第一章

Chapter 1 General Provisions

第一條   為了發展精神衛生事業,規範精神衛生服務,維護精神障礙患者的合法權益,制定本法。

Article 1 The Law is formulated to develop the cause of mental health, regulate mental health services, and safeguard the legitimate rights and interests of persons with mental disorders.

第二條   在中華人民共和國境內開展維護和增進公民心理健康、預防和治療精神障礙、促進精神障礙患者康複的活動,適用本法。

Article 2 This Law shall be applicable to the activities carried out within the territory of the People's Republic of China to maintain and improve citizens' psychological health, to prevent and treat mental disorders, and to promote the rehabilitation of persons with mental disorders.

第三條   精神衛生工作實行預防為主的方針,堅持預防、治療和康複相結合的原則。

Article 3 With prevention as its guiding principle, mental health work must adhere to the principle of combining prevention, treatment and rehabilitation.

第四條   精神障礙患者的人格尊嚴、人身和財產安全不受侵犯。

Article 4 The human dignity, personal and property safety of the persons with mental disorders shall not be violated.

精神障礙患者的教育、勞動、醫療以及從國家和社會獲得物質幫助等方面的合法權益受法律保護。

The legitimate rights and interests of persons with mental disorders in terms of education, labor, medical care, and material assistance from the state and society are protected by law.

有關單位和個人應當對精神障礙患者的姓名、肖像、住址、工作單位、病曆資料以及其他可能推斷出其身份的信息予以保密;但是,依法履行職責需要公開的除外。

The relevant entities and individuals shall keep confidential the name, portrait, address, employer, medical records, or other information that could infer the identity of the persons with mental disorders, except when such information is necessary for performing their responsibilities in accordance with the law.

第五條   全社會應當尊重、理解、關愛精神障礙患者。

Article 5 The whole society shall respect, understand, and care for persons with mental disorders.

任何組織或者個人不得歧視、侮辱、虐待精神障礙患者,不得非法限制精神障礙患者的人身自由。

No organization or individual may discriminate against, insult, abuse, or illegally restrict the personal freedom of, persons with mental disorders.

新聞報道和文學藝術作品等不得含有歧視、侮辱精神障礙患者的內容。

News reports and literary and artistic works shall not include content that discriminates against or insults people with mental disorders.

第六條   精神衛生工作實行政府組織領導、部門各負其責、家庭和單位盡力盡責、全社會共同參與的綜合管理機制。

Article 6 A comprehensive management mechanism, under which governments organize and lead, departments undertake their respective responsibilities, families and units do their best, and the whole society participates in the mental health work, shall be applied.

第七條   縣級以上人民政府領導精神衛生工作,將其納入國民經濟和社會發展規劃,建設和完善精神障礙的預防、治療和康複服務體系,建立健全精神衛生工作協調機制和工作責任制,對有關部門承擔的精神衛生工作進行考核、監督。

Article 7 The people's governments at the county level or above shall lead the mental health work, include it in the national economic and social development plan, establish and improve the service system for the prevention, treatment and rehabilitation of mental disorders, establish a sound mental health work coordination mechanism and work responsibility system, and assess and supervise the mental health work of the relevant departments.

鄉鎮人民政府和街道辦事處根據本地區的實際情況,組織開展預防精神障礙發生、促進精神障礙患者康複等工作。

The people's governments at the township level and sub- district offices shall, in light of the actual conditions of their respective regions, organize and carry out the work related to the prevention of the occurrence of mental disorders and promoting the rehabilitation of persons with mental disorders.

第八條   國務院衛生行政部門主管全國的精神衛生工作。縣級以上地方人民政府衛生行政部門主管本行政區域的精神衛生工作。

Article 8 The administrative department of health under the State Council shall be in charge of the mental health work throughout the country. The administrative departments of health under the local people's governments at the county level or above shall take charge of the mental health work in their respective administrative areas.

縣級以上人民政府司法行政、民政、公安、教育、醫療保障等部門在各自職責範圍內負責有關的精神衛生工作。

The judicial affairs, civil affairs, public security, education, medical security, and other departments of the people's government at the county level or above shall be responsible for the mental health work within the scope of their respective responsibilities.

第九條   精神障礙患者的監護人應當履行監護職責,維護精神障礙患者的合法權益。

Article 9 Guardians of the persons with mental disorders shall fulfill the responsibilities as guardians to safeguard the legitimate rights and interests of the persons with mental disorders.

禁止對精神障礙患者實施家庭暴力,禁止遺棄精神障礙患者。

It is prohibited to commit domestic violence against persons with mental disorders and to abandon persons with mental disorders.

第十條   中國殘疾人聯合會及其地方組織依照法律、法規或者接受政府委托,動員社會力量,開展精神衛生工作。

Article 10 The China Disabled Persons' Federation and its local branches shall mobilize social forces for mental health work in accordance with laws and regulations or as entrusted by the government.

村民委員會、居民委員會依照本法的規定開展精神衛生工作,並對所在地人民政府開展的精神衛生工作予以協助。

Villagers' committees and residents' committees shall, in accordance with the provisions of the Law, undertake the mental health work and assist the local people's governments in undertaking the mental health work.

國家鼓勵和支持工會、共產主義青年團、婦女聯合會、紅十字會、科學技術協會等團體依法開展精神衛生工作。

The State encourages and supports the labor unions, the communist youth leagues, the women's federations, the Red Cross, the science and technology associations, and other organizations in their efforts to undertake the mental health work in accordance with the law.

第十一條   國家鼓勵和支持開展精神衛生專門人才的培養,維護精神衛生工作人員的合法權益,加強精神衛生專業隊伍建設。

Article 11 The State encourages and supports the trainings of specialized personnel in mental health care, the protection of the legitimate rights and interests of mental health workers, and the strengthening of the professional mental health workforce.

國家鼓勵和支持開展精神衛生科學技術研究,發展現代醫學、我國傳統醫學、心理學,提高精神障礙預防、診斷、治療、康複的科學技術水平。

The State encourages and supports scientific and technological research in mental health and the development of modern medicine, traditional medicine, and psychology in order to improve the scientific and technological level of the prevention, diagnosis, treatment, and rehabilitation of mental disorders.

國家鼓勵和支持開展精神衛生領域的國際交流與合作。

The State encourages and supports international exchanges and cooperation in the field of mental health.

第十二條   各級人民政府和縣級以上人民政府有關部門應當采取措施,鼓勵和支持組織、個人提供精神衛生志願服務,捐助精神衛生事業,興建精神衛生公益設施。

Article 12 The people's governments at all levels and the relevant departments of the people's governments at the county level or above shall take measures to encourage and support organizations and individuals to provide voluntary mental health services, to make donations to the cause of mental health, and to build mental health welfare facilities.

對在精神衛生工作中作出突出貢獻的組織、個人,按照國家有關規定給予表彰、獎勵。

Organizations or individuals that make outstanding contributions to the mental health work shall be commended and awarded in accordance with the relevant provisions of the State.

第二章 心理健康促進和精神障礙預防

Chapter II Mental Health Promotion and Prevention of Mental Disorders

第十三條   各級人民政府和縣級以上人民政府有關部門應當采取措施,加強心理健康促進和精神障礙預防工作,提高公眾心理健康水平。

Article 13 The people's governments at all levels and the relevant departments of the people's governments at the county level or above shall take measures to strengthen the work of promoting psychological health and preventing mental disorders so as to improve the psychological health of the public.

第十四條   各級人民政府和縣級以上人民政府有關部門制定的突發事件應急預案,應當包括心理援助的內容。發生突發事件,履行統一領導職責或者組織處置突發事件的人民政府應當根據突發事件的具體情況,按照應急預案的規定,組織開展心理援助工作。

Article 14 Emergency response plans formulated by the people's governments at all levels and the relevant departments of the people's governments at the county level or above shall include the contents relating to psychological assistance. When an emergency occurs, the people's government performing the duty of unified leadership or being responsible for organizing the handling of the emergency shall, in light of the specific circumstances of the emergency and in accordance with the provisions of the emergency response plan, make arrangements for psychological support work.

第十五條   用人單位應當創造有益於職工身心健康的工作環境,關注職工的心理健康;對處於職業發展特定時期或者在特殊崗位工作的職工,應當有針對性地開展心理健康教育。

Article 15 Employers shall create a working environment beneficial to the physical and mental health of employees, pay attention to the psychological health of employees; and conduct targeted psychological health education for employees at certain stages in their career development or employees undertaking special jobs.

第十六條   各級各類學校應當對學生進行精神衛生知識教育;配備或者聘請心理健康教育教師、輔導人員,並可以設立心理健康輔導室,對學生進行心理健康教育。學前教育機構應當對幼兒開展符合其特點的心理健康教育。

Article 16 All types of schools at all levels shall provide mental health education for their students, employ or engage teachers or consultants specialized in psychological health education, and may establish offices to provide guidance about psychological health for their students. Institutions of pre-school education shall carry out psychological health education for young children in line with their characteristics.

發生自然災害、意外傷害、公共安全事件等可能影響學生心理健康的事件,學校應當及時組織專業人員對學生進行心理援助。

In the event of natural disasters, accidental injuries, public security incidents and other events that may affect students' psychological health, the schools shall promptly arrange professionals to provide psychological assistance for students.

教師應當學習和了解相關的精神衛生知識,關注學生心理健康狀況,正確引導、激勵學生。地方各級人民政府教育行政部門和學校應當重視教師心理健康。

Teachers should study and understand the relevant mental health knowledge, pay attention to students' mental health, guide and encourage students correctly. The administrative departments of education of the local people's governments at all levels and the schools shall attach importance to the psychological health of teachers.

學校和教師應當與學生父母或者其他監護人、近親屬溝通學生心理健康情況。

Schools and teachers shall communicate with students' parents or other guardians or close relatives about the psychological health of students.

第十七條   醫務人員開展疾病診療服務,應當按照診斷標準和治療規範的要求,對就診者進行心理健康指導;發現就診者可能患有精神障礙的,應當建議其到符合本法規定的醫療機構就診。

Article 17 When providing diagnostic and therapeutic services, medical personnel shall give patients advice about psychological health in accordance with diagnostic criteria and treatment norms. When finding that the patients may have mental disorders, medical personnel shall advise the patients to seek treatment at a medical institution that meets the provisions of the Law.

第十八條   監獄、看守所、拘留所、強制隔離戒毒所等場所,應當對服刑人員,被依法拘留、逮捕、強制隔離戒毒的人員等,開展精神衛生知識宣傳,關注其心理健康狀況,必要時提供心理諮詢和心理輔導。

Article 18 Prisons, jails, detention centers, compulsory residential drug rehabilitation centers and other similar institutions shall provide knowledge about mental health for the prisoners or the persons legally detained, arrested or subject to compulsory residential drug rehabilitation, care about their psychological health, and, if necessary, provide them with psychological counseling and counseling.

第十九條   縣級以上地方人民政府人力資源社會保障、教育、衛生、司法行政、公安等部門應當在各自職責範圍內分別對本法第十五條至第十八條規定的單位履行精神障礙預防義務的情況進行督促和指導。

Article 19 The human resources and social security, education, health, judicial administration, public security and other departments of the local people's governments at or above the county level shall, within the scope of their respective responsibilities, supervise, urge and guide the performance of the obligation to prevent mental disorders by the entities specified in Articles 15 to 18 of this Law.

第二十條   村民委員會、居民委員會應當協助所在地人民政府及其有關部門開展社區心理健康指導、精神衛生知識宣傳教育活動,創建有益於居民身心健康的社區環境。

Article 20 Villagers' committees and residents' committees shall assist the local people's governments and their relevant departments in providing advice about psychological health and organizing activities that disseminate mental health knowledge so as to create a favorable community environment for the health of residents.

鄉鎮衛生院或者社區衛生服務機構應當為村民委員會、居民委員會開展社區心理健康指導、精神衛生知識宣傳教育活動提供技術指導。

Township health centers or community health service agencies shall provide technical guidance for villagers' committees and residents' committees when they provide advice about psychological health and organize activities that disseminate mental health knowledge.

第二十一條   家庭成員之間應當相互關愛,創造良好、和睦的家庭環境,提高精神障礙預防意識;發現家庭成員可能患有精神障礙的,應當幫助其及時就診,照顧其生活,做好看護管理。

Article 21 Family members shall care about each other, create a good and harmonious family environment, and improve their awareness of mental disorder prevention. If it is found that a Family member may have a mental disorder, the family members shall help him/her to seek timely medical treatment, care for his/her life, and take care of him/her.

第二十二條   國家鼓勵和支持新聞媒體、社會組織開展精神衛生的公益性宣傳,普及精神衛生知識,引導公眾關注心理健康,預防精神障礙的發生。

Article 22 The State encourages and supports news media and social organizations to carry out public welfare publicity of mental health, popularize mental health knowledge, guide the public to pay attention to psychological health, and prevent the occurrence of mental disorders.

第二十三條   心理諮詢人員應當提高業務素質,遵守執業規範,為社會公眾提供專業化的心理諮詢服務。

Article 23 Psychological consultants shall improve their professional quality, comply with the practice norms, and provide professional psychological consultancy services for the public.

心理諮詢人員不得從事心理治療或者精神障礙的診斷、治療。

Psychological consultants shall not provide psychotherapy or diagnose or treat mental disorders.

心理諮詢人員發現接受諮詢的人員可能患有精神障礙的,應當建議其到符合本法規定的醫療機構就診。

When psychological consultants find that their clients may have mental disorders, they shall advise them to seek treatment at a medical institution that meets the provisions of the Law.

心理諮詢人員應當尊重接受諮詢人員的隱私,並為其保守秘密。

Psychological consultants shall respect their clients' privacy and keep their information confidential.

第二十四條   國務院衛生行政部門建立精神衛生監測網絡,實行嚴重精神障礙發病報告制度,組織開展精神障礙發生狀況、發展趨勢等的監測和專題調查工作。精神衛生監測和嚴重精神障礙發病報告管理辦法,由國務院衛生行政部門制定。

Article 24 The administrative department of health under the State Council shall establish a mental health monitoring network, implement a reporting system for serious mental disorders, and organize and carry out the monitoring and special investigations of the occurrence and trends of mental disorders. The administrative measures for mental health monitoring and for the reporting system for serious mental disorders shall be formulated by the administrative department of health under the State Council.

國務院衛生行政部門應當會同有關部門、組織,建立精神衛生工作信息共享機制,實現信息互聯互通、交流共享。

The administrative department of health under the State Council shall, in concert with other relevant departments and organizations, establish a mechanism for sharing the information about mental health work so as to achieve the exchanges and sharing of information.

第三章 精神障礙的診斷和治療

Chapter 3 Diagnosis and Treatment of Mental Disorders

第二十五條   開展精神障礙診斷、治療活動,應當具備下列條件,並依照醫療機構的管理規定辦理有關手續:

Article 25 The following conditions shall be met and the relevant procedures shall be handled in accordance with the administrative provisions of medical institutions for the diagnosis and treatment of mental disorders:

(一)有與從事的精神障礙診斷、治療相適應的精神科執業醫師、護士;

1. mental practitioners and nurses appropriate for the diagnosis and treatment of mental disorders;

(二)有滿足開展精神障礙診斷、治療需要的設施和設備;

2. the medical institutions shall have the facilities and equipment necessary for the diagnosis and treatment of mental disorders; and

(三)有完善的精神障礙診斷、治療管理制度和質量監控制度。

3. have a sound management system and quality monitoring system for the diagnosis and treatment of mental disorders.

從事精神障礙診斷、治療的專科醫療機構還應當配備從事心理治療的人員。

The specialized medical institutions that diagnose and treat mental disorders shall also have staff who provide psychotherapy.

第二十六條   精神障礙的診斷、治療,應當遵循維護患者合法權益、尊重患者人格尊嚴的原則,保障患者在現有條件下獲得良好的精神衛生服務。

Article 26 The diagnosis and treatment on persons with mental disorders shall adhere to the principles of safeguarding their legitimate rights and interests and respecting their human dignity while ensuring that they receive quality mental health services under the existing conditions.

精神障礙分類、診斷標準和治療規範,由國務院衛生行政部門組織制定。

The classification, diagnostic criteria, and treatment norms for mental disorders shall be developed under the organization of the administrative department of health under the State Council.

第二十七條   精神障礙的診斷應當以精神健康狀況為依據。

Article 27 The diagnosis of mental disorders shall be based on the mental health status of the patients.

除法律另有規定外,不得違背本人意志進行確定其是否患有精神障礙的醫學檢查。

Except as otherwise provided by law, no medical examination should be performed, against the will of the patient, to determine whether the patient has any mental disorder.

第二十八條   除個人自行到醫療機構進行精神障礙診斷外,疑似精神障礙患者的近親屬可以將其送往醫療機構進行精神障礙診斷。對查找不到近親屬的流浪乞討疑似精神障礙患者,由當地民政等有關部門按照職責分工,幫助送往醫療機構進行精神障礙診斷。

Article 28 In addition to going to a medical institution for a mental disorder diagnosis on their own, the persons suspected of having mental disorders may be taken to a medical institution for a diagnosis by their close relatives. For the persons suspected of having mental disorders who are homeless beggars and if it is not possible to find their close relatives, the local department of civil affairs and other relevant departments shall help to send them to a medical institution for psychiatric diagnosis as per the division of duties.

疑似精神障礙患者發生傷害自身、危害他人安全的行為,或者有傷害自身、危害他人安全的危險的,其近親屬、所在單位、當地公安機關應當立即采取措施予以制止,並將其送往醫療機構進行精神障礙診斷。

When persons suspected of having mental disorders harm themselves or endanger the safety of others, or when they are at risk of harming themselves or endangering the safety of others, their close relatives, employers, or local public security organs shall immediately adopt measures to stop them and take them to a medical institution for psychiatric diagnosis.

醫療機構接到送診的疑似精神障礙患者,不得拒絕為其作出診斷。

Medical institutions shall not refuse to conduct a diagnosis for the persons suspected of having mental disorders sent for that purpose.

第二十九條   精神障礙的診斷應當由精神科執業醫師作出。

Article 29 The diagnosis of mental disorders shall be made by registered psychiatrists.

醫療機構接到依照本法第二十八條第二款規定送診的疑似精神障礙患者,應當將其留院,立即指派精神科執業醫師進行診斷,並及時出具診斷結論。

When receiving persons suspected of having mental disorders as described in Paragraph 2 of Article 28 hereof, medical institutions shall hold them in the hospital, immediately designate a registered psychiatrist to conduct a diagnosis, and promptly issue a diagnosis conclusion.

第三十條   精神障礙的住院治療實行自願原則。

Article 30 Inpatient treatment of mental disorders shall be carried out on a voluntary basis.

診斷結論、病情評估表明,就診者為嚴重精神障礙患者並有下列情形之一的,應當對其實施住院治療:

If the diagnostic result and the condition assessment shows that the person has a serious mental disorder and falls under any of the following circumstances, the medical institution shall impose inpatient treatment on the person:

(一)已經發生傷害自身的行為,或者有傷害自身的危險的;

1. the person has the action of self-harm or has the risk of self-harm; or

(二)已經發生危害他人安全的行為,或者有危害他人安全的危險的。

(II) the person has the action of endangering the safety of others or has the risk of endangering the safety of others.

第三十一條   精神障礙患者有本法第三十條第二款第一項情形的,經其監護人同意,醫療機構應當對患者實施住院治療;監護人不同意的,醫療機構不得對患者實施住院治療。監護人應當對在家居住的患者做好看護管理。

Article 31 If a person with a mental disorder falls under the circumstance specified in Item 1, Paragraph 2 of Article 30 hereof, a medical institution shall impose inpatient treatment on the patient, subject to the consent of the guardians. If the guardians disagree, the medical institution shall not impose inpatient treatment. Guardians shall take good care of the patients living at home.

第三十二條   精神障礙患者有本法第三十條第二款第二項情形,患者或者其監護人對需要住院治療的診斷結論有異議,不同意對患者實施住院治療的,可以要求再次診斷和鑒定。

Article 32 In the circumstance specified in Item 2, Paragraph 2 of Article 30 hereof, if the persons with mental disorders or their guardians disagree with the diagnosis result and refuse the inpatient treatment, they may request a second diagnosis and evaluation.

依照前款規定要求再次診斷的,應當自收到診斷結論之日起三日內向原醫療機構或者其他具有合法資質的醫療機構提出。承擔再次診斷的醫療機構應當在接到再次診斷要求後指派二名初次診斷醫師以外的精神科執業醫師進行再次診斷,並及時出具再次診斷結論。承擔再次診斷的執業醫師應當到收治患者的醫療機構面見、詢問患者,該醫療機構應當予以配合。

Those requesting for a second diagnosis in accordance with the provisions of the preceding paragraph shall make a request to the original medical institution or another medical institution with legal qualifications within three days upon receiving the diagnosis conclusion. The medical institution that undertakes the second diagnosis shall, after receiving the request for request, designate two registered psychiatrists who did not participate in the initial diagnosis to conduct the second diagnosis, and then promptly issue a second diagnosis conclusion. The registered physician who undertakes the second diagnosis shall conduct a face-to-face interview with the patient at the medical institution where the patient is being treated, and the medical institution shall render cooperation.

對再次診斷結論有異議的,可以自主委托依法取得執業資質的鑒定機構進行精神障礙醫學鑒定;醫療機構應當公示經公告的鑒定機構名單和聯系方式。接受委托的鑒定機構應當指定本機構具有該鑒定事項執業資格的二名以上鑒定人共同進行鑒定,並及時出具鑒定報告。

If the patients or their guardians disagree with the second diagnostic result, they may commission a legally accredited evaluation agency to conduct a medical evaluation for the mental disorders, and the medical institutions shall publicize the names and contact information of the evaluation agencies. The authentication institution that accepts the entrustment shall designate two or more authenticators with practice qualifications of the authentication institution to jointly conduct the authentication and issue an authentication report in a timely manner.

第三十三條   鑒定人應當到收治精神障礙患者的醫療機構面見、詢問患者,該醫療機構應當予以配合。

Article 33 The evaluators shall conduct a face-to-face interview of the patient at the medical institution where the patient is being treated, and the medical institution shall render cooperation.

鑒定人本人或者其近親屬與鑒定事項有利害關系,可能影響其獨立、客觀、公正進行鑒定的,應當回避。

An expert himself or his close relative shall withdraw from the evaluation if the evaluation may affect the independence, objectivity and impartiality of the evaluation.

第三十四條   鑒定機構、鑒定人應當遵守有關法律、法規、規章的規定,尊重科學,恪守職業道德,按照精神障礙鑒定的實施程序、技術方法和操作規範,依法獨立進行鑒定,出具客觀、公正的鑒定報告。

Article 34 The evaluation agencies and evaluators shall abide by the relevant laws, regulations and rules, follow scientific principles, observe professional ethics, and comply with the procedures, technical methods and operational norms for the evaluation of mental disorders so as to conduct an independent evaluation in accordance with the law and issue an objective and fair evaluation report.

鑒定人應當對鑒定過程進行實時記錄並簽名。記錄的內容應當真實、客觀、準確、完整,記錄的文本或者聲像載體應當妥善保存。

Authenticators shall make real-time records of the authentication process and sign thereon. The contents recorded shall be authentic, objective, accurate and complete. The recorded texts or video/audio media shall be properly preserved.

第三十五條   再次診斷結論或者鑒定報告表明,不能確定就診者為嚴重精神障礙患者,或者患者不需要住院治療的,醫療機構不得對其實施住院治療。

Article 35 If the second diagnostic result or the evaluation report indicates that the person does not have a serious mental disorder or does not need inpatient treatment, the medical institution shall not impose inpatient treatment on the person.

再次診斷結論或者鑒定報告表明,精神障礙患者有本法第三十條第二款第二項情形的,其監護人應當同意對患者實施住院治療。監護人阻礙實施住院治療或者患者擅自脫離住院治療的,可以由公安機關協助醫療機構采取措施對患者實施住院治療。

If the second diagnostic result or the evaluation report indicates that the person falls under the circumstance specified in Item 2, Paragraph 2 of Article 30 hereof, the guardians thereof shall agree on inpatient treatment for the person. If the guardians obstruct the inpatient treatment or the patient leaves off inpatient treatment without permission, the public security authority may assist the medical institution in taking measures to conduct inpatient treatment.

在相關機構出具再次診斷結論、鑒定報告前,收治精神障礙患者的醫療機構應當按照診療規範的要求對患者實施住院治療。

Prior to the issue of the second diagnostic result or the evaluation report, the medical institutions that treat persons with mental disorders shall provide inpatient treatment for the persons in accordance with the diagnostic criteria.

第三十六條   診斷結論表明需要住院治療的精神障礙患者,本人沒有能力辦理住院手續的,由其監護人辦理住院手續;患者屬於查找不到監護人的流浪乞討人員的,由送診的有關部門辦理住院手續。

Article 36 When a diagnostic result indicates that a person with a mental disorder requires inpatient treatment but the person is unable to complete hospitalization procedures, the guardians of the person shall complete hospitalization procedures. When the person is a homeless beggar whose guardian cannot be found, the department that sends the person to the hospital for diagnosis shall complete hospitalization procedures.

精神障礙患者有本法第三十條第二款第二項情形,其監護人不辦理住院手續的,由患者所在單位、村民委員會或者居民委員會辦理住院手續,並由醫療機構在患者病曆中予以記錄。

If a person with mental disorders falls under the circumstance specified in Item 2, Paragraph 2 of Article 30 hereof but the guardians do not complete the hospitalization formalities, the employer, villagers' committee or residents' committee shall complete the hospitalization formalities and the medical institution shall make a record in the patient's medical records.

第三十七條   醫療機構及其醫務人員應當將精神障礙患者在診斷、治療過程中享有的權利,告知患者或者其監護人。

Article 37 The medical institutions and their medical personnel shall inform the patients with mental disorders or their guardians about their rights during the process of diagnosis and treatment.

第三十八條   醫療機構應當配備適宜的設施、設備,保護就診和住院治療的精神障礙患者的人身安全,防止其受到傷害,並為住院患者創造盡可能接近正常生活的環境和條件。

Article 38 Medical institutions shall have appropriate facilities and equipment to protect the personal safety of the persons with mental disorders who seek medical treatment or receive inpatient treatment, to prevent them from being injured, and shall create as close as possible to a normal living environment and conditions for the inpatients.

第三十九條   醫療機構及其醫務人員應當遵循精神障礙診斷標準和治療規範,制定治療方案,並向精神障礙患者或者其監護人告知治療方案和治療方法、目的以及可能產生的後果。

Article 39 Medical institutions and their medical personnel shall follow the diagnostic criteria and treatment norms for mental disorders, formulate a treatment plan, and inform patients with mental disorders or their guardians about the treatment plan, treatment methods, purposes and possible consequences.

第四十條   精神障礙患者在醫療機構內發生或者將要發生傷害自身、危害他人安全、擾亂醫療秩序的行為,醫療機構及其醫務人員在沒有其他可替代措施的情況下,可以實施約束、隔離等保護性醫療措施。實施保護性醫療措施應當遵循診斷標準和治療規範,並在實施後告知患者的監護人。

Article 40 If the persons with mental disorders in a medical institution commit or are about to commit self-harm, endanger the safety of others, or disrupt the medical order, the medical institution and their medical personnel may use restraints, isolation, or other protective medical measures if there are no alternative measures. The implementation of protective medical measures shall follow diagnostic criteria and treatment norms, and the patients' guardians shall be informed after the implementation thereof.

禁止利用約束、隔離等保護性醫療措施懲罰精神障礙患者。

It is forbidden to punish patients with mental disorders by using protective medical measures such as restraint and isolation.

第四十一條   對精神障礙患者使用藥物,應當以診斷和治療為目的,使用安全、有效的藥物,不得為診斷或者治療以外的目的使用藥物。

Article 41 The use of drugs for persons with mental disorders shall be for the purposes of diagnosis and treatment, safe and effective drugs shall be used, and no drug shall be used for purposes other than diagnosis and treatment.

醫療機構不得強迫精神障礙患者從事生產勞動。

Medical institutions shall not force the persons with mental disorders to engage in production work.

第四十二條   禁止對依照本法第三十條第二款規定實施住院治療的精神障礙患者實施以治療精神障礙為目的的外科手術。

Article 42 It is prohibited to perform surgical operations for the purpose of treating mental disorders on the persons with mental disorders who receive inpatient treatment in accordance with the provisions of Paragraph 2 of Article 30 hereof.

第四十三條   醫療機構對精神障礙患者實施下列治療措施,應當向患者或者其監護人告知醫療風險、替代醫療方案等情況,並取得患者的書面同意;無法取得患者意見的,應當取得其監護人的書面同意,並經本醫療機構倫理委員會批準:

Article 43 When taking the following treatment measures for the persons with mental disorders, a medical institution shall inform the patients or their guardians about medical risks, alternative treatment plans, and other information, and obtain the written consent of the patients or obtain the written consent of the patients' guardians if the patients are unable to provide such consent, and obtain the approval of the ethics committee of the medical institution:

(一)導致人體器官喪失功能的外科手術;

1. surgical operations that result in the loss of any function of any human organ;

(二)與精神障礙治療有關的實驗性臨床醫療。

(II) experimental clinical treatments for mental disorders.

實施前款第一項治療措施,因情況緊急查找不到監護人的,應當取得本醫療機構負責人和倫理委員會批準。

Where a guardian cannot be found in an emergency under the treatment measures specified in Item 1 of the preceding paragraph, the approval shall be obtained from the responsible person and the ethics committee of the medical institution.

禁止對精神障礙患者實施與治療其精神障礙無關的實驗性臨床醫療。

It is forbidden to carry out experimental clinical treatment which has nothing to do with the treatment of mental disorders.

第四十四條   自願住院治療的精神障礙患者可以隨時要求出院,醫療機構應當同意。

Article 44 The persons with mental disorders who voluntarily hospitalize for treatment may request discharge at any time, and the medical institutions shall permit such request.

對有本法第三十條第二款第一項情形的精神障礙患者實施住院治療的,監護人可以隨時要求患者出院,醫療機構應當同意。

For persons with mental disorders who receive inpatient treatment in the circumstance as specified in Item 1, Paragraph 2 of Article 30 hereof, the guardians may request discharge at any time and the medical institution shall permit such request.

醫療機構認為前兩款規定的精神障礙患者不宜出院的,應當告知不宜出院的理由;患者或者其監護人仍要求出院的,執業醫師應當在病曆資料中詳細記錄告知的過程,同時提出出院後的醫學建議,患者或者其監護人應當簽字確認。

If the medical institution deems it inappropriate for a person with a mental disorder to leave hospital as specified in the preceding two paragraphs, it shall inform the person of the reasons for not leaving hospital. If the person or his guardian still requires him to leave hospital, the medical practitioner shall record the details of the notification process in the medical records of the patient and provide medical recommendations for the patient after leaving hospital. The patient or his guardian shall sign the medical records for confirmation.

對有本法第三十條第二款第二項情形的精神障礙患者實施住院治療,醫療機構認為患者可以出院的,應當立即告知患者及其監護人。

For persons with mental disorders who receive inpatient treatment in the circumstance as specified in Item 2, Paragraph 2 of Article 30 hereof, if the medical institution considers discharge appropriate, it shall immediately inform the patient and the guardians.

醫療機構應當根據精神障礙患者病情,及時組織精神科執業醫師對依照本法第三十條第二款規定實施住院治療的患者進行檢查評估。評估結果表明患者不需要繼續住院治療的,醫療機構應當立即通知患者及其監護人。

Based on the medical condition of a patient with a mental disorder who has received inpatient treatment in accordance with the second paragraph of Article 30 hereof, the medical institution shall promptly arrange for registered psychiatrists to conduct an inspection and assessment of the patient. If the assessment result shows that the patient no longer needs inpatient treatment, the medical institution shall immediately inform the patient and the guardians.

第四十五條   精神障礙患者出院,本人沒有能力辦理出院手續的,監護人應當為其辦理出院手續。

Article 45 If the persons with mental disorders are unable to complete hospital discharge procedures by themselves, their guardians shall complete such procedures on their behalf.

第四十六條   醫療機構及其醫務人員應當尊重住院精神障礙患者的通訊和會見探訪者等權利。除在急性發病期或者為了避免妨礙治療可以暫時性限制外,不得限制患者的通訊和會見探訪者等權利。

Article 46 Medical institutions and their medical personnel shall respect the rights of the persons with mental disorders who receive inpatient treatment to communicate with the outside and to meet visitors. Except for temporary restrictions in acute episodes of illness or in order to avoid interference with treatment, the patients' rights to communicate with the outside and to meet visitors shall not be restricted.

第四十七條   醫療機構及其醫務人員應當在病曆資料中如實記錄精神障礙患者的病情、治療措施、用藥情況、實施約束、隔離措施等內容,並如實告知患者或者其監護人。患者及其監護人可以查閱、複制病曆資料;但是,患者查閱、複制病曆資料可能對其治療產生不利影響的除外。病曆資料保存期限不得少於三十年。

Article 47 Medical institutions and their medical personnel shall faithfully record in the medical records the status, treatment, medication, restraint and isolation measures and other content of persons with mental disorders and truthfully inform the patients or their guardians of the same. Patients and their guardians may review and reproduce their medical records, unless this would be likely to have an adverse effect on their treatment. Medical records shall be kept for at least 30 years.

第四十八條   醫療機構不得因就診者是精神障礙患者,推诿或者拒絕為其治療屬於本醫療機構診療範圍的其他疾病。

Article 48 Medical institutions shall not refuse to treat other illnesses of the person with a mental disorder, which are within the scope of treatment of the medical institution, on the grounds that the person has a mental disorder.

第四十九條   精神障礙患者的監護人應當妥善看護未住院治療的患者,按照醫囑督促其按時服藥、接受隨訪或者治療。村民委員會、居民委員會、患者所在單位等應當依患者或者其監護人的請求,對監護人看護患者提供必要的幫助。

Article 49 Guardians of the persons with mental disorders shall appropriately take care of such persons who are not hospitalized, urge them to take medicine on time, and require them to receive follow-up visits or treatment as recommended by their doctors. Villagers' committees, residents' committees, patients' employers and others shall, at the request of patients or their guardians, provide necessary help for guardians to take care of patients.

第五十條   縣級以上地方人民政府衛生行政部門應當定期就下列事項對本行政區域內從事精神障礙診斷、治療的醫療機構進行檢查:

Article 50 The administrative departments of health of the local people's governments at the county level or above shall periodically inspect, regarding the following matters, medical institutions within their respective administrative areas that are engaged in the diagnosis and treatment of mental disorders:

(一)相關人員、設施、設備是否符合本法要求;

1. whether or not the relevant personnel, facilities and equipment meet the requirements of the Law;

(二)診療行為是否符合本法以及診斷標準、治療規範的規定;

2. whether or not the diagnosis and treatment practices meet the provisions of the Law, diagnostic criteria and treatment norms;

(三)對精神障礙患者實施住院治療的程序是否符合本法規定;

3. whether or not the inpatient treatment procedures for persons with mental disorders meet the provisions of the Law; and

(四)是否依法維護精神障礙患者的合法權益。

4. whether or not the legitimate rights and interests of persons with mental disorders are protected in accordance with the law.

縣級以上地方人民政府衛生行政部門進行前款規定的檢查,應當聽取精神障礙患者及其監護人的意見;發現存在違反本法行為的,應當立即制止或者責令改正,並依法作出處理。

When the administrative departments of health of the local people's governments at the county level or above carry out the examinations prescribed in the preceding paragraph, they shall listen to the opinions of the persons with mental disorders and their guardians. If any violations of the Law are found, these violations shall be immediately stopped or corrected, and treated in accordance with the law.

第五十一條   心理治療活動應當在醫療機構內開展。專門從事心理治療的人員不得從事精神障礙的診斷,不得為精神障礙患者開具處方或者提供外科治療。心理治療的技術規範由國務院衛生行政部門制定。

Article 51 Psychotherapy shall be conducted within medical institutions. Persons specializing in psychotherapy shall not diagnose mental disorders, prescribe medications for persons with mental disorders, or perform surgical treatments. Technical norms for psychotherapy shall be formulated by the administrative department of health under the State Council.

第五十二條   監獄、強制隔離戒毒所等場所應當采取措施,保證患有精神障礙的服刑人員、強制隔離戒毒人員等獲得治療。

Article 52 Prisons, compulsory residential drug rehabilitation centers and other similar institutions shall take measures to ensure that prisoners, persons subject to compulsory residential drug rehabilitation or other persons who suffer from mental disorders can receive treatment.

第五十三條   精神障礙患者違反治安管理處罰法或者觸犯刑法的,依照有關法律的規定處理。

Article 53 Persons with mental disorders who violate the Law on Administrative Penalties for Public Security or the Criminal Law shall be dealt with in accordance with the provisions of the relevant laws.

第四章 精神障礙的康複

Chapter 4 Rehabilitation of Mental Disorders

第五十四條   社區康複機構應當為需要康複的精神障礙患者提供場所和條件,對患者進行生活自理能力和社會適應能力等方面的康複訓練。

Article 54 Community rehabilitation institutions shall provide the space and conditions for the persons with mental disorders who require rehabilitation and provide them with rehabilitation training in terms of self-ability and social adaptability.

第五十五條   醫療機構應當為在家居住的嚴重精神障礙患者提供精神科基本藥物維持治療,並為社區康複機構提供有關精神障礙康複的技術指導和支持。

Article 55 Medical institutions shall provide maintenance treatment with basic psychiatric medicine for the persons with serious mental disorders who live at home, and shall provide the rehabilitation facilities in communities with technical guidance and support related to the rehabilitation of mental disorders.

社區衛生服務機構、鄉鎮衛生院、村衛生室應當建立嚴重精神障礙患者的健康檔案,對在家居住的嚴重精神障礙患者進行定期隨訪,指導患者服藥和開展康複訓練,並對患者的監護人進行精神衛生知識和看護知識的培訓。縣級人民政府衛生行政部門應當為社區衛生服務機構、鄉鎮衛生院、村衛生室開展上述工作給予指導和培訓。

Community health service agencies, township health centers and village health clinics shall establish health files for the persons with serious mental disorders, pay regular follow-up visits to the persons with serious mental disorders who live at home, instruct the patients to take medicine and carry out rehabilitation training, and train the guardians of the patients on the knowledge of mental health and nursing. The administrative departments of public health of the people's governments at or above the county level shall provide guidance and trainings for community public health service agencies, township public health centers and village health clinics in carrying out the aforesaid work.

第五十六條   村民委員會、居民委員會應當為生活困難的精神障礙患者家庭提供幫助,並向所在地鄉鎮人民政府或者街道辦事處以及縣級人民政府有關部門反映患者及其家庭的情況和要求,幫助其解決實際困難,為患者融入社會創造條件。

Article 56 Villagers' committees and residents' committees shall provide assistance to families of persons with mental disorders that have financial difficulties and report the conditions and requests of these patients and their families to the local people's governments at the township level, sub- district offices or relevant departments of the people's governments at county level in order to help the patients and their families solve practical difficulties and create favorable conditions for the integration into society.

第五十七條   殘疾人組織或者殘疾人康複機構應當根據精神障礙患者康複的需要,組織患者參加康複活動。

Article 57 Organizations for disabled persons and rehabilitation facilities for persons with disabilities shall organize the persons with mental disorders to participate in rehabilitation activities based on their rehabilitation needs.

第五十八條   用人單位應當根據精神障礙患者的實際情況,安排患者從事力所能及的工作,保障患者享有同等待遇,安排患者參加必要的職業技能培訓,提高患者的就業能力,為患者創造適宜的工作環境,對患者在工作中取得的成績予以鼓勵。

Article 58 The employers shall, based on the actual conditions of the persons with mental disorders, arrange for them to take up jobs within their capabilities, ensure that they are treated equally, arrange for them to participate in necessary vocational training sessions, improve their employability, create a favorable working environment for them and encourage them for their work achievements.

第五十九條   精神障礙患者的監護人應當協助患者進行生活自理能力和社會適應能力等方面的康複訓練。

Article 59 Guardians of the persons with mental disorders shall assist the persons with mental disorders in undergoing rehabilitation training in terms of self-accessibility and social adaptability.

精神障礙患者的監護人在看護患者過程中需要技術指導的,社區衛生服務機構或者鄉鎮衛生院、村衛生室、社區康複機構應當提供。

If guardians need technical guidance when taking care of persons with mental disorders, such guidance shall be provided by the community health service agencies, township hospitals, village clinics, or community rehabilitation facilities.

第五章

Chapter 5 Guarantee Measures

第六十條   縣級以上人民政府衛生行政部門會同有關部門依據國民經濟和社會發展規劃的要求,制定精神衛生工作規劃並組織實施。

Article 60 The administrative departments of health of the people's governments at the county level or above shall, in concert with other relevant departments, formulate, and organize the implementation of, the mental health work plans based on the requirements of the National Economic and Social Development Plan.

精神衛生監測和專題調查結果應當作為制定精神衛生工作規劃的依據。

The mental health work plans shall be based on the results of mental health monitoring activities and special investigations.

第六十一條   省、自治區、直轄市人民政府根據本行政區域的實際情況,統籌規劃,整合資源,建設和完善精神衛生服務體系,加強精神障礙預防、治療和康複服務能力建設。

Article 61 The people's governments of provinces, autonomous regions, and municipalities directly under the Central Government shall, based on the specific conditions of their respective administrative areas, develop overall plans and integrate resources to build and improve the mental health service system and enhance their abilities to prevent, treat, and rehabilitate mental disorders.

縣級人民政府根據本行政區域的實際情況,統籌規劃,建立精神障礙患者社區康複機構。

The people's governments at county level shall, based on the specific conditions of their respective administrative areas, develop overall plans for the establishment of community rehabilitation facilities for persons with mental disorders.

縣級以上地方人民政府應當采取措施,鼓勵和支持社會力量舉辦從事精神障礙診斷、治療的醫療機構和精神障礙患者康複機構。

The local people's governments at the county level or above shall take measures to encourage and support social forces to establish medical institutions for diagnosis and treatment of mental disorders and to establish rehabilitation facilities for the persons with mental disorders.

第六十二條   各級人民政府應當根據精神衛生工作需要,加大財政投入力度,保障精神衛生工作所需經費,將精神衛生工作經費列入本級財政預算。

Article 62 Based on the requirements of the mental health work, the people's governments at all levels shall increase financial investment to ensure the funds required for the mental health work, and include the funds for the mental health work in the financial budget of the governments at corresponding levels.

第六十三條   國家加強基層精神衛生服務體系建設,扶持貧困地區、邊遠地區的精神衛生工作,保障城市社區、農村基層精神衛生工作所需經費。

Article 63 The State strengthens the construction of the mental health service system at the grass-roots level, supports the mental health work in poor and remote regions, and ensures the funds required for the mental health work in both urban and rural communities at the grass-roots level.

第六十四條   醫學院校應當加強精神醫學的教學和研究,按照精神衛生工作的實際需要培養精神醫學專門人才,為精神衛生工作提供人才保障。

Article 64 Medical colleges and universities shall strengthen the teaching and research in psychiatry and cultivate specialized psychiatric talents based on the actual requirements of the mental health work so as to provide talent guarantee for the mental health work.

第六十五條   綜合性醫療機構應當按照國務院衛生行政部門的規定開設精神科門診或者心理治療門診,提高精神障礙預防、診斷、治療能力。

Article 65 The comprehensive medical institutions shall, in accordance with the provisions of the administrative department of health under the State Council, set up mental outpatient departments or psychotherapy clinics to improve their abilities to prevent, diagnose and treat mental disorders.

第六十六條   醫療機構應當組織醫務人員學習精神衛生知識和相關法律、法規、政策。

Article 66 Medical institutions shall organize their medical personnel to study mental health knowledge and the relevant laws, regulations and policies.

從事精神障礙診斷、治療、康複的機構應當定期組織醫務人員、工作人員進行在崗培訓,更新精神衛生知識。

The institutions engaged in diagnosis, treatment, and rehabilitation of mental disorders shall regularly arrange for their medical personnel and other personnel to participate in in-service trainings to update their knowledge about mental health.

縣級以上人民政府衛生行政部門應當組織醫務人員進行精神衛生知識培訓,提高其識別精神障礙的能力。

The administrative departments of health of the people's governments at the county level or above shall organize mental health trainings for their medical personnel so as to improve their abilities to identify mental disorders.

第六十七條   師範院校應當為學生開設精神衛生課程;醫學院校應當為非精神醫學專業的學生開設精神衛生課程。

Article 67 The normal colleges and universities shall offer mental health courses for students, and the medical colleges and universities shall offer mental health courses for students not specializing in psychiatry.

縣級以上人民政府教育行政部門對教師進行上崗前和在崗培訓,應當有精神衛生的內容,並定期組織心理健康教育教師、輔導人員進行專業培訓。

The administrative departments of education of the people's governments at the county level or above shall provide pre-service and in-service trainings for teachers on mental health, and periodically provide professional trainings for teachers and consultants involved in psychological health education.

第六十八條   縣級以上人民政府衛生行政部門應當組織醫療機構為嚴重精神障礙患者免費提供基本公共衛生服務。

Article 68 The administrative departments of health of the people's governments at the county level or above shall organize medical institutions to provide basic public health services free of charge for the persons with serious mental disorders.

精神障礙患者的醫療費用按照國家有關社會保險的規定由基本醫療保險基金支付。醫療保險經辦機構應當按照國家有關規定將精神障礙患者納入城鎮職工基本醫療保險、城鎮居民基本醫療保險或者新型農村合作醫療的保障範圍。縣級人民政府應當按照國家有關規定對家庭經濟困難的嚴重精神障礙患者參加基本醫療保險給予資助。醫療保障、財政等部門應當加強協調,簡化程序,實現屬於基本醫療保險基金支付的醫療費用由醫療機構與醫療保險經辦機構直接結算。

The medical expenses of the persons with mental disorders shall be paid by the basic medical insurance fund according to the relevant national provisions on social insurance. Medical insurance agencies shall, in accordance with the relevant provisions of the State, include the persons with mental disorders in the coverage of the basic medical insurance for urban and township employees, the basic medical insurance for urban and township residents, or the new type of rural cooperative medical care. The people's governments at the county level shall, in accordance with the relevant provisions of the State, provide financial assistance to the persons with serious mental disorders from families with financial difficulties for their participation in the basic medical insurance. The departments of medical security, finance, and other departments shall strengthen their coordination and simplify the procedures to ensure that the medical expenses paid by the basic medical insurance funds are directly settled between medical institutions and medical insurance agencies.

精神障礙患者通過基本醫療保險支付醫療費用後仍有困難,或者不能通過基本醫療保險支付醫療費用的,醫療保障部門應當優先給予醫療救助。

If any persons with mental disorders still have financial difficulties after medical expense have been covered by basic medical insurance or if it is not possible for them to pay their medical expenses by basic medical insurance, the medical security departments shall provide them with medical assistance in priority.

第六十九條   對符合城鄉最低生活保障條件的嚴重精神障礙患者,民政部門應當會同有關部門及時將其納入最低生活保障。

Article 69 For the persons with serious mental disorders who meet the requirements for urban and rural minimum living security, the civil affairs departments shall, in concert with other relevant departments, promptly include them into the minimum living security.

對屬於農村五保供養對象的嚴重精神障礙患者,以及城市中無勞動能力、無生活來源且無法定贍養、撫養、扶養義務人,或者其法定贍養、撫養、扶養義務人無贍養、撫養、扶養能力的嚴重精神障礙患者,民政部門應當按照國家有關規定予以供養、救助。

The departments of civil affairs shall, in accordance with the relevant provisions of the State, provide support and assistance to the persons with serious mental disorders who are targets of the Rural Five Guarantees Program and to the urban residents with serious mental disorders who are unable to work, have no source of income, and have no statutory obligor to support, bring up or maintain them, or the obligors have no capacity to support, bring up or maintain them.

前兩款規定以外的嚴重精神障礙患者確有困難的,民政部門可以采取臨時救助等措施,幫助其解決生活困難。

For the persons with serious mental disorders who have real difficulties but are not covered by the scope as specified in the two preceding paragraphs, the civil affairs departments may take temporary assistance and other measures to help them resolve their living difficulties.

第七十條   縣級以上地方人民政府及其有關部門應當采取有效措施,保證患有精神障礙的適齡兒童、少年接受義務教育,扶持有勞動能力的精神障礙患者從事力所能及的勞動,並為已經康複的人員提供就業服務。

Article 70 The local people's governments at the county level or above and the relevant departments thereof shall take effective measures to ensure that school-age children and adolescents with mental disorders receive compulsory education, support the persons with mental disorders who are able to work to engage in the work within their capabilities, and provide employment services for those who are rehabilitated.

國家對安排精神障礙患者就業的用人單位依法給予稅收優惠,並在生產、經營、技術、資金、物資、場地等方面給予扶持。

The State shall, in accordance with the law, grant tax incentives to the employers that employ persons with mental disorders, and shall support these employers in the aspects of production, operations, technology, capital, materials, and sites.

第七十一條   精神衛生工作人員的人格尊嚴、人身安全不受侵犯,精神衛生工作人員依法履行職責受法律保護。全社會應當尊重精神衛生工作人員。

Article 71 The human dignity and personal safety of mental health workers shall not be violated, and mental health workers are protected by law when performing their responsibilities in accordance with the law. The whole society shall respect mental health workers.

縣級以上人民政府及其有關部門、醫療機構、康複機構應當采取措施,加強對精神衛生工作人員的職業保護,提高精神衛生工作人員的待遇水平,並按照規定給予適當的津貼。精神衛生工作人員因工致傷、致殘、死亡的,其工傷待遇以及撫恤按照國家有關規定執行。

The people's government at the county level or above, and the relevant departments, medical institutions, and rehabilitation facilities shall take measures to strengthen the occupational protection of mental health workers, improve the benefits of mental health workers, and provide mental health workers with appropriate allowances as stipulated. In the event that a mental health worker is injured, disabled, or killed in his or her job, work-related injury benefits and pension shall be provided in accordance with the relevant provisions of the State.

第六章

Chapter 6 Legal Liability

第七十二條   縣級以上人民政府衛生行政部門和其他有關部門未依照本法規定履行精神衛生工作職責,或者濫用職權、玩忽職守、徇私舞弊的,由本級人民政府或者上一級人民政府有關部門責令改正,通報批評,對直接負責的主管人員和其他直接責任人員依法給予警告、記過或者記大過的處分;造成嚴重後果的,給予降級、撤職或者開除的處分。

Article 72 Where the administrative departments for public health and other relevant departments under the people's governments at the county level or above fail to perform their duties for mental health work in accordance with the provisions of this Law, or abuse their powers, neglect their duties, or engage in malpractices for personal gain, the people's governments at corresponding level or the relevant departments of the people's governments at higher level shall order them to rectify the situation and issue a notice of criticism, and the persons directly in charge and the other persons directly responsible shall, in accordance with the law, be given a warning, or have a demerit or major demerit recorded; or if serious consequences are caused, shall be demoted, dismissed or discharged.

第七十三條   不符合本法規定條件的醫療機構擅自從事精神障礙診斷、治療的,由縣級以上人民政府衛生行政部門責令停止相關診療活動,給予警告,並處五千元以上一萬元以下罰款,有違法所得的,沒收違法所得;對直接負責的主管人員和其他直接責任人員依法給予或者責令給予降低崗位等級或者撤職、開除的處分;對有關醫務人員,吊銷其執業證書。

Article 73 Where a medical institution that does not meet the conditions prescribed in this Law arbitrarily conducts the diagnosis and treatment of mental disorders, the administrative department of health of the people's government at the county level or above shall order the institution to cease the relevant diagnosis and treatment activities, give a warning and impose a fine of not less than 5,000 yuan but not more than 10,000 yuan. The illegal gains, if any, shall be confiscated. The person directly in charge and other directly liable persons shall be given a disciplinary action of downgrading, removal from office or dismissal in accordance with the law or order. The practicing certificate of the relevant medical personnel shall be revoked.

第七十四條   醫療機構及其工作人員有下列行為之一的,由縣級以上人民政府衛生行政部門責令改正,給予警告;情節嚴重的,對直接負責的主管人員和其他直接責任人員依法給予或者責令給予降低崗位等級或者撤職、開除的處分,並可以責令有關醫務人員暫停一個月以上六個月以下執業活動:

Article 74 Where a medical institution or any of its employees commits any of the following acts, it/he shall be ordered to make corrections and given a warning by the administrative department of health under the people's government at the county level or above; if the circumstance is serious, the person directly in charge and other persons directly liable shall be given a punishment of degradation of their position grade or dismissal from office or expulsion in accordance with the law, and the relevant medical personnel may be ordered to suspend their practicing activities for not less than one month but not more than six months:

(一)拒絕對送診的疑似精神障礙患者作出診斷的;

1. refuse to diagnose the persons suspected of having mental disorders sent for diagnosis;

(二)對依照本法第三十條第二款規定實施住院治療的患者未及時進行檢查評估或者未根據評估結果作出處理的。

(II) failing to conduct timely examination and assessment on the patients receiving inpatient treatment in accordance with Paragraph 2 of Article 30 of the Law or failing to treat the patients according to the assessment results.

第七十五條   醫療機構及其工作人員有下列行為之一的,由縣級以上人民政府衛生行政部門責令改正,對直接負責的主管人員和其他直接責任人員依法給予或者責令給予降低崗位等級或者撤職的處分;對有關醫務人員,暫停六個月以上一年以下執業活動;情節嚴重的,給予或者責令給予開除的處分,並吊銷有關醫務人員的執業證書:

Article 75 Medical institutions and their staff that commit any of the following acts shall be ordered by the health administration department of the People's Governments at county level and above to make correction, the directly accountable person (s) -in-charge and other directly accountable personnel shall be subject to punishment of demotion or dismissal pursuant to the law; the relevant medical personnel shall be suspended from practice for a period of six months to one year; in serious cases, the offender shall be subject to or ordered to be dismissed, and the practising certificate of the relevant medical personnel shall be revoked:

(一)違反本法規定實施約束、隔離等保護性醫療措施的;

1. in violation of the Law, take restraint, isolation and other protective medical measures;

(二)違反本法規定,強迫精神障礙患者勞動的;

2. in violation of the Law, force the persons with mental disorders to work; or

(三)違反本法規定對精神障礙患者實施外科手術或者實驗性臨床醫療的;

3. in violation of the Law, implement surgery or experimental clinical treatment for persons with mental disorders;

(四)違反本法規定,侵害精神障礙患者的通訊和會見探訪者等權利的;

(IV) in violation of the Law, violate the rights of persons with mental disorders to communicate with the outside and to meet visitors; and

(五)違反精神障礙診斷標準,將非精神障礙患者診斷為精神障礙患者的。

(V) in violation of the diagnostic criteria for mental disorders, diagnose someone who does not have a mental disorder as having one.

第七十六條   有下列情形之一的,由縣級以上人民政府衛生行政部門、工商行政管理部門依據各自職責責令改正,給予警告,並處五千元以上一萬元以下罰款,有違法所得的,沒收違法所得;造成嚴重後果的,責令暫停六個月以上一年以下執業活動,直至吊銷執業證書或者營業執照:

Article 76 In any of the following circumstances, the administrative departments of health and administrative departments for industry and commerce of the people's governments at the county level or above shall, according to their respective duties, order the offenders to rectify the situation, issue a warning, impose a fine ranging from 5,000 yuan to 10,000 yuan and confiscate any illegal gains. If there are serious consequences, the offenders shall be ordered to suspend their practice for six months to one year or even have their practice certificate or business license revoked:

(一)心理諮詢人員從事心理治療或者精神障礙的診斷、治療的;

1. psychological consultants provide psychotherapy or they diagnose or treat mental disorders;

(二)從事心理治療的人員在醫療機構以外開展心理治療活動的;

(II) persons engaged in psychotherapy practice psychotherapy outside medical institutions; and

(三)專門從事心理治療的人員從事精神障礙的診斷的;

3. persons specializing in psychotherapy diagnose mental disorders; and

(四)專門從事心理治療的人員為精神障礙患者開具處方或者提供外科治療的。

4. persons specializing in psychotherapy prescribe medications for persons with mental disorders or perform surgical treatments.

心理諮詢人員、專門從事心理治療的人員在心理諮詢、心理治療活動中造成他人人身、財產或者其他損害的,依法承擔民事責任。

Psychological consultants or the persons specializing in psychotherapy who cause physical, financial or other damages to others in the course of consulting or psychotherapy shall bear civil liabilities in accordance with the law.

第七十七條   有關單位和個人違反本法第四條第三款規定,給精神障礙患者造成損害的,依法承擔賠償責任;對單位直接負責的主管人員和其他直接責任人員,還應當依法給予處分。

Article 77 The relevant entities and individuals that violate the provisions of Paragraph 3 of Article 4 of the Law and cause harm to persons with mental disorders shall be liable for compensation in accordance with the law. The persons who are directly in charge and the other persons who are directly liable for the violation shall also be disciplined in accordance with the law.

第七十八條   違反本法規定,有下列情形之一,給精神障礙患者或者其他公民造成人身、財產或者其他損害的,依法承擔賠償責任:

Article 78 In any of the following circumstances, the violations of the Law cause personal, property or other damages to persons with mental disorders or to other citizens, the relevant persons shall bear the liability for compensation:

(一)將非精神障礙患者故意作為精神障礙患者送入醫療機構治療的;

1. deliberately send persons without mental disorders to medical institutions for treatment as if they have mental disorders;

(二)精神障礙患者的監護人遺棄患者,或者有不履行監護職責的其他情形的;

2. guardians of the persons with mental disorders abandon them or do not fulfill their responsibilities as guardians;

(三)歧視、侮辱、虐待精神障礙患者,侵害患者的人格尊嚴、人身安全的;

3. violate the human dignity or personal safety of persons with mental disorders by stigmatizing, humiliating or abusing them;

(四)非法限制精神障礙患者人身自由的;

(IV) illegally restrict the personal freedom of persons with mental disorders; and

(五)其他侵害精神障礙患者合法權益的情形。

5. other situations that violate the legitimate rights and interests of persons with mental disorders.

第七十九條   醫療機構出具的診斷結論表明精神障礙患者應當住院治療而其監護人拒絕,致使患者造成他人人身、財產損害的,或者患者有其他造成他人人身、財產損害情形的,其監護人依法承擔民事責任。

Article 79 If the diagnostic result issued by a medical institution indicates that a person with a mental disorder should receive inpatient treatment but the guardians thereof refuse, resulting in the patient causing physical or property damage to another person, or the patient otherwise causes physical or property damage to another person, the guardians shall bear civil liability in accordance with the law.

第八十條   在精神障礙的診斷、治療、鑒定過程中,尋釁滋事,阻撓有關工作人員依照本法的規定履行職責,擾亂醫療機構、鑒定機構工作秩序的,依法給予治安管理處罰。

Article 80 During the process of diagnosis, treatment, or evaluation of mental disorders, if any persons intentionally cause disturbances or prevent the relevant staff members from performing their duties in accordance with the Law or disrupt the work order of a medical institution or evaluation agency, they shall be subject to public security penalties in accordance with the law.

違反本法規定,有其他構成違反治安管理行為的,依法給予治安管理處罰。

Any other violation of this Law that constitutes a violation of public security administration shall be subject to a public security administrative penalty legally.

第八十一條   違反本法規定,構成犯罪的,依法追究刑事責任。

Article 81 Where a violation of the provisions of this Law constitutes a criminal offence, criminal liability shall be pursued in accordance with the law.

第八十二條   精神障礙患者或者其監護人、近親屬認為行政機關、醫療機構或者其他有關單位和個人違反本法規定侵害患者合法權益的,可以依法提起訴訟。

Article 82 Persons with mental disorders or their guardians or close relatives who believe that administrative authorities, medical institutions, or other relevant entities and individuals have violated the provisions of the Law and infringed on the legitimate rights and interests of persons with mental disorders may institute a proceeding in accordance with the law.

第七章

Chapter 7 Supplementary Provisions

第八十三條   本法所稱精神障礙,是指由各種原因引起的感知、情感和思維等精神活動的紊亂或者異常,導致患者明顯的心理痛苦或者社會適應等功能損害。

Article 83 For the purpose of the Law, mental disorders refer to disturbances in perception, emotion, thinking and other mental activities or abnormalities caused by various causes, which result in significant psychological distress or impairment of such functions as social adaptation.

本法所稱嚴重精神障礙,是指疾病症狀嚴重,導致患者社會適應等功能嚴重損害、對自身健康狀況或者客觀現實不能完整認識,或者不能處理自身事務的精神障礙。

For the purpose of the Law, serious mental disorder refers to the mental disorder characterized by severe symptoms that result in serious impairments in social adaptation or in other types of functioning, in impaired awareness of one's own health condition or of objective reality, or in an inability to deal with one's own affairs.

本法所稱精神障礙患者的監護人,是指依照民法通則的有關規定可以擔任監護人的人。

For the purpose of the Law, guardians of persons with mental disorders refer to those who may act as guardians in accordance with the relevant provisions of the General Principles of the Civil Law.

第八十四條   軍隊的精神衛生工作,由國務院和中央軍事委員會依據本法制定管理辦法。

Article 84 The State Council and the Central Military Commission shall formulate administrative measures for the mental health work in armies in accordance with the Law.

第八十五條   本法自201351日起施行。

Article 85 This Law shall be effective 1 May 2013.
