Regulations on Fire Protection and Rescue Ranks

《中華人民共和國消防救援銜條例》已由中華人民共和國第十三屆全國人民代表大會常務委員會第六次會議於2018年10月26日通過，現予公布，自2018年10月27日起施行。

The Regulations of the People's Republic of China on Fire Protection and Rescue, adopted at the 6th Session of the Standing Committee of the 13th National People's Congress on 26 October 2018, are hereby promulgated, effective 27 October 2018.

第一章 總 則

Chapter 1 General Provisions

第一條   為了加強國家綜合性消防救援隊伍正規化、專業化、職業化建設，增強消防救援人員的責任感、榮譽感和組織紀律性，有利於國家綜合性消防救援隊伍的指揮、管理和依法履行職責，根據憲法，制定本條例。

Article 1 These Regulations are formulated in accordance with the Constitution with a view to strengthening the formalization, specialization and professionalization of the national comprehensive fire fighting and rescue team, enhancing the firefighting and rescue personnel's sense of responsibility, honor and discipline, and being conducive to the command and management of the national comprehensive fire fighting and rescue team and the performance of their duties according to law.

第二條   國家綜合性消防救援隊伍實行消防救援銜制度。

Article 2 The national comprehensive fire fighting and prevention team shall implement the system of fire fighting and prevention ranks.

消防救援銜授予對象為納入國家行政編制、由國務院應急管理部門統一領導管理的綜合性消防救援隊伍在職人員。

The grants for the ranks for fire fighting and rescue shall be granted to the on-the-job personnel of comprehensive fire fighting and rescue teams who have been included in the State's administrative establishment and under the unified leadership and administration of the emergency administration department under the State Council.

第三條   消防救援銜是表明消防救援人員身份、區分消防救援人員等級的稱號和標志，是國家給予消防救援人員的榮譽和相應待遇的依據。

Article 3 The rank of fire-fighting and rescue is the title and sign that indicates the identity of fire-fighting and rescue personnel and distinguishes the grades of fire-fighting and rescue personnel, and is the basis of honor and corresponding treatment granted by the State to fire-fighting and rescue personnel.

第四條   消防救援銜高的人員對消防救援銜低的人員，消防救援銜高的為上級。消防救援銜高的人員在職務上隸屬於消防救援銜低的人員時，擔任領導職務或者領導職務高的為上級。

Article 4 With respect to persons with a lower fire rescue rank, the one with a higher fire rescue rank shall be the superior of those with a higher fire rescue rank. When a person with a higher fire fighting and rescue rank is subordinate, in terms of post, to a person with a lower fire fighting and rescue rank, the former shall be the superior.

第五條   國務院應急管理部門主管消防救援銜工作。

Article 5 The emergency administrative department under the State Council shall be in charge of the work concerning fire fighting and rescue ranks.

第二章 消防救援銜等級的設置

Chapter 2 Ranks and Grades for Fire Fighting and Rescue

第六條   消防救援銜按照管理指揮人員、專業技術人員和消防員分別設置。

Article 6 The ranks for fire fighting and rescue shall be established respectively for each of the administrative commanding personnel, professional technicians and firefighters.

第七條   管理指揮人員消防救援銜設下列三等十一級：

Article 7 The ranks of management and commanders for fire fighting and rescue shall be classified into the following 11 grades under three categories:

（一）總監、副總監、助理總監；

1. Director, Deputy Directors and Assistant Directors;

（二）指揮長：高級指揮長、一級指揮長、二級指揮長、三級指揮長；

(II) Chief Commander: Senior Chief Commander, Chief Commander of First Class, Chief Commander of Second Class, Chief Commander of Third Class;

（三）指揮員：一級指揮員、二級指揮員、三級指揮員、四級指揮員。

(III) Commander: Commander First Class, Commander Second Class, Commander Third Class or Commander Fourth Class.

第八條   專業技術人員消防救援銜設下列二等八級，在消防救援銜前冠以“專業技術”：

Article 8 The ranks of professional technicians for fire fighting and prevention shall have the following eight grades under two grades, and the title of professional technician shall be preceded by "professional skill":

（一）指揮長：高級指揮長、一級指揮長、二級指揮長、三級指揮長；

1. Chief Commander: Senior Chief Commander, Chief Commander of First Class, Chief Commander of Second Class, Chief Commander of Third Class;

（二）指揮員：一級指揮員、二級指揮員、三級指揮員、四級指揮員。

(II) Commander: Commander First Class, Commander Second Class, Commander Third Class or Commander Fourth Class.

第九條   消防員消防救援銜設下列三等八級：

Article 9 The ranks of firefighters for fire fighting and rescue shall have the following eight grades under three categories:

（一）高級消防員：一級消防長、二級消防長、三級消防長；

1. Senior Firefighters: Chief Fire Control Class I, Chief Fire Control Class II and Chief Fire Control Class III;

（二）中級消防員：一級消防士、二級消防士；

(II) Intermediate Fireman: First Class Fireman, Second Class Fireman;

（三）初級消防員：三級消防士、四級消防士、預備消防士。

(III) Primary Fireman: Third Class, Fourth Class Fireman, Preliminary Fireman.

第三章 消防救援銜等級的編制

Chapter 3 Formulation of Fire Rescue Rank

第十條   管理指揮人員按照下列職務等級編制消防救援銜：

Article 10 The management and commanders shall be graded in the rank of fire prevention and control according to the following titles:

（一）國務院應急管理部門正職：總監；

1. the chief of the emergency management department under the State Council: the chief inspector;

（二）國務院應急管理部門消防救援隊伍領導指揮機構、森林消防隊伍領導指揮機構正職：副總監；

(II) Chief of the leading and commanding team of fire fighting and rescue of the emergency administrative department under the State Council, and chief of the leading and commanding team of forest fire fighting and rescue: deputy chief inspector;

（三）國務院應急管理部門消防救援隊伍領導指揮機構、森林消防隊伍領導指揮機構副職：助理總監；

(III) Deputy post at the level of the fire rescue team leading and commanding institution of the department of emergency administration under the State Council, and the deputy position at the level of the forest fire rescue team leading and commanding institution: Assistant director;

（四）總隊級正職：高級指揮長；

(IV) Post at the level of head corps commander: senior commander;

（五）總隊級副職：一級指揮長；

(V) Deputy commander of the general corps: commander of the first class;

（六）支隊級正職：二級指揮長；

(VI) Post at the level of commander of the detachment: commander of second class;

（七）支隊級副職：三級指揮長；

(VII) Deputy commander at the level of detachment: commander at the level of three;

（八）大隊級正職：一級指揮員；

(VIII) Post at the level of brigade chief: commander of first class;

（九）大隊級副職：二級指揮員；

(IX) Deputy commander of brigade level: commander of second class;

（十）站（中隊）級正職：三級指揮員；

(X) Post at the level of station (squadron) chief: commander at the third grade;

（十一）站（中隊）級副職：四級指揮員。

(XI) Deputy post at the station (squadron) level: Commander of Grade IV.

第十一條   專業技術人員按照下列職務等級編制消防救援銜：

Article 11 Professional technicians shall have their ranks for fire fighting and rescue established according to the following ranks:

（一）高級專業技術職務：高級指揮長至三級指揮長；

1. Senior specialized technical officer: senior commander down to the third commander; and

（二）中級專業技術職務：一級指揮長至二級指揮員；

2. Intermediate specialized technical officer: commander of first class or commander of second class; and

（三）初級專業技術職務：三級指揮長至四級指揮員。

(III) Junior specialized technical officer: from Commander Third Class down to Commander Fourth Class.

第十二條   消防員按照下列工作年限編制消防救援銜：

Article 12 Firefighters shall be graded as the ranks for fire fighting and rescue based on the following years of service:

（一）工作滿二十四年的：一級消防長；

1. Having worked for 24 full years: Level 1 chief fire officer;

（二）工作滿二十年的：二級消防長；

(II) having worked for 20 years or more: Class II fire prevention chief;

（三）工作滿十六年的：三級消防長；

(III) having worked for at least 16 years: Chief fire fighters of Class III;

（四）工作滿十二年的：一級消防士；

(IV) having worked for 12 years: Grade 1 firefighters;

（五）工作滿八年的：二級消防士；

(V) having worked for eight full years: Class II firefighters;

（六）工作滿五年的：三級消防士；

(VI) having worked for 5 years: Grade III firefighters;

（七）工作滿二年的：四級消防士；

(VII) having worked for two full years: Class IV firemen;

（八）工作二年以下的：預備消防士。

(VIII) having worked for not more than two years: preparing to be a firefighter.

第四章 消防救援銜的首次授予

Chapter 4 First Award of Fire Rescue Rank

第十三條   授予消防救援銜，以消防救援人員現任職務、德才表現、學曆學位、任職時間和工作年限為依據。

Article 13 The conferment of the rank of firefighting rescue personnel shall be based on their current posts, political integrity, professional competence, educational background or academic degree, time of holding the post and years of employment.

第十四條   初任管理指揮人員、專業技術人員，按照下列規定首次授予消防救援銜：

Article 14 The rank conferred on it for fire prevention and control for the first time according to the following provisions shall be that to be assumed, for the first time, as a management commander or a professional technician:

（一）從普通高等學校畢業生中招錄，取得大學專科、本科學曆的，授予四級指揮員消防救援銜；取得碩士學位的研究生，授予三級指揮員消防救援銜；取得博士學位的研究生，授予一級指揮員消防救援銜；

1. The rank for fire prevention and rescue shall be conferred on a commander of Grade 4 who is recruited from graduates of regular institutions of higher education and holds either a junior college or a bachelor's degree; on a graduate who has a master's degree, the rank for fire prevention and rescue shall be conferred on a commander of Grade 3; and on a graduate who has a doctor's degree, the rank for fire prevention and rescue shall be conferred on a commander of Grade 1;

（二）從消防員選拔任命為管理指揮人員、專業技術人員的，按照所任命的職務等級授予相應的消防救援銜；

(II) The personnel selected from firefighters and appointed as management commanders, professional technicians shall be conferred the corresponding ranks for fire fighting and rescue according to the appointed post levels;

（三）從國家機關或者其他救援隊伍調入的，或者從符合條件的社會人員中招錄的，按照所任命的職務等級授予相應的消防救援銜。

(III) The personnel transferred from State organs or other rescue teams, or recruited from the qualified personnel in society, shall be conferred the corresponding ranks for fire fighting and rescue according to the posts they hold.

第十五條   初任消防員，按照下列規定首次授予消防救援銜：

Article 15 The rank of firefighting aid shall be conferred for the first time on the person who is appointed as a firefighter according to the following provisions:

（一）從高中畢業生、普通高等學校在校生或者畢業生中招錄的，授予預備消防士；

1. Those recruited from high school graduates, students or graduates of regular institutions of higher education shall be conferred the title of preparatory fireman;

（二）從退役士兵中招錄的，其服役年限計入工作時間，按照本條例第十二條的規定，授予相應的消防救援銜；

(II) Those who are recruited from among soldiers discharged from military service shall serve their terms of service in military service, The appropriate ranks for fire fighting and rescue shall be conferred in accordance with the provisions of Article 12 of these Regulations;

（三）從其他救援隊伍或者具備專業技能的社會人員中招錄的，根據其從事相關專業工作時間，比照國家綜合性消防救援隊伍中同等條件人員，授予相應的消防救援銜。

(III) The personnel recruited from other rescue teams or the social personnel with professional skills shall be conferred the corresponding title of firefighting and rescue according to their working hours in relevant professions and in comparison with the personnel of equivalent qualifications of the national comprehensive firefighting and rescue team.

第十六條   首次授予管理指揮人員、專業技術人員消防救援銜，按照下列規定的權限予以批準：

Article 16 The initial conferment of the ranks for fire fighting and rescue on the management commanders and professional and technical personnel shall be approved according to the authority prescribed as follows:

（一）授予總監、副總監、助理總監，由國務院總理批準；

1. Appointments of Director, Deputy Director General and Assistant Director General shall be subject to the approval of the Premier of the State Council;

（二）授予高級指揮長、一級指揮長、二級指揮長，由國務院應急管理部門正職領導批準；

2. the conferment of the powers of attorney on a chief commander, a chief commander of first class, or a chief commander of second class shall be subject to the approval of the chief of the emergency management department under the State Council; and

（三）授予三級指揮長、一級指揮員，報省、自治區、直轄市人民政府應急管理部門同意後由總隊級單位正職領導批準，其中森林消防隊伍人員由國務院應急管理部門森林消防隊伍領導指揮機構正職領導批準；

(III) to confer on a commander at the third level or a commander at the first level, which shall be reported to the emergency management department of the people's government of the province, autonomous region or municipality directly under the Central Government for approval and then be approved by the chief leader of the unit at the headquarter level, in which the personnel of the forest fire control contingent shall be approved by the chief leader of the leadership and command institution of forest fire control contingent of the emergency management department under the State Council;

（四）授予二級指揮員、三級指揮員、四級指揮員，由總隊級單位正職領導批準。

(IV) The conferment of the powers of commander of second, third or fourth grade shall be subject to approval by the chief of the relevant entity at the headquarters level.

第十七條   首次授予消防員消防救援銜，按照下列規定的權限予以批準：

Article 17 The initial conferment of the rank of fire prevention and control rescue on a fireman shall be approved according to the following functions and powers:

（一）授予一級消防長、二級消防長、三級消防長，由國務院應急管理部門消防救援隊伍領導指揮機構、森林消防隊伍領導指揮機構正職領導批準；

1. The conferment of the titles of Class I chief fire control officer, Class II chief fire control officer and Class III chief fire control officer shall be subject to the approval of the chief leaders of the leading and commanding bodies of the fire control and rescue teams of the department of emergency administration under the State Council;

（二）授予一級消防士、二級消防士、三級消防士、四級消防士、預備消防士，由總隊級單位正職領導批準。

(II) The conferment of the title of Level 1 firefighter, Level 2 firefighter, Level 3 firefighter, Level 4 firefighter or preliminary firefighter shall be subject to the approval of the chief leader of the entity at the level of headquarter.

第五章 消防救援銜的晉級

Chapter 5 Promotion in Fire Protection Ranks

第十八條   消防救援銜一般根據職務等級調整情況或者工作年限逐級晉升。

Article 18 The rank for fire fighting and rescue is generally promoted grade by grade in accordance with the adjustment of post grades or the number of years of work.

消防救援人員晉升上一級消防救援銜，應當勝任本職工作，遵紀守法，廉潔奉公，作風正派。

Firefighting and rescue personnel to be promoted to the next higher level shall be competent in their duties, law-abiding, honest in performing their official duties and upright in conduct.

消防救援人員經培訓合格後，方可晉升上一級消防救援銜。

The fire rescue personnel may be promoted to the next higher level only after they have completed the training.

第十九條   管理指揮人員、專業技術人員的消防救援銜晉升，一般與其職務等級晉升一致。

Article 19 The promotion of managerial and commanding personnel and professional and technical personnel in the title of fire fighting and rescue shall generally be the same as their promotion in their post levels.

消防員的消防救援銜晉升，按照本條例第十二條的規定執行。通過全國普通高等學校招生統一考試、取得全日制大學專科以上學曆的消防員晉升消防救援銜，其按照規定學制在普通高等學校學習的時間視同工作時間，但不計入工齡。

Promotion of firefighters in the ranks for fire fighting and rescue shall be conducted in accordance with the provisions of Article 12 of these Regulations. Where a firefighter who passed the uniform national examination for student recruitment in regular institutions of higher education and obtained the degree of full-time university or above is promoted to the rank of firefighting and rescue, his/her study in a regular institution of higher education pursuant to the prescribed schooling system shall be deemed as working time and shall not be included into his/her length of service.

第二十條   管理指揮人員、專業技術人員消防救援銜晉升，按照下列規定的權限予以批準：

Article 20 The promotion of management and command personnel and professional and technical personnel in the rank of fire prevention and control shall be approved according to the following functions and powers:

（一）晉升為總監、副總監、助理總監，由國務院總理批準；

1. Promotions to the ranks of Director, Deputy Director or Assistant Director of the State Council shall be subject to the approval of the Premier of the State Council;

（二）晉升為高級指揮長、一級指揮長，由國務院應急管理部門正職領導批準；

(II) to be promoted to senior commander or chief commander of the emergency management department of the State Council, and to be approved by the chief of the said department; and

（三）晉升為二級指揮長，報省、自治區、直轄市人民政府應急管理部門同意後由總隊級單位正職領導批準，其中森林消防隊伍人員由國務院應急管理部門森林消防隊伍領導指揮機構正職領導批準；

(III) to be promoted to commander of second class, and reported to the emergency management department of the people's government of the province, autonomous region or municipality directly under the Central Government for approval and then to the chief leader of the unit at the headquarter level for approval, among whom the members of the forest fire control contingent shall be approved by the chief leader of the leadership and command organ of forest fire control contingent of the emergency management department under the State Council;

（四）晉升為三級指揮長、一級指揮員，由總隊級單位正職領導批準；

(IV) to be promoted to commander at the third grade and commander at the first grade, to be approved by the chief of the unit at the head corps level;

（五）晉升為二級指揮員、三級指揮員，由支隊級單位正職領導批準。

(V) A candidate for promotion to the second or third commander shall be subject to the approval of the chief of the relevant sub-branch entity.

第二十一條   消防員消防救援銜晉升，按照下列規定的權限予以批準：

Article 21 The promotion of a firefighter for fire fighting and rescue shall be approved according to the authority prescribed below:

（一）晉升為一級消防長、二級消防長、三級消防長，由國務院應急管理部門消防救援隊伍領導指揮機構、森林消防隊伍領導指揮機構正職領導批準；

1. To be promoted to Chief Fire Control Officer Class I, Chief Fire Control Officer Class II or Chief Fire Control Officer Class III, subject to the approval of the chief leaders of the leading and commanding bodies of the fire fighting and rescue teams of the department of emergency administration under the State Council;

（二）晉升為一級消防士、二級消防士，由總隊級單位正職領導批準；

(II) to be promoted to Level 1 firefighter or Level 2 firefighter, to be approved by the chief of the unit at the headquarters level;

（三）晉升為三級消防士、四級消防士，由支隊級單位正職領導批準。

(III) being promoted to Level 3 firefighter or Level 4 firefighter shall be approved by the chief of the unit at the level of detachment.

第二十二條   消防救援人員在消防救援工作中做出重大貢獻、德才表現突出的，其消防救援銜可以提前晉升。

Article 22 Firefighting and rescue personnel who have made significant contributions to fire control and rescue work and have outstanding ability and political integrity may be promoted in advance.

第六章 消防救援銜的保留、降級和取消

Chapter 6 Retention, Demotion and Cancellation of Fire Rescue Rank

第二十三條   消防救援人員退休後，其消防救援銜予以保留。

Article 23 The fire-protection rank shall be reserved after the retirement of the fire-protection personnel.

消防救援人員按照國家規定退出消防救援隊伍，或者調離、辭職、被辭退的，其消防救援銜不予保留。

Where a firefighting and rescue personnel withdraws from a firefighting and rescue team pursuant to the provisions of the State or is transferred, resigned or dismissed, his/her firefighting and rescue rank shall not be retained.

第二十四條   消防救援人員因不勝任現任職務被調任下級職務的，其消防救援銜應當調整至相應銜級，調整的批準權限與原銜級的批準權限相同。

Article 24 Where a firefighting rescue personnel is demoted to a lower position for incompetence or non-competence, his/her title of firefighting and rescue shall be adjusted to the corresponding rank, and the approval authority of such adjustment shall be the same as that of the original rank.

第二十五條   消防救援人員受到降級、撤職處分的，應當相應降低消防救援銜，降級的批準權限與原銜級的批準權限相同。

Article 25 Where a firefighting and rescue personnel is demoted or removed from his/her post, his/her fire control and rescue rank shall be demoted accordingly, and the approval authority for demotion shall be the same as that for the original rank.

消防救援銜降級不適用於四級指揮員和預備消防士。

Demotion in the fire-fighting rescue rank shall not be applicable to Level 4 Commanders and Reserve Firemen.

第二十六條   消防救援人員受到開除處分的，以及因犯罪被依法判處剝奪政治權利或者有期徒刑以上刑罰的，其消防救援銜相應取消。

Article 26 Where a fire-fighting and rescue personnel is dismissed, or is deprived of his/her political rights or sentenced to fixed-term imprisonment or more serious criminal punishment due to a crime, his/her fire-fighting and rescue rank shall be cancelled accordingly.

消防救援人員退休後犯罪的，適用前款規定。

The provisions of the preceding paragraph shall apply to the fire-fighting and rescue personnel who have committed crimes after retirement.

第七章 附 則

Chapter 7 Supplementary Provisions

第二十七條   消防救援銜標志式樣和佩帶辦法，由國務院制定。

Article 27 The patterns of the insignias for the ranks for fire fighting and rescue and the way of wearing them shall be drawn up by the State Council.

第二十八條   本條例自2018年10月27日起施行。

Article 28 These Regulations shall be implemented with effect from 27 October 2018.
