《中華人民共和國國防動員法》已由中華人民共和國第十一屆全國人民代表大會常務委員會第十三次會議於2010年2月26日通過,現予公布,自2010年7月1日起施行。
The Law of the People's Republic of China on National Defense Mobilization, which was adopted at the 13th session of the Standing Committee of the 11th National People's Congress of the People's Republic of China on February 26, 2010, is hereby promulgated for implementation as of July 1, 2010.

第一章 總 則
Chapter 1 General Provisions
第一條 為了加強國防建設,完善國防動員制度,保障國防動員工作的順利進行,維護國家的主權、統一、領土完整和安全,根據憲法,制定本法。
Article 1 In order to strengthen the national defense construction, improve the national defense mobilization system, ensure the smooth progress of national defense mobilization work and safeguard the sovereignty, unity, territorial integrity and security of the country, this Law is formulated in accordance with the Constitution.
第二條 國防動員的準備、實施以及相關活動,適用本法。
Article 2 This Law applies to the preparation and implementation of, and other activities related to national defense mobilization.
第三條 國家加強國防動員建設,建立健全與國防安全需要相適應、與經濟社會發展相協調、與突發事件應急機制相銜接的國防動員體系,增強國防動員能力。
Article 3 The State shall strengthen the construction for national defense mobilization and establish and improve a national defense mobilization system that is in line with the needs of national defense security, in coordination with the economic and social development and in connection with the emergency response mechanism for emergencies to enhance the capability of national defense mobilization.
第四條 國防動員堅持平戰結合、軍民結合、寓軍於民的方針,遵循統一領導、全民參與、長期準備、重點建設、統籌兼顧、有序高效的原則。
Article 4 National defense mobilization shall be subject to the guidelines of combining peacetime with wartime, combining army and people, and having army among the people, as well as the principles of unified leadership, participation of the whole people, long-term preparation, key construction, overall planning and all-round consideration, orderliness and efficiency.
第五條 公民和組織在和平時期應當依法完成國防動員準備工作;國家決定實施國防動員後,應當完成規定的國防動員任務。
Article 5 Citizens and organizations shall complete the preparatory work for national defense mobilization according to the law in peacetime; and, once the State has decided to implement national defense mobilization, shall complete the required national defense mobilization tasks.
第六條 國家保障國防動員所需經費。國防動員經費按照事權劃分的原則,分別列入中央和地方財政預算。
Article 6 The State shall ensure the availability of the funds required for national defense mobilization. National defense mobilization funds shall be separately included in the central and local government budgets pursuant to the principle of the division of duties.
第七條 國家對在國防動員工作中作出突出貢獻的公民和組織,給予表彰和獎勵。
Article 7 The State shall commend and reward citizens and organizations that have made outstanding contributions to national defense mobilization.
第二章 組織領導機構及其職權
Chapter 2 Organizational and Leadership Institutions and Authorities Thereof
第八條 國家的主權、統一、領土完整和安全遭受威脅時,全國人民代表大會常務委員會依照憲法和有關法律的規定,決定全國總動員或者局部動員。國家主席根據全國人民代表大會常務委員會的決定,發布動員令。
Article 8 In the case of any threat to the State's sovereignty, unity, territorial integrity or security, the Standing Committee of the National People's Congress shall, in accordance with the Constitution and relevant laws, decide on nationwide or partial mobilization. The President of the State shall issue a mobilization order in accordance with the decision of the Standing Committee of the National People's Congress.
第九條 國務院、中央軍事委員會共同領導全國的國防動員工作,制定國防動員工作的方針、政策和法規,向全國人民代表大會常務委員會提出實施全國總動員或者局部動員的議案,根據全國人民代表大會常務委員會的決定和國家主席發布的動員令,組織國防動員的實施。
Article 9 The State Council and the Central Military Commission shall jointly lead national defense mobilization across the country, and work out guidelines, policies and regulations on national defense mobilization, propose a bill of implementing nationwide or partial mobilization to the Standing Committee of the National People's Congress, and, in accordance with the decision of the Standing Committee of the National People's Congress and the mobilization decree issued by the president of the People's Republic of China, organize the implementation of national defense mobilization.
國家的主權、統一、領土完整和安全遭受直接威脅必須立即采取應對措施時,國務院、中央軍事委員會可以根據應急處置的需要,采取本法規定的必要的國防動員措施,同時向全國人民代表大會常務委員會報告。
Where immediate measures must be taken to respond to any direct threat to the State's sovereignty, unity, territorial integrity or security, the State Council and the Central Military Commission may take necessary national defense mobilization measures as specified herein if it is necessary for an emergency response, and report the same to the Standing Committee of the National People's Congress at the same time.
第十條 地方人民政府應當貫徹和執行國防動員工作的方針、政策和法律、法規;國家決定實施國防動員後,應當根據上級下達的國防動員任務,組織本行政區域國防動員的實施。
Article 10 Local people's governments shall implement and put in practice the guidelines, policies, laws and regulations concerning national defense mobilization; and shall organize the implementation of national defense mobilization within their respective administrative region depending on the national defense mobilization tasks assigned by the people's governments at a higher level, after the State has decided to implement national defense mobilization.
縣級以上地方人民政府依照法律規定的權限管理本行政區域的國防動員工作。
Local people's governments at or above the county level shall manage the national defense mobilization work within their respective administrative regions according to the authority granted by law.
第十一條 縣級以上人民政府有關部門和軍隊有關部門在各自的職責範圍內,負責有關的國防動員工作。
Article 11 Related departments under the people's governments at or above the county level and related military departments shall be responsible for the related national defense mobilization work within their respective duties.
第十二條 國家國防動員委員會在國務院、中央軍事委員會的領導下負責組織、指導、協調全國的國防動員工作;按照規定的權限和程序議定的事項,由國務院和中央軍事委員會的有關部門按照各自職責分工組織實施。軍區國防動員委員會、縣級以上地方各級國防動員委員會負責組織、指導、協調本區域的國防動員工作。
Article 12 The State Commission for National Defense Mobilization, under the leadership of the State Council and the Central Military Commission, shall take charge of organizing, guiding, and coordinating the national defense mobilization across the whole country; for matters decided under certain procedures according to the relevant authority, related departments under the State Council and the Central Military Commission shall organize the implementation of such matters according to their respective duties. National defense mobilization commissions of all military commands and local National defense mobilization commissions at or above the county level shall be in charge of organizing, guiding and coordinating the National defense mobilization work within the local area.
第十三條 國防動員委員會的辦事機構承擔本級國防動員委員會的日常工作,依法履行有關的國防動員職責。
Article 13 Offices of national defense mobilization commissions shall undertake the routine work of their corresponding national defense mobilization commissions and fulfill their relevant responsibilities in national defense mobilization in accordance with the law.
第十四條 國家的主權、統一、領土完整和安全遭受的威脅消除後,應當按照決定實施國防動員的權限和程序解除國防動員的實施措施。
Article 14 After the threat to the State's sovereignty, unity, territorial integrity or security has been eliminated, measures for implementing national defense mobilization shall be terminated in accordance with the authority and procedures based on which it is decided to implement national defense mobilization.
第三章 國防動員計劃、實施預案與潛力統計調查
Chapter III National Defense Mobilization Plans, Implementing Plans and Statistical Survey on the Capacity for National Defense Mobilization
第十五條 國家實行國防動員計劃、國防動員實施預案和國防動員潛力統計調查制度。
Article 15 The State adopts plans and implementing plans for national defense mobilization and statistical survey on the capacity for national defense mobilization.
第十六條 國防動員計劃和國防動員實施預案,根據國防動員的方針和原則、國防動員潛力狀況和軍事需求編制。軍事需求由軍隊有關部門按照規定的權限和程序提出。
Article 16 National defense mobilization plans and implementing plans for National defense mobilization shall be drawn up under the guidelines and principles of National defense mobilization and according to the state of the capacity for National defense mobilization and the military demands. Military demands shall be proposed by related military departments according to the prescribed authority and procedures.
國防動員實施預案與突發事件應急處置預案應當在指揮、力量使用、信息和保障等方面相互銜接。
Implementing plans for national defense mobilization and emergency response plans for emergencies shall be connected with each other in respect of the command, use of forces, information, support, etc.
第十七條 各級國防動員計劃和國防動員實施預案的編制和審批,按照國家有關規定執行。
Article 17 National defense mobilization plans and implementing plans for National defense mobilization at all levels shall be drawn up and approved in accordance with the applicable provisions of the State.
第十八條 縣級以上人民政府應當將國防動員的相關內容納入國民經濟和社會發展計劃。軍隊有關部門應當將國防動員實施預案納入戰備計劃。
Article 18 The people's governments at or above the county level shall include contents relating to national defense mobilization into the national economic and social development plans. Related military departments shall include the national defense mobilization implementation plans in the preparedness plans against war.
縣級以上人民政府及其有關部門和軍隊有關部門應當按照職責落實國防動員計劃和國防動員實施預案。
The people's governments at or above the county level as well as related departments thereof and related military departments shall put in place the national defense mobilization plans and the implementing plans for national defense mobilization ex officio.
第十九條 縣級以上人民政府統計機構和有關部門應當根據國防動員的需要,準確及時地向本級國防動員委員會的辦事機構提供有關統計資料。提供的統計資料不能滿足需要時,國防動員委員會辦事機構可以依據《中華人民共和國統計法》和國家有關規定組織開展國防動員潛力專項統計調查。
Article 19 Statistical departments and other related departments under the people's governments at or above the county level shall, in light of the needs of national defense mobilization, promptly provide the national defense mobilization commissions at the same level with accurate statistical materials. If the statistical materials provided are unable to meet the needs, representative offices of the national defense mobilization commissions may organize and conduct special statistical surveys to look at the capacity for national defense mobilization in accordance with the Statistics Law of the People's Republic of China and applicable provisions of the State.
第二十條 國家建立國防動員計劃和國防動員實施預案執行情況的評估檢查制度。
Article 20 The State has established a system to evaluate and check efforts in implementing the national defense mobilization plans and the implementing plans for national defense mobilization.
第四章 與國防密切相關的建設項目和重要產品
Chapter 4 Construction Projects and Important Products Closely Related to National Defense
第二十一條 根據國防動員的需要,與國防密切相關的建設項目和重要產品應當貫徹國防要求,具備國防功能。
Article 21 Construction projects and important products in close connection with the national defense shall be in line with the national defense requirements and have national defense functions, depending on the need of national defense mobilization.
第二十二條 與國防密切相關的建設項目和重要產品目錄,由國務院經濟發展綜合管理部門會同國務院其他有關部門以及軍隊有關部門擬定,報國務院、中央軍事委員會批準。
Article 22 Catalogs of construction projects and important products closely related to the national defense shall be drafted by the comprehensive administrative department of economic development under the State Council in concert with other relevant departments under the State Council and relevant military departments, and be submitted to the State Council and the Central Military Commission for approval.
列入目錄的建設項目和重要產品,其軍事需求由軍隊有關部門提出;建設項目審批、核準和重要產品設計定型時,縣級以上人民政府有關主管部門應當按照規定征求軍隊有關部門的意見。
With regard to any construction project or important product included in such catalogs, the military demands thereof shall be put forward by relevant military departments; when a construction project is subject to examination and approval or the design of an important product is finalized, relevant competent authorities of the people's governments at or above the county level shall solicit opinions from relevant military departments as required.
第二十三條 列入目錄的建設項目和重要產品,應當依照有關法律、行政法規和貫徹國防要求的技術規範和標準進行設計、生產、施工、監理和驗收,保證建設項目和重要產品的質量。
Article 23 In terms of any construction project or important product included in such catalogs, it shall be designed, manufactured, constructed, supervised and checked for acceptance purposes in accordance with the relevant laws, administrative regulations and technical standards for implementing national defense requirements, so as to ensure the quality of construction projects and important products.
第二十四條 企業事業單位投資或者參與投資列入目錄的建設項目建設或者重要產品研究、開發、制造的,依照有關法律、行政法規和國家有關規定,享受補貼或者其他政策優惠。
Article 24 Enterprises and institutions investing or participating in development of construction projects listed in the Catalogue or research, development and manufacturing of important products shall enjoy subsidies or other preferential policies pursuant to the relevant laws, administrative regulations and the relevant provisions of the State.
第二十五條 縣級以上人民政府應當對列入目錄的建設項目和重要產品貫徹國防要求工作給予指導和政策扶持,有關部門應當按照職責做好有關的管理工作。
Article 25 People's governments at or above the county level shall provide guidance and policy support to the implementation of national defense requirements for construction projects and important products included in such catalogs, and the relevant departments shall effectively administer such projects and products within their competence.
第五章 預備役人員的儲備與征召
Chapter 5 Reserve and Recruitment of Reservists
第二十六條 國家實行預備役人員儲備制度。
Article 26 The State shall implement a reservist system.
國家根據國防動員的需要,按照規模適度、結構科學、布局合理的原則,儲備所需的預備役人員。
The State shall reserve the needed reservists under the principles of appropriate scale, scientific structure and rational distribution, depending on the needs of national defense mobilization.
國務院、中央軍事委員會根據國防動員的需要,決定預備役人員儲備的規模、種類和方式。
The State Council and the Central Military Commission will determine the size, category and method of reservists reserve based on the needs of national defense mobilization.
第二十七條 預備役人員按照專業對口、便於動員的原則,采取預編到現役部隊、編入預備役部隊、編入民兵組織或者其他形式進行儲備。
Article 27 Reservists shall, in accordance with the principles of appropriate specialty and convenient mobilization, be pre-assigned to the standing army, incorporated into reserve forces, or incorporated into a militia organization, or form a reserve army in any other forms.
國家根據國防動員的需要,建立預備役專業技術兵員儲備區。
The State shall set up a reserve zone for soldiers with specialized skills, depending on the needs of national defense mobilization.
國家為預備役人員訓練、儲備提供條件和保障。預備役人員應當依法參加訓練。
The State shall provide conditions and guarantees with regard to training reservists and building a reserve army. The reservists shall participate in training according to the law.
第二十八條 縣級以上地方人民政府兵役機關負責組織實施本行政區域預備役人員的儲備工作。縣級以上地方人民政府有關部門、預備役人員所在鄉(鎮)人民政府、街道辦事處或者企業事業單位,應當協助兵役機關做好預備役人員儲備的有關工作。
Article 28 Military service organs of the people's governments at or above the county level shall be responsible for organizing the implementation of the reserve personnel work within their respective administrative areas. The relevant departments of the people's governments at or above the county level, and the people's governments at the township (town) level, subdistrict offices, enterprises or public institutions at the locality of the reservists shall assist the military service departments in carrying out the work relating to the reserve service personnel reserve.
第二十九條 預編到現役部隊和編入預備役部隊的預備役人員、預定征召的其他預備役人員,離開預備役登記地一個月以上的,應當向其預備役登記的兵役機關報告。
Article 29 Reservists pre-assigned to the standing army or the reserve army as well as other pre-drafted reservists shall report to the military service organization where the reservist registration was made, provided that they will be away from the place of reservist registration for over a month.
第三十條 國家決定實施國防動員後,縣級人民政府兵役機關應當根據上級的命令,迅速向被征召的預備役人員下達征召通知。
Article 30 After the State has decided to initiate national defense mobilization, the people's governments at or above the county level shall promptly issue a conscription notice to the drafted reservists upon the order of their superiors.
接到征召通知的預備役人員應當按照通知要求,到指定地點報到。
Reservists who have received the conscription notice shall report at the designated places as required by the notice.
第三十一條 被征召的預備役人員所在單位應當協助兵役機關做好預備役人員的征召工作。
Article 31 Entities where drafted reservists are employed shall assist military service organs in drafting such reservists.
從事交通運輸的單位和個人,應當優先運送被征召的預備役人員。
Units and individuals engaged in transportation shall give priority to the transport of the drafted reservists.
第三十二條 國家決定實施國防動員後,預定征召的預備役人員,未經其預備役登記地的縣級人民政府兵役機關批準,不得離開預備役登記地;已經離開預備役登記地的,接到兵役機關通知後,應當立即返回或者到指定地點報到。
Article 32 After the State has decided to initiate national defense mobilization, the pre-drafted reservists shall not leave the place of reservist registration, unless approved by the military service departments under the people's governments at or above the county level where the reservist registration was made; if they have already left such place, they shall return or report to the designated location immediately upon receipt of the notice from the military service departments.
第六章 戰略物資儲備與調用
Chapter 6 Strategic Material Reserve and Allocation
第三十三條 國家實行適應國防動員需要的戰略物資儲備和調用制度。
Article 33 The State adopts the strategic material reserve and allocation system that meets the needs of national defense mobilization.
戰略物資儲備由國務院有關主管部門組織實施。
Strategic material reserves shall be organized and implemented by the relevant competent authority under the State Council.
第三十四條 承擔戰略物資儲備任務的單位,應當按照國家有關規定和標準對儲備物資進行保管和維護,定期調整更換,保證儲備物資的使用效能和安全。
Article 34 Entities undertaking the missions of reserving strategic materials shall, in accordance with the relevant provisions and standards of the State, safekeep and maintain such materials, and adjust or replace them on a regular basis, so as to ensure the utilization efficiency and security of such materials.
國家按照有關規定對承擔戰略物資儲備任務的單位給予補貼。
The State shall provide subsidies to entities undertaking the task of reserving strategic material.
第三十五條 戰略物資按照國家有關規定調用。國家決定實施國防動員後,戰略物資的調用由國務院和中央軍事委員會批準。
Article 35 Strategic materials shall be allocated in accordance with the relevant provisions of the State. After the State has decided to implement national defense mobilization, the allocation of strategic materials shall be approved by the State Council and the Central Military Commission.
第三十六條 國防動員所需的其他物資的儲備和調用,依照有關法律、行政法規的規定執行。
Article 36 Other materials needed for national defense mobilization shall be reserved and allocated in accordance with the relevant laws and administrative regulations.
第七章 軍品科研、生產與維修保障
Chapter 7 Research and Development, Production and Maintenance Support of Military Goods
第三十七條 國家建立軍品科研、生產和維修保障動員體系,根據戰時軍隊訂貨和裝備保障的需要,儲備軍品科研、生產和維修保障能力。
Article 37 The State has established a mobilization system for the research and development, production and maintenance support of military goods, and built up the support capacity for research and development, production and maintenance of military goods based on the needs of military orders and equipment support during wartime.
本法所稱軍品,是指用於軍事目的的裝備、物資以及專用生產設備、器材等。
For the purpose of this Law, military goods refer to any equipment, materials, and other specialized production facilities and equipment for military purposes.
第三十八條 軍品科研、生產和維修保障能力儲備的種類、布局和規模,由國務院有關主管部門會同軍隊有關部門提出方案,報國務院、中央軍事委員會批準後組織實施。
Article 38 Related competent authorities under the State Council in concert with related military departments shall propose a plan on the types, layout and scale for building up the support capacity for the scientific research, production and maintenance of military goods, and organize the implementation of such plan after it is submitted to and approved by the State Council and the Central Military Commission.
第三十九條 承擔轉產、擴大生產軍品和維修保障任務的單位,應當根據所擔負的國防動員任務,儲備所需的設備、材料、配套產品、技術,建立所需的專業技術隊伍,制定和完善預案與措施。
Article 39 Entities that switch to the production of other military goods, expand the production of military goods and undertake maintenance support tasks shall, based on their national defense mobilization tasks, reserve necessary equipment, materials, supporting products and technologies, build up necessary professional technical teams, and formulate and improve plans and measures.
第四十條 各級人民政府應當支持和幫助承擔轉產、擴大生產軍品任務的單位開發和應用先進的軍民兩用技術,推廣軍民通用的技術標準,提高轉產、擴大生產軍品的綜合保障能力。
Article 40 People's governments at all levels shall support and assist entities switching to the production of other military goods or undertaking the expanded production of military goods to develop and apply advanced dual military-civilian use technologies, and promote technical standards common to military and civilian use, in order to enhance the comprehensive support capacity of switching to the production of other military goods and expanding the production of military goods.
國務院有關主管部門應當對重大的跨地區、跨行業的轉產、擴大生產軍品任務的實施進行協調,並給予支持。
The relevant competent departments under the State Council shall coordinate the implementation of key cross-regional and cross-industry production transfer and expanded production of military goods and offer support.
第四十一條 國家決定實施國防動員後,承擔轉產、擴大生產軍品任務的單位,應當按照國家軍事訂貨合同和轉產、擴大生產的要求,組織軍品科研、生產,保證軍品質量,按時交付訂貨,協助軍隊完成維修保障任務。為轉產、擴大生產軍品提供能源、材料、設備和配套產品的單位,應當優先滿足轉產、擴大生產軍品的需要。
Article 41 Once the State has decided to implement national defense mobilization, entities switching to the production of other military goods or undertaking the expanded production of military goods shall, in accordance with the State's military goods order contract and requirements of such production switch and expanded production, organize the research, development and production of military goods, ensure their quality, deliver orders on time, and assist the army to accomplish its maintenance support tasks. Entities that supply energy, materials, equipment and supporting products for the purpose of switching to the production of other military goods or expanding the production of military goods shall first satisfy the needs of the switched or expanded production.
國家對因承擔轉產、擴大生產軍品任務造成直接經濟損失的單位給予補償。
Entities that sustain direct economic losses as a result of switching to the production of other military goods or expanding the production of military goods will be compensated by the State.
第八章 戰爭災害的預防與救助
Chapter 8 Prevention of Disasters of War and Rescue
第四十二條 國家實行戰爭災害的預防與救助制度,保護人民生命和財產安全,保障國防動員潛力和持續動員能力。
Article 42 The State adopts a system for the prevention of and relief from disasters of war to protect the lives and property of the people and guarantee the potential and capacity for sustained mobilization of national defense.
第四十三條 國家建立軍事、經濟、社會目標和首腦機關分級防護制度。分級防護標準由國務院、中央軍事委員會規定。
Article 43 The State shall establish a multi-level system for protecting military, economic and social objectives, and government bodies. Such multi-level protection system shall be formulated by the State Council and the Central Military Commission.
軍事、經濟、社會目標和首腦機關的防護工作,由縣級以上人民政府會同有關軍事機關共同組織實施。
The protection of military, economic and social objectives and government bodies shall be organized and implemented by the people's governments at or above the county level in concert with the relevant military organs.
第四十四條 承擔軍事、經濟、社會目標和首腦機關防護任務的單位,應當制定防護計劃和搶險搶修預案,組織防護演練,落實防護措施,提高綜合防護效能。
Article 44 Entities responsible for protecting military, economic and social objectives and government bodies shall formulate protection plans and emergency and rush repairs plans, organize protection drills, implement protection measures and improve comprehensive protection efficiency.
第四十五條 國家建立平戰結合的醫療衛生救護體系。國家決定實施國防動員後,動員醫療衛生人員、調用藥品器材和設備設施,保障戰時醫療救護和衛生防疫。
Article 45 The State shall establish a medical and health rescue system for both peacetime and wartime. Once the State has decided to implement national defense mobilization, medical personnel shall be mobilized, and drugs, medical devices, equipment and facilities shall be allocated so as to ensure the medical rescue and hygiene and epidemic prevention during wartime.
第四十六條 國家決定實施國防動員後,人員、物資的疏散和隱蔽,在本行政區域進行的,由本級人民政府決定並組織實施;跨行政區域進行的,由相關行政區域共同的上一級人民政府決定並組織實施。
Article 46 Once the State has decided to implement national defense mobilization, the evacuation and hiding of individuals and materials within the local administrative region shall be determined and organized by the people's government at the same level; the evacuation and hiding, if across administrative regions, shall be determined and organized by the common people's government at the next higher level for such administrative regions.
承擔人員、物資疏散和隱蔽任務的單位,應當按照有關人民政府的決定,在規定時間內完成疏散和隱蔽任務。
Entities responsible for evacuating and hiding individuals and materials shall, in accordance with the decision made by the related people's government, accomplish the evacuation and hiding tasks within the required time limit.
第四十七條 戰爭災害發生時,當地人民政府應當迅速啟動應急救助機制,組織力量搶救傷員、安置災民、保護財產,盡快消除戰爭災害後果,恢複正常生產生活秩序。
Article 47 When disasters of war occur, the local people's government shall activate the emergency rescue mechanism immediately, organize forces to rescue the wounded, resettle victims of the disaster and protect properties, and eliminate the consequences of such disasters as soon as possible, so as to restore the normal production and living order.
遭受戰爭災害的人員和組織應當及時采取自救、互救措施,減少戰爭災害造成的損失。
Individuals and organizations suffering from disasters of war shall save themselves, take actions to save each other, and reduce the losses caused by disasters of war in a timely manner.
第九章 國防勤務
Chapter 9 Defense Support Services
第四十八條 國家決定實施國防動員後,縣級以上人民政府根據國防動員實施的需要,可以動員符合本法規定條件的公民和組織擔負國防勤務。
Article 48 Once the State has decided to implement national defense mobilization, people's governments at or above the county level may mobilize citizens and organizations satisfying the conditions specified herein to assume national defense support services.
本法所稱國防勤務,是指支援保障軍隊作戰、承擔預防與救助戰爭災害以及協助維護社會秩序的任務。
For the purpose of this Law, national defense support services refer to tasks of supporting the military in battles, undertaking the prevention of disasters of war and the assistance in this regard, and assisting in maintaining the social order.
第四十九條 十八周歲至六十周歲的男性公民和十八周歲至五十五周歲的女性公民,應當擔負國防勤務;但有下列情形之一的,免予擔負國防勤務:
Article 49 Male citizens aged between 18 and 60 and female citizens aged between 18 and 55 shall bear national defense support services, but are exempted from such support services under any of the following circumstances,
(一)在托兒所、幼兒園和孤兒院、養老院、殘疾人康複機構、救助站等社會福利機構從事管理和服務工作的公民;
1. Citizens undertaking the management or providing services in social welfare institutions, such as nurseries, kindergartens and orphanages, elderly nursing homes, rehabilitation facilities for the disabled and rescue stations;
(二)從事義務教育階段學校教學、管理和服務工作的公民;
(II) Citizens undertaking the teaching or management or serving at schools providing compulsory education;
(三)懷孕和在哺乳期內的女性公民;
(III) Female citizens who are pregnant or in the suckling period;
(四)患病無法擔負國防勤務的公民;
(IV) Citizens who are unable to provide national defense support services due to illness; and
(五)喪失勞動能力的公民;
(V) Citizens who have lost their ability to work;
(六)在聯合國等政府間國際組織任職的公民;
(VI) citizens who hold positions in the United Nations and other inter-governmental international organizations; and
(七)其他經縣級以上人民政府決定免予擔負國防勤務的公民。
(VII) Other citizens who are exempted from national defense support services as approved by the people's governments at or above the county level.
有特殊專長的專業技術人員擔負特定的國防勤務,不受前款規定的年齡限制。
Professional technicians with special skills are not subject to the age limit specified in the preceding paragraph when they undertake certain national defense support services.
第五十條 被確定擔負國防勤務的人員,應當服從指揮、履行職責、遵守紀律、保守秘密。擔負國防勤務的人員所在單位應當給予支持和協助。
Article 50 Individuals who are identified to undertake national defense support services shall obey commands, fulfill their duties, comply with discipline and keep secrets confidential. For individuals undertaking national defense support services, their employers shall offer support and assistance.
第五十一條 交通運輸、郵政、電信、醫藥衛生、食品和糧食供應、工程建築、能源化工、大型水利設施、民用核設施、新聞媒體、國防科研生產和市政設施保障等單位,應當依法擔負國防勤務。
Article 51 Units of transportation, postal service, telecommunications, medicine, health, food and grain supply, engineering and construction, energy and chemical industry, large water conservancy facilities, civil nuclear facilities, news media, scientific research and production for national defense and support of municipal facilities shall undertake national defense support services according to law.
前款規定的單位平時應當按照專業對口、人員精幹、應急有效的原則組建專業保障隊伍,組織訓練、演練,提高完成國防勤務的能力。
Entities specified in the preceding paragraph shall form professional protection teams, and organize training and drills in peacetime under the principle of professional counterparts, elite personnel, and effective emergency response, in order to improve their ability to accomplish national defense support services.
第五十二條 公民和組織擔負國防勤務,由縣級以上人民政府負責組織。
Article 52 Citizens and organizations undertaking national defense support services shall be organized by the people's governments at or above the county level.
擔負預防與救助戰爭災害、協助維護社會秩序勤務的公民和專業保障隊伍,由當地人民政府指揮,並提供勤務和生活保障;跨行政區域執行勤務的,由相關行政區域的縣級以上地方人民政府組織落實相關保障。
Citizens and professional protection teams that undertake support services of preventing disasters of war and launching rescue in this regard and assisting in maintaining the social order shall be under the command of local people's governments and render support services and provide livelihood guarantees; in the event that they conduct support services across administrative regions, the people's governments at or above the county level of the relevant administrative regions shall provide relevant guarantees.
擔負支援保障軍隊作戰勤務的公民和專業保障隊伍,由軍事機關指揮,伴隨部隊行動的由所在部隊提供勤務和生活保障;其他的由當地人民政府提供勤務和生活保障。
For citizens and professional protection teams that undertake support services for armies engaged in battles, they shall be under the command of military organs. Services and livelihood guarantees for those accompanying troop missions shall be provided by the troop in which they serve; and services and livelihood guarantees for others shall be provided by the local people's governments.
第五十三條 擔負國防勤務的人員在執行勤務期間,繼續享有原工作單位的工資、津貼和其他福利待遇;沒有工作單位的,由當地縣級人民政府參照民兵執行戰備勤務的補貼標準給予補貼;因執行國防勤務傷亡的,由當地縣級人民政府依照《軍人撫恤優待條例》等有關規定給予撫恤優待。
Article 53 Personnel undertaking national defense support services shall continue to be entitled to the wages, allowances and other benefits of their original employers during the period of their performance of such services; where such personnel are not employed by their original employers, the local people's governments at the county level shall grant subsidies by reference to the subsidy standards for militia performing combat readiness support services; where such personnel are injured in the performance of national defense support services, the local people's governments at the county level shall grant pensions and preferential treatments in accordance with the Regulations on the Pension and Preferential Treatments for Military Personnel and other relevant provisions.
第十章 民用資源征用與補償
Chapter 10 Requisition of and Compensation for Civilian Resources
第五十四條 國家決定實施國防動員後,儲備物資無法及時滿足動員需要的,縣級以上人民政府可以依法對民用資源進行征用。
Article 54 Once the State has decided to implement national defense mobilization, the people's governments at or above the county level may requisition civilian resources in accordance with the law when the reserve materials are not sufficient to meet the needs of mobilization in a timely manner.
本法所稱民用資源,是指組織和個人所有或者使用的用於社會生產、服務和生活的設施、設備、場所和其他物資。
For the purposes of this Law, civilian resources refer to facilities, equipment, venues and other materials that are owned or used by organizations and individuals for production, services and livelihood.
第五十五條 任何組織和個人都有接受依法征用民用資源的義務。
Article 55 All organizations and individuals are obliged to accept the requisition of civilian resources in accordance with the law.
需要使用民用資源的中國人民解放軍現役部隊和預備役部隊、中國人民武裝警察部隊、民兵組織,應當提出征用需求,由縣級以上地方人民政府統一組織征用。縣級以上地方人民政府應當對被征用的民用資源予以登記,向被征用人出具憑證。
The standing forces and reserve forces of the People's Liberation Army of China, the People's Armed Police Force of China and militia organizations that need to use civilian resources shall put forward a requisition request, and the requisition shall be organized by the local people's government at or above the county level in a unified manner. People's governments at or above the county level shall register civilian resources requisitioned and issue a certificate to each requisitioned party.
第五十六條 下列民用資源免予征用:
Article 56 The following civilian resources shall be exempted from requisition:
(一)個人和家庭生活必需的物品和居住場所;
1. necessities of life for individuals and families and residential places;
(二)托兒所、幼兒園和孤兒院、養老院、殘疾人康複機構、救助站等社會福利機構保障兒童、老人、殘疾人和救助對象生活必需的物品和居住場所;
(II) Necessities of life and residential places of social welfare organizations, such as nurseries, kindergartens and orphanages, elderly nursing homes, rehabilitation institutions for the disabled and rescue stations, to guarantee the livelihood of children, the elderly, the disabled and those seeking assistance; and
(三)法律、行政法規規定免予征用的其他民用資源。
(III) other civilian resources that are exempt from requisition under laws and administrative regulations.
第五十七條 被征用的民用資源根據軍事要求需要進行改造的,由縣級以上地方人民政府會同有關軍事機關組織實施。
Article 57 Where it is necessary to reconstruct the civilian resources requisitioned so as to meet military requirements, the people's government at or above the county level shall, in concert with the relevant military organs, organize the reconstruction.
承擔改造任務的單位應當按照使用單位提出的軍事要求和改造方案進行改造,並保證按期交付使用。改造所需經費由國家負擔。
The unit that undertakes the task of renovation shall conduct renovation in accordance with the military requirements put forward by the user unit and the scheme for renovation, and ensure to put them into use on schedule. The funds needed for the reform shall be borne by the State.
第五十八條 被征用的民用資源使用完畢,縣級以上地方人民政府應當及時組織返還;經過改造的,應當恢複原使用功能後返還;不能修複或者滅失的,以及因征用造成直接經濟損失的,按照國家有關規定給予補償。
Article 58 Upon the completion of the use of the civilian resources requisitioned, the local people's governments at or above the county level shall promptly organize the return thereof. Such resources that have been reconstructed shall be returned after their original use functions are restored. Where they cannot be restored or lost, or direct economic losses have been caused due to requisition, compensation shall be made in accordance with the relevant provisions of the State.
第五十九條 中國人民解放軍現役部隊和預備役部隊、中國人民武裝警察部隊、民兵組織進行軍事演習、訓練,需要征用民用資源或者采取臨時性管制措施的,按照國務院、中央軍事委員會的有關規定執行。
Article 59 Where the active and reserve forces of the Chinese People's Liberation Army, the Chinese People's Armed Police Force or the militia needs to requisition civilian resources or take temporary control measures to conduct military drills and training, the relevant provisions of the State Council and the Central Military Commission shall apply.
第十一章 宣傳教育
Chapter 11 Publicity and Education
第六十條 各級人民政府應當組織開展國防動員的宣傳教育,增強公民的國防觀念和依法履行國防義務的意識。有關軍事機關應當協助做好國防動員的宣傳教育工作。
Article 60 People's governments at all levels shall organize the publicity and education in respect of national defense mobilization, and enhance citizens' sense of national defense mobilization and their awareness of performing obligations in national defense mobilization in accordance with the law. Relevant military organs shall assist in the effective publicity and education of national defense mobilization.
第六十一條 國家機關、社會團體、企業事業單位和基層群眾性自治組織,應當組織所屬人員學習和掌握必要的國防知識與技能。
Article 61 State organs, social organizations, enterprises, public institutions and grassroots autonomous organizations shall arrange with their personnel to learn and acquire necessary knowledge and skills of national defense.
第六十二條 各級人民政府應當運用各種宣傳媒體和宣傳手段,對公民進行愛國主義、革命英雄主義宣傳教育,激發公民的愛國熱情,鼓勵公民踴躍參戰支前,采取多種形式開展擁軍優屬和慰問活動,按照國家有關規定做好撫恤優待工作。
Article 62 People's governments at all levels shall use various publicity media and adopt various publicity measures, so as to educate citizens about patriotism and revolutionary heroism, inspire their patriotic zeal, encourage them to actively take part in war and support the army, support the families of soldiers and adopt various forms of activities to support the army and extend preferential treatment to their families, and provide preferential treatment in comforting and compensating bereaved families in accordance with the relevant provisions of the State.
新聞出版、廣播影視和網絡傳媒等單位,應當按照國防動員的要求做好宣傳教育和相關工作。
Entities relating to news, publication, radio, film, television and network media shall do a good job in publicity, education and other related work according to the national defense mobilization requirements.
第十二章 特別措施
Chapter 12 Special Measures
第六十三條 國家決定實施國防動員後,根據需要,可以依法在實施國防動員的區域采取下列特別措施:
Article 63 Once the State has decided to implement national defense mobilization, the following special measures may be taken, where necessary, within areas where national defense mobilization is implemented according to the law,
(一)對金融、交通運輸、郵政、電信、新聞出版、廣播影視、信息網絡、能源水源供應、醫藥衛生、食品和糧食供應、商業貿易等行業實行管制;
1. Imposing control over certain industries, such as finance, transport, postal service, telecommunications, press, publication, radio, film and television, information network, energy and water supply, medical and healthcare, food and grain supply, commerce and trade, etc.;
(二)對人員活動的區域、時間、方式以及物資、運載工具進出的區域進行必要的限制;
(II) Imposing necessary restrictions on the areas, time and methods of human activities, and areas of entry and exit of materials and transportation vehicles;
(三)在國家機關、社會團體和企業事業單位實行特殊工作制度;
3. Implementing special work systems in state organs, social organizations, enterprises and public institutions;
(四)為武裝力量優先提供各種交通保障;
(IV) Providing priority transportation guarantee to the armed forces;
(五)需要采取的其他特別措施。
(V) other special measures that shall be taken.
第六十四條 在全國或者部分省、自治區、直轄市實行特別措施,由國務院、中央軍事委員會決定並組織實施;在省、自治區、直轄市範圍內的部分地區實行特別措施,由國務院、中央軍事委員會決定,由特別措施實施區域所在省、自治區、直轄市人民政府和同級軍事機關組織實施。
Article 64 Special measures to be taken on a nationwide basis or in some provinces, autonomous regions and municipalities directly under the Central Government shall be determined, organized and implemented by the State Council and the Central Military Commission; special measures to be taken in some areas within a province, autonomous region or municipality directly under the Central Government shall be determined by the State Council and the Central Military Commission, and be implemented by the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government where special measures are to be taken and the military organs at the same level in the aforesaid areas.
第六十五條 組織實施特別措施的機關應當在規定的權限、區域和時限內實施特別措施。特別措施實施區域內的公民和組織,應當服從組織實施特別措施的機關的管理。
Article 65 Organs responsible for organizing and implementing special measures shall take such measures within the prescribed authority, area and time limit. Citizens and organizations in the area where special measures are implemented shall obey the administration of the organ carrying out such special measures.
第六十六條 采取特別措施不再必要時,應當及時終止。
Article 66 The adoption of special measures shall immediately cease when no longer necessary.
第六十七條 因國家發布動員令,訴訟、行政複議、仲裁活動不能正常進行的,適用有關時效中止和程序中止的規定,但法律另有規定的除外。
Article 67 Where litigation, administrative reconsideration or arbitration activities cannot be conducted normally as a result of the mobilization decree issued by the State, the provisions on suspension of limitation period or proceedings shall apply, unless otherwise provided for by the law.
第十三章 法律責任
Chapter 13 Legal Liabilities
第六十八條 公民有下列行為之一的,由縣級人民政府責令限期改正;逾期不改的,強制其履行義務:
Article 68 Where any citizen is found to have committed any act specified as follows, the people's government at the county level shall order him or her to effect rectification within the required time limit; such citizen shall be forced to perform his or her obligations if he or she fails to effect any rectification within the said time limit,
(一)預編到現役部隊和編入預備役部隊的預備役人員、預定征召的其他預備役人員離開預備役登記地一個月以上未向預備役登記的兵役機關報告的;
1. Reservists pre-assigned to the standing army or the reserve army as well as other pre-drafted reservists who have left the place of reservist registration for over a month but have not reported to the military service organization where the reservist registration was made;
(二)國家決定實施國防動員後,預定征召的預備役人員未經預備役登記的兵役機關批準離開預備役登記地,或者未按照兵役機關要求及時返回,或者未到指定地點報到的;
(II) Pre-drafted reservists who have left the place of reservist registration without approval of the military service organization where the reservist registration was made, or failed to return in time as required by the military service organization or report to the appointed location;
(三)拒絕、逃避征召或者拒絕、逃避擔負國防勤務的;
(III) Any person refuses or evades conscription or refuses or evades national defense support services;
(四)拒絕、拖延民用資源征用或者阻礙對被征用的民用資源進行改造的;
(IV) refusing or delaying the requisition of civilian resources or obstructing the restructuring of requisitioned civilian resources; or
(五)幹擾、破壞國防動員工作秩序或者阻礙從事國防動員工作的人員依法履行職責的。
(V) Disrupting or destroying the work order in respect of national defense mobilization, or obstructing the personnel engaging in national defense mobilization from performing their duties according to the law.
第六十九條 企業事業單位有下列行為之一的,由有關人民政府責令限期改正;逾期不改的,強制其履行義務,並可以處以罰款:
Article 69 Where any enterprise or public institution acts in any of the following ways, the relevant people's government shall order it to take remedial action within a specified period of time. Where the enterprise or public institution fails to take remedial action within the period of time specified, it shall be forced to perform its obligations and may be fined:
(一)在承建的貫徹國防要求的建設項目中未按照國防要求和技術規範、標準進行設計或者施工、生產的;
1. failing to design, construct or produce in accordance with national defense requirements and technical norms and standards when undertaking construction projects required for the national defense purpose;
(二)因管理不善導致戰略儲備物資丟失、損壞或者不服從戰略物資調用的;
(II) Strategic reserve materials are lost or damaged due to its improper management or strategic materials are not allocated properly;
(三)未按照轉產、擴大生產軍品和維修保障任務的要求進行軍品科研、生產和維修保障能力儲備,或者未按照規定組建專業技術隊伍的;
(III) military goods are not reserved for the scientific research, production and maintenance support capacity of military goods according to the requirements of changing the line of production, expanding the tasks of production of military goods and maintenance support, or professional technical teams are not formed according to the provisions;
(四)拒絕、拖延執行專業保障任務的;
(IV) refusing or delaying professional protection tasks;
(五)拒絕或者故意延誤軍事訂貨的;
(V) Refusing or intentionally delaying orders placed for military purposes;
(六)拒絕、拖延民用資源征用或者阻礙對被征用的民用資源進行改造的;
(VI) refusing or delaying the requisition of civilian resources or obstructing the restructuring of requisitioned civilian resources; or
(七)阻撓公民履行征召、擔負國防勤務義務的。
(VII) obstructing citizens from fulfilling their obligations in regard to conscription and national defense support services.
第七十條 有下列行為之一的,對直接負責的主管人員和其他直接責任人員,依法給予處分:
Article 70 In the case of any of the following acts, the directly liable person-in-charge and other directly liable persons shall be given a sanction:
(一)拒不執行上級下達的國防動員命令的;
1. Refusal to execute the national defense mobilization order issued by a higher authority;
(二)濫用職權或者玩忽職守,給國防動員工作造成嚴重損失的;
(II) Abuse of powers or neglect of duties, which causes serious losses to national defense mobilization;
(三)對征用的民用資源,拒不登記、出具憑證,或者違反規定使用造成嚴重損壞,以及不按照規定予以返還或者補償的;
(III) refusing to register or present a certificate of proof for civilian resources requisitioned, or using such resources in violation of regulations, thus causing serious damage, and failing to return such resources or pay compensation in accordance with regulations; or
(四)泄露國防動員秘密的;
(IV) Divulging national defense mobilization secrets;
(五)貪汙、挪用國防動員經費、物資的;
(V) Corruption and misappropriation of national defense mobilization funds and materials; and
(六)濫用職權,侵犯和損害公民或者組織合法權益的。
(VI) Abuse of power to infringe upon and damage the lawful rights and interests of citizens or organizations.
第七十一條 違反本法規定,構成違反治安管理行為的,依法給予治安管理處罰;構成犯罪的,依法追究刑事責任。
Article 71 For violation of the provisions of this Law which constitute a violation of public security administration, the offender shall be subject to public security administration punishment pursuant to the law; where the case constitutes a criminal offence, criminal liability shall be pursued in accordance with the law.
第十四章 附 則
Chapter 14 Supplementary Provisions
第七十二條 本法自2010年7月1日起施行。
Article 72 This Law shall come into effect on July 1, 2010.
