支持和協助。

Article 42 Relevant departments of the State Council and local people's governments above the county level shall, according to their respective responsibilities, organize relevant enterprises and public institutions to conduct urgent repair and construction of traffic engineering facilities as well as urgent repair of means of delivery, so as to ensure the smooth implementation of national defense activities. Relevant military organs shall provide due support and assistance.

第四十三條   國防交通保障方案確定的重點交通目標的管理單位和預定承擔保障任務的單位,應當根據有關規定編制重點交通目標保障預案,並做好相關準備。

Article 43 Management units of key traffic targets and preplanned units for guarantee tasks specified in guarantee plans for national defense traffic shall formulate guarantee plans for key traffic targets according to relevant provisions and make preparations accordingly.

第四十四條   重點交通目標的管理單位和預定承擔保障任務的單位,在重點交通目標受到破壞威脅時,應當立即啟動保障預案,做好相應準備;在重點交通目標遭受破壞時,應當按照任務分工,迅速組織實施工程加固和搶修、搶建,盡快恢複交通。

Article 44 Management entities for core transportation targets and entities for safeguarding tasks shall activate the guarantee plan immediately and make preparations once the core transportation targets are damaged or threatened; and shall organize and implement the reinforcement, urgent repair and urgent construction work rapidly according to their respective responsibilities when such core targets are damaged so as to restore the transportation as soon as possible.

與國防運輸有關的其他交通工程設施遭到破壞的,其管理單位應當及時按照管理關系向上級報告,同時組織修複。

Where other transportation engineering facilities related to national defense transportation are damaged, their management entities shall timely report to their superior entities based on the administrative relations, and organize the repair.

第四十五條   縣級以上人民政府國防交通主管機構會同本級人民政府國土資源、城鄉規劃等主管部門確定預定搶建重要國防交通工程設施的土地,作為國防交通控制範圍,納入土地利用總體規劃和城鄉規劃。

Article 45 National defense traffic authorities of governments above the county level, together with authorities of local land and resources as well as urban and rural planning, shall determine the land for urgent construction of national defense traffic engineering facilities, which shall be included in the overall land use plan and urban and rural planning for national defense traffic control.

未經縣級以上人民政府國土資源主管部門、城鄉規劃主管部門和國防交通主管機構批準,任何組織和個人不得占用作為國防交通控制範圍的土地。

No organizations or individuals shall occupy any land used as national defense traffic control area without the approval of competent authorities of land and resources, urban and rural planning, and national defense traffic authorities of governments above the county level.

第四十六條   重點交通目標的對空、對海防禦,由軍隊有關部門納入對空、對海防禦計劃,統一組織實施。

Article 46 Air and sea defense of key traffic targets shall be included into the air and sea defense plan by relevant military departments for unified implementation.

重點交通目標的地面防衛,由其所在地縣級以上人民政府和有關軍事機關共同組織實施。

Ground defense of core traffic targets shall be jointly implemented by local governments above the county level and relevant military organs.

重點交通目標的工程技術防護,由其所在地縣級以上人民政府交通主管部門會同本級人民政府國防交通主管機構、人民防空主管部門,組織指導其管理單位和保障單位實施。

Competent transportation authorities of the people's governments above the county level together with competent transportation authorities of national defense under the people's governments at the same level and competent authorities of civil air defense shall organize and guide their management units and guarantee units to implement the engineering technical protection of key transportation targets.

重點交通目標以外的其他交通設施的防護,由其所在地縣級以上人民政府按照有關規定執行。

Protection for other traffic facilities besides key targets shall be conducted by local governments above the county level according to relevant provisions.

第四十七條   因重大軍事行動和國防科研生產試驗以及與國防相關的保密物資、危險品運輸等特殊需要,縣級以上人民政府有關部門應當按照規定的權限和程序,在相關地區的陸域、水域、空域采取必要的交通管理措施和安全防護措施。有關軍事機關應當給予協助。

Article 47 Competent departments of governments above the county level shall take necessary traffic control and protection measures in land, water and air areas of relevant regions in accordance with the prescribed authorities and procedures due to special needs in significant military actions, defense research, production and test as well as transportation of confidential and dangerous materials relating to national defense. Relevant military organs shall provide due assistance.

第四十八條   縣級以上人民政府交通主管部門和有關軍事機關、國防交通主管機構應當根據需要,組織相關企業事業單位開展國防交通專業保障隊伍的訓練、演練。

Article 48 Competent transportation authorities of the people's governments above the county level, relevant military organs and responsible organs of transportation for national defense shall organize relevant enterprises and public institutions to carry out training and drills for professional guarantee teams of transportation for national defense as needed.

國防交通專業保障隊伍由企業事業單位按照有關規定組建。

Professional guarantee contingents of transportation for national defense shall be established by enterprises and public institutions in accordance with relevant provisions.

參加訓練、演練的國防交通專業保障隊伍人員的生活福利待遇,參照民兵參加軍事訓練的有關規定執行。

Welfare benefits of personnel of professional guarantee teams of transportation for national defense participating in such training and drill shall be subject to relevant provisions applicable to militia participating in military training.

第四十九條   國防交通專業保障隊伍執行國防交通工程設施搶修、搶建、防護和民用運載工具搶修以及人員物資搶運等任務,由縣級以上人民政府國防交通主管機構會同本級人民政府交通主管部門統一調配。

Article 49 National defense traffic authorities and traffic authorities of governments above the county level shall implement unified deployment for urgent repair, construction, and protection of national defense traffic engineering facilities, urgent repair of civil carriers, and urgent transportation of personnel and materials by professional guarantee contingents of national defense traffic.

國防交通專業保障隊伍的車輛、船舶和其他機動設備,執行任務時按照國家國防交通主管機構的規定設置統一標志,可以優先通行。

Vehicles, ships, and other power equipment of professional guarantee contingents of national defense traffic shall bear unified marks as required by the national defense traffic authority to gain traffic priority.

第五十條   各級人民政府對承擔國防交通保障任務的企業和個人,按照有關規定給予政策支持。

Article 50 People's governments at all levels shall provide policy support to enterprises and individuals undertaking transportation guarantee tasks for national defense pursuant to the relevant provisions.

第七章 國防交通物資儲備

Chapter 7 Material Reserves for National Defense Transportation

第五十一條   國家建立國防交通物資儲備制度,保證戰時和平時特殊情況下國防交通順暢的需要。

Article 51 The State has established a system for material reserves for national defense transportation so as to ensure smooth transportation for national defense during wartime and under special circumstances during peacetime.

國防交通物資儲備應當布局合理、規模適度,儲備的物資應當符合國家規定的質量標準。

Materials reserved for national defense transportation shall be reasonably distributed at an appropriate scale, and shall meet the national quality standards.

國防交通儲備物資的品種由國家國防交通主管機構會同國務院有關部門和軍隊有關部門規定。

The types of reserved national defense traffic supplies shall be jointly determined by the central national defense traffic authority, relevant departments of the State Council and relevant military organs.

第五十二條   國務院交通主管部門和省、自治區、直轄市人民政府國防交通主管機構,應當按照有關規定確定國防交通儲備物資儲存管理單位,監督檢查國防交通儲備物資管理工作。

Article 52 Competent transportation authorities of transportation for national defense under the State Council and responsible organs of transportation for national defense of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, in accordance with the relevant provisions, determine the administrative entities for material reserves for national defense transportation, and supervise and inspect the administration of material reserves for national defense transportation.

國防交通儲備物資儲存管理單位應當建立健全管理制度,按照國家有關規定和標準對儲備物資進行保管、維護和更新,保證儲備物資的使用效能和安全,不得挪用、損壞和丟失儲備物資。

The units for reservation and management of national defense traffic supplies shall establish a sound management system, and safekeep, maintain, and update the reserved supplies according to national regulations and standards to ensure the effectiveness of use and security of the reserved supplies, and shall not misappropriate, damage, or lose the reserved supplies.

第五十三條   戰時和平時特殊情況下執行交通防護和搶修、搶建任務,或者組織重大軍事演習,搶險救災以及國防交通專業保障隊伍訓練、演練等需要的,可以調用國防交通儲備物資。

Article 53 Reserved national defense traffic supplies can be allocated to traffic protection and urgent repair and construction during wartime and special situations in peacetime, major military exercises, disaster relief, and training and exercises of professional guarantee teams of national defense traffic.

調用中央儲備的國防交通物資,由國家國防交通主管機構批準;調用地方儲備的國防交通物資,由省、自治區、直轄市人民政府國防交通主管機構批準。

Allocation of central reserved national defense supplies shall be approved by the central national defense traffic authority; allocation of local reserved national defense supplies shall be approved by national defense traffic authorities of provincial, autonomous regional, or municipal people's governments.

國防交通儲備物資儲存管理單位,應當嚴格執行儲備物資調用指令,不得拒絕或者拖延。

Administrative entities for material reserves for national defense transportation shall strictly execute the deployment order of material reserves and shall not refuse or delay such order.

未經批準,任何組織和個人不得動用國防交通儲備物資。

No organizations or individuals may use reserved national defense traffic supplies without approval.

第五十四條   國防交通儲備物資因產品技術升級、更新換代或者主要技術性能低於使用維護要求,喪失儲備價值的,可以改變用途或者作報廢處理。

Article 54 Reserved national defense traffic supplies may be used for other purposes or scrapped due to technology upgrades, product updates, major technical performance degradation, or loss of reservation value.

中央儲備的國防交通物資需要改變用途或者作報廢處理的,由國家國防交通主管機構組織技術鑒定並審核後,報國務院財政部門審批。

Function alteration or scrapping of central reserved national defense traffic supplies shall be identified and reviewed by the central national defense traffic authority before approval by the fiscal department of the State Council.

地方儲備的國防交通物資需要改變用途或者作報廢處理的,由省、自治區、直轄市人民政府國防交通主管機構組織技術鑒定並審核後,報本級人民政府財政部門審批。

Function alteration or scrapping of local reserved national defense traffic supplies shall be identified and reviewed by the national defense traffic authority of provincial, autonomous regional, or municipal people's governments before approval by the fiscal department of the government at the same level.

中央和地方儲備的國防交通物資改變用途或者報廢獲得的收益,應當上繳本級國庫,納入財政預算管理。

Where materials of national defense transportation reserved by the Central Government and local governments are to be changed in their use or be discarded as useless, such materials shall be handed over to the State Treasury at the corresponding level and included in the fiscal budget management.

第八章 法律責任

Chapter 8 Legal Liabilities

第五十五條   違反本法規定,有下列行為之一的,由縣級以上人民政府交通主管部門或者國防交通主管機構責令限期改正,對負有直接責任的主管人員和其他直接責任人員依法給予處分;有違法所得的,予以沒收,並處違法所得一倍以上五倍以下罰款:

Article 55 Where any party commits any of the following acts in violation of the provisions hereof, the competent transportation authority of the people's government above the county level or the competent transportation authority for national defense shall order it to make corrections within a time limit, and impose punishments on the person directly in charge and other directly liable persons; and confiscate illegal gains, if any, and impose a fine of not less than one time but not more than five times of the illegal gains:

(一)擅自改變國防交通工程設施用途或者作報廢處理的;

1. Altering the use of engineering facilities of transportation for national defense or undertaking disposal without approval;

(二)拒絕或者故意拖延執行國防運輸任務的;

2. Refuse or purposely delay national defense transportation;

(三)拒絕或者故意拖延執行重點交通目標搶修、搶建任務的;

(III) Refuse or purposely delay urgent repair and construction of key traffic targets.

(四)拒絕或者故意拖延執行國防交通儲備物資調用命令的;

(IV) Refuse or purposely delay execution of allocation orders of reserved national defense traffic supplies;

(五)擅自改變國防交通儲備物資用途或者作報廢處理的;

(V) Alter the function of or scrap reserved national defense traffic supplies without authorization;

(六)擅自動用國防交通儲備物資的;

(VI) Use reserved national defense traffic supplies without authorization;

(七)未按照規定保管、維護國防交通儲備物資,造成損壞、丟失的。

(VII) Damage and loss of reserved national defense traffic supplies due to non-compliance with regulations in safekeeping and maintenance.

上述違法行為造成財產損失的,依法承擔賠償責任。

Where losses are caused to property as a result of the above illegal acts, the liability for compensation shall be assumed in accordance with the law.

第五十六條   國防交通主管機構、有關軍事機關以及交通主管部門和其他相關部門的工作人員違反本法規定,有下列情形之一的,對負有直接責任的主管人員和其他直接責任人員依法給予處分:

Article 56 Where personnel of responsible organs of transportation for national defense, relevant military organs, competent transportation authorities or other relevant departments violate this Law, if any of the following circumstances applies, the directly responsible person in charge and other directly responsible persons shall be punished in accordance with the law:

(一)濫用職權或者玩忽職守,給國防交通工作造成嚴重損失的;

1. Any state functionary who abuses his/her power of office or neglects his/her duties, causing serious damages to national defense traffic;

(二)貪汙、挪用國防交通經費、物資的;

2. Any state functionary who embezzles or misappropriates defense traffic funds and materials;

(三)泄露在國防交通工作中知悉的國家秘密和商業秘密的;

(III) Divulging state and commercial secrets learned in national defense traffic work;

(四)在國防交通工作中侵害公民或者組織合法權益的。

(IV) Infringing the legitimate rights and interests of citizens or organizations in national defense traffic work.

第五十七條   違反本法規定,構成違反治安管理行為的,依法給予治安管理處罰;構成犯罪的,依法追究刑事責任。

Article 57 For violation of the provisions of this Law which constitute a violation of public security administration, the offender shall be subject to public security administration punishment pursuant to the law; where the case constitutes a criminal offence, criminal liability shall be pursued in accordance with the law.

第九章

Chapter 9 Supplementary Provisions

第五十八條   本法所稱國防交通工程設施,是指國家為國防目的修建的交通基礎設施以及國防交通專用的指揮、檢修、裝卸、倉儲等工程設施。

Article 58 National defense traffic engineering facilities herein refer to the traffic infrastructure and special command, repair, handling, and storage facilities built for national defense.

本法所稱國防運輸,是指政府和軍隊為國防目的運用軍民交通運輸資源,運送人員、裝備、物資的活動。軍隊運用自身資源進行的運輸活動,按照中央軍事委員會有關規定執行。

National defense transportation herein refers to the activities of governments and armies to transport personnel, equipment, and materials with military and civilian traffic resources for the purpose of national defense. Transportation activities conducted by armies with their own resources shall comply with the relevant provisions of the Central Military Commission.

第五十九條   與國防交通密切相關的信息設施、設備和專業保障隊伍的建設、管理、使用活動,適用本法。

Article 59 This law applies to the construction, management and employment of information facilities, equipment and professional guarantee teams closely related to national defense traffic.

國家對信息動員另有規定的,從其規定。

Where the State has other provisions on information mobilization, such provisions shall prevail.

第六十條   本法自201711日起施行。

Article 60 This Law shall come into force as of January 1, 2017.
