《中華人民共和國測繪法》已由中華人民共和國第十二屆全國人民代表大會常務委員會第二十七次會議於2017年4月27日修訂通過，現將修訂後的《中華人民共和國測繪法》公布，自2017年7月1日起施行。

The Surveying and Mapping Law of the People's Republic of China, revised and adopted at the 27th Session of the Standing Committee of the 12th National People's Congress of the People's Republic of China on 27 April 2017, is hereby promulgated, effective on 1 July 2017.

第一章 總 則

Chapter 1 General Provisions

第一條   為了加強測繪管理，促進測繪事業發展，保障測繪事業為經濟建設、國防建設、社會發展和生態保護服務，維護國家地理信息安全，制定本法。

Article 1 This Law is enacted to strengthen the administration of the surveying and mapping undertaking, promote its development, ensure that it renders service to development of the national economy, the building up of national defense, progress of the society and protection of the ecological environment, and safeguard national geographic information security.

第二條   在中華人民共和國領域和中華人民共和國管轄的其他海域從事測繪活動，應當遵守本法。

Article 2 All surveying and mapping activities in the territorial air, land and waters of the People's Republic of China, as well as other sea areas under its jurisdiction shall be conducted in compliance with this Law.

本法所稱測繪，是指對自然地理要素或者地表人工設施的形狀、大小、空間位置及其屬性等進行測定、采集、表述，以及對獲取的數據、信息、成果進行處理和提供的活動。

For purpose of this Law, surveying and mapping include the activities conducted to determine, collect and formulate the key elements of physical geography or the shapes, sizes, space positions, attributes, etc. of man-made surface installations, as well as to process and provide the data, information and results gained therefrom.

第三條   測繪事業是經濟建設、國防建設、社會發展的基礎性事業。各級人民政府應當加強對測繪工作的領導。

Article 3 The undertaking of surveying and mapping is a basic undertaking for the development of the national economy, the building up of national defence, and the advancement of society. People's governments at all levels shall strengthen leadership of work in this field.

第四條   國務院測繪地理信息主管部門負責全國測繪工作的統一監督管理。國務院其他有關部門按照國務院規定的職責分工，負責本部門有關的測繪工作。

Article 4 The competent department for the geographic information on surveying and mapping under the State Council shall be in charge of the unified supervision over the work of surveying and mapping throughout the country. Other relevant departments under the State Council shall, in line with the division of their functions and duties specified by the State Council, be responsible for the work of surveying and mapping which they are concerned with.

縣級以上地方人民政府測繪地理信息主管部門負責本行政區域測繪工作的統一監督管理。縣級以上地方人民政府其他有關部門按照本級人民政府規定的職責分工，負責本部門有關的測繪工作。

The competent departments for surveying, mapping and geoinformation under the local people's governments at or above the county level shall be responsible for the unified supervision over the work of surveying and mapping within their own administrative areas. The relevant departments of the local people's governments at or above the county level shall, in line with the division of their functions and duties specified by the people's governments at the corresponding level, be responsible for the work of surveying and mapping which they are concerned with.

軍隊測繪部門負責管理軍事部門的測繪工作，並按照國務院、中央軍事委員會規定的職責分工負責管理海洋基礎測繪工作。

The competent department for surveying and mapping of the army shall be responsible for the work of the administration of surveying and mapping done by military departments and shall, in line with the division of its functions and duties specified by the State Council and the Central Military Commission, be responsible for the administration of basic marine surveying and charting.

第五條   從事測繪活動，應當使用國家規定的測繪基準和測繪系統，執行國家規定的測繪技術規範和標準。

Article 5 In surveying and mapping, the datums and systems prescribed by the State for surveying and mapping shall be employed, and the technical norms and standards prescribed by the State for surveying and mapping shall be applied.

第六條   國家鼓勵測繪科學技術的創新和進步，采用先進的技術和設備，提高測繪水平，推動軍民融合，促進測繪成果的應用。國家加強測繪科學技術的國際交流與合作。

Article 6 The State encourages scientific and technological updating and progress in surveying and mapping and adoption of advanced technology and equipment so as to raise the surveying and mapping level and promote the application of surveying and mapping results. The State strengthens the international scientific and technological exchanges and cooperation in relation to surveying and mapping.

對在測繪科學技術的創新和進步中做出重要貢獻的單位和個人，按照國家有關規定給予獎勵。

Units and individuals that make important contributions to scientific and technological updating and progress in surveying and mapping shall be rewarded in accordance with the relevant regulations of the State.

第七條   各級人民政府和有關部門應當加強對國家版圖意識的宣傳教育，增強公民的國家版圖意識。新聞媒體應當開展國家版圖意識的宣傳。教育行政部門、學校應當將國家版圖意識教育納入中小學教學內容，加強愛國主義教育。

Article 7 People's governments at all levels and relevant departments shall improve publicity and education among citizens in their awareness of the territory of the State and enhance their awareness of the importance of the State territory. News media shall conduct publicity on the consciousness of the territory of the State. The administrative departments for education and schools shall include education regarding the awareness of the territory of the State in the syllabus of primary and secondary schools, and enhance education in patriotism.

第八條   外國的組織或者個人在中華人民共和國領域和中華人民共和國管轄的其他海域從事測繪活動，應當經國務院測繪地理信息主管部門會同軍隊測繪部門批準，並遵守中華人民共和國有關法律、行政法規的規定。

Article 8 Foreign organizations or individuals that wish to conduct surveying and mapping in the territorial air, land or waters, as well as other sea areas under the jurisdiction of the People's Republic of China shall be subject to approval by the competent department for surveying, mapping and geoinformation under the State Council and the competent department for surveying and mapping of the army, and they shall observe the provisions of relevant laws and administrative rules and regulations of the People's Republic of China.

外國的組織或者個人在中華人民共和國領域從事測繪活動，應當與中華人民共和國有關部門或者單位合作進行，並不得涉及國家秘密和危害國家安全。

Foreign organizations or individuals that wish to conduct surveying and mapping in the territorial air, land or waters of the People's Republic of China shall join hands with the relevant departments or units of the People's Republic of China and such surveying and mapping may not involve State secrets or endanger State security.

第二章 測繪基準和測繪系統

Chapter 2 Surveying and Mapping Datum and System

第九條   國家設立和采用全國統一的大地基準、高程基準、深度基準和重力基準，其數據由國務院測繪地理信息主管部門審核，並與國務院其他有關部門、軍隊測繪部門會商後，報國務院批準。

Article 9 The State establishes and adopts the nationwide unified geodetic datums, vertical datums, depth datums and gravimetric datums, and the data in this respect shall be examined and verified by the competent department for the geographic information on surveying and mapping under the State Council, which, after consulting with the relevant departments under the State Council and the department for surveying and mapping of the army, shall submit the data to the State Council for approval.

第十條   國家建立全國統一的大地坐標系統、平面坐標系統、高程系統、地心坐標系統和重力測量系統，確定國家大地測量等級和精度以及國家基本比例尺地圖的系列和基本精度。具體規範和要求由國務院測繪地理信息主管部門會同國務院其他有關部門、軍隊測繪部門制定。

Article 10 The State establishes a nationwide unified geodetic coordinate system, plane coordinate system, vertical system, geocentric coordinate system and gravimetric system, and defines the classification of orders and classes and precision of the national geodetic survey, as well as the national basic scale map series and their basic precision. Specific norms and requirements shall be formulated by the competent department for the geographic information on surveying and mapping under the State Council in conjunction with the relevant departments under the State Council and the department for surveying and mapping of the army.

第十一條   因建設、城市規劃和科學研究的需要，國家重大工程項目和國務院確定的大城市確需建立相對獨立的平面坐標系統的，由國務院測繪地理信息主管部門批準；其他確需建立相對獨立的平面坐標系統的，由省、自治區、直轄市人民政府測繪地理信息主管部門批準。

Article 11 Where it is really necessary to establish relatively independent plane coordinate systems for major construction projects of the State and large cities determined by the State Council to meet the needs of construction, urban planning and scientific research, the matter shall be subject to approval by the competent department for surveying, mapping and geoinformation under the State Council; and where it is really necessary to establish relatively independent plane coordinate systems for other purposes, the matter shall be subject to approval by the competent department for surveying, mapping and geoinformation under the people's government of a province, autonomous region, or centrally-administered municipality.

建立相對獨立的平面坐標系統，應當與國家坐標系統相聯系。

The relatively independent plane coordinate systems to be established shall be connected with the national coordinate system.

第十二條   國務院測繪地理信息主管部門和省、自治區、直轄市人民政府測繪地理信息主管部門應當會同本級人民政府其他有關部門，按照統籌建設、資源共享的原則，建立統一的衛星導航定位基準服務系統，提供導航定位基準信息公共服務。

Article 12 The competent department for the geographic information on surveying and mapping under the State Council and the competent departments for the geographic information on surveying and mapping under the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government shall, in conjunction with other relevant departments under the people's governments at the same level and in compliance with the principle of overall construction and resource sharing, establish a unified satellite navigation positioning datum service system so as to provide public services related to navigation positioning datum information.

第十三條   建設衛星導航定位基準站的，建設單位應當按照國家有關規定報國務院測繪地理信息主管部門或者省、自治區、直轄市人民政府測繪地理信息主管部門備案。國務院測繪地理信息主管部門應當匯總全國衛星導航定位基準站建設備案情況，並定期向軍隊測繪部門通報。

Article 13 In constructing a satellite navigation positioning datum station, the construction entity shall, in accordance with the relevant provisions of the State, report to the competent department for the geographic information on surveying and mapping under the State Council or the competent department for the geographic information on surveying and mapping under the people's government of the relevant province, autonomous region or municipality directly under the Central Government for record-filing. The competent department for surveying, mapping and geoinformation under the State Council shall summarize the record-filing of the construction of satellite navigation positioning datum stations nationwide, and regularly report the same to the competent department for surveying and mapping of the army.

本法所稱衛星導航定位基準站，是指對衛星導航信號進行長期連續觀測，並通過通信設施將觀測數據實時或者定時傳送至數據中心的地面固定觀測站。

For the purpose of this Law, base stations for satellite navigation positioning refer to the ground fixed observation stations which conduct long-term continuous observations of satellite navigation signals and transmit observation data in real time or at regular time to the data center via communication facilities.

第十四條   衛星導航定位基準站的建設和運行維護應當符合國家標準和要求，不得危害國家安全。

Article 14 The construction, operation and maintenance of base stations for satellite navigation positioning shall conform to the national standards and requirements, and shall not endanger national security.

衛星導航定位基準站的建設和運行維護單位應當建立數據安全保障制度，並遵守保密法律、行政法規的規定。

Entities in charge of the construction, operation and maintenance of base stations for satellite navigation positioning shall establish a data security guarantee system, and abide by the laws and administrative regulations governing State secrets.

縣級以上人民政府測繪地理信息主管部門應當會同本級人民政府其他有關部門，加強對衛星導航定位基準站建設和運行維護的規範和指導。

The competent departments for surveying, mapping and geoinformation under the people's governments at or above the county level shall, in conjunction with other relevant departments under the people's governments at the corresponding level, regulate and guide the construction, operation and maintenance of the base stations for satellite navigation positioning.

第三章 基礎測繪

Chapter III Basic Surveying and Mapping

第十五條   基礎測繪是公益性事業。國家對基礎測繪實行分級管理。

Article 15 Basic surveying and mapping is a public welfare undertaking. The State administers basic surveying and mapping at different levels.

本法所稱基礎測繪，是指建立全國統一的測繪基準和測繪系統，進行基礎航空攝影，獲取基礎地理信息的遙感資料，測制和更新國家基本比例尺地圖、影像圖和數字化產品，建立、更新基礎地理信息系統。

For purpose of this Law, basic surveying and mapping include establishing of the nationwide unified surveying and mapping datums and systems, taking of basic aerial photographs, obtaining of the remote sensing data of basic geographic information, surveying, producing and renewing of the national basic scale maps, photomaps and digital products and establishing and renewing of the basic geographic information system.

第十六條   國務院測繪地理信息主管部門會同國務院其他有關部門、軍隊測繪部門組織編制全國基礎測繪規劃，報國務院批準後組織實施。

Article 16 The competent department for the geographic information on surveying and mapping under the State Council shall, in conjunction with the relevant departments under the State Council and the department for surveying and mapping of the army, take charge of drawing up national plans for basic surveying and mapping, and shall submit the plans to the State Council for approval before making arrangements for their implementation.

縣級以上地方人民政府測繪地理信息主管部門會同本級人民政府其他有關部門，根據國家和上一級人民政府的基礎測繪規劃及本行政區域的實際情況，組織編制本行政區域的基礎測繪規劃，報本級人民政府批準後組織實施。

The competent departments for the geographic information on surveying and mapping under the local people's governments at or above the county level shall, in conjunction with the relevant departments of the people's governments at the corresponding level, take charge of drawing up the plans for basic surveying and mapping of their own administrative areas on the basis of the basic surveying and mapping plans of the State and of the people's government at the next higher level and in view of the actual conditions of their own administrative areas, submit the plans to the people's governments at the same level for approval and make arrangements for their implementation.

第十七條   軍隊測繪部門負責編制軍事測繪規劃，按照國務院、中央軍事委員會規定的職責分工負責編制海洋基礎測繪規劃，並組織實施。

Article 17 The competent department for surveying and mapping of the army shall be responsible for working out plans for military surveying and mapping and, in line with the division of functions and duties specified by the State Council and the Central Military Commission, take charge of drawing up plans for basic marine surveying and charting, and make arrangements for their implementation.

第十八條   縣級以上人民政府應當將基礎測繪納入本級國民經濟和社會發展年度計劃，將基礎測繪工作所需經費列入本級政府預算。

Article 18 People's governments at or above the county level shall incorporate basic surveying and mapping into their annual plans for national economic and social development and their budgets for the basic surveying and mapping at the same level.

國務院發展改革部門會同國務院測繪地理信息主管部門，根據全國基礎測繪規劃編制全國基礎測繪年度計劃。

The department for development and reform under the State Council shall, in conjunction with the competent department for the geographic information on surveying and mapping under the State Council and on the basis of the national basic surveying and mapping plan, draw up annual plans for national basic surveying and mapping.

縣級以上地方人民政府發展改革部門會同本級人民政府測繪地理信息主管部門，根據本行政區域的基礎測繪規劃編制本行政區域的基礎測繪年度計劃，並分別報上一級部門備案。

The departments for development and reform under the local people's governments at or above the county level shall, in conjunction with the competent departments for the geographic information on surveying and mapping at the corresponding level, draw up annual plans for basic surveying and mapping of their own administrative areas on the basis of the basic surveying and mapping plans for their own administrative areas, and submit their annual plans respectively to the competent departments at the next higher level for the record.

第十九條   基礎測繪成果應當定期更新，經濟建設、國防建設、社會發展和生態保護急需的基礎測繪成果應當及時更新。

Article 19 The results of basic surveying and mapping shall be regularly renewed. The results of basic surveying and mapping urgently needed for the development of the national economy, the building up of national defense, the advancement of society and ecological protection shall be renewed in a timely manner.

基礎測繪成果的更新周期根據不同地區國民經濟和社會發展的需要確定。

The period for updating the results of basic surveying and mapping shall be determined on the basis of the need for national economic and social development in different areas.

第四章 界線測繪和其他測繪

Chapter 4 Boundary Mapping and Other Mapping

第二十條   中華人民共和國國界線的測繪，按照中華人民共和國與相鄰國家締結的邊界條約或者協定執行，由外交部組織實施。中華人民共和國地圖的國界線標準樣圖，由外交部和國務院測繪地理信息主管部門擬定，報國務院批準後公布。

Article 20 The national boundaries of the People's Republic of China shall be surveyed and mapped in accordance with the boundary treaties or agreements concluded between the People's Republic of China and its neighboring countries. The Ministry of Foreign Affairs shall make arrangements for their implementation. Standard sample maps defining the international boundaries of the People's Republic of China shall be drafted by the Ministry of Foreign Affairs and the competent department for surveying, mapping and geoinformation under the State Council and submitted to the State Council for approval and publishing.

第二十一條   行政區域界線的測繪，按照國務院有關規定執行。省、自治區、直轄市和自治州、縣、自治縣、市行政區域界線的標準畫法圖，由國務院民政部門和國務院測繪地理信息主管部門擬定，報國務院批準後公布。

Article 21 The boundary lines between the administrative areas shall be surveyed and mapped in accordance with the relevant regulations of the State Council. Standard maps drawing the administrative boundaries between provinces, autonomous regions, municipalities directly under the Central Government, and between autonomous prefectures, counties, autonomous counties and cities shall be drafted by the department for civil affairs under the State Council and the competent department for surveying, mapping and geoinformation under the State Council and submitted to the State Council for approval and publication.

第二十二條   縣級以上人民政府測繪地理信息主管部門應當會同本級人民政府不動產登記主管部門，加強對不動產測繪的管理。

Article 22 The competent department for the geographic information on surveying and mapping under the people's government at or above the county level shall, in conjunction with the competent department for the registration of real estate under the people's government at the same level, strengthen the administration for the surveying and mapping of real estate.

測量土地、建築物、構築物和地面其他附著物的權屬界址線，應當按照縣級以上人民政府確定的權屬界線的界址點、界址線或者提供的有關登記資料和附圖進行。權屬界址線發生變化的，有關當事人應當及時進行變更測繪。

The estate boundary location lines of lands, buildings, structures and other aboveground objects attached to the land shall be surveyed in accordance with the estate boundary location points and estate boundary location lines determined by the local people's governments at or above the county level or with the relevant registration data and attached maps provided by the said governments. When changes in the estate boundary location lines take place, the persons concerned shall, without delay, conduct surveying and mapping accordingly.

第二十三條   城鄉建設領域的工程測量活動，與房屋產權、產籍相關的房屋面積的測量，應當執行由國務院住房城鄉建設主管部門、國務院測繪地理信息主管部門組織編制的測量技術規範。

Article 23 Projects in the field of urban and rural construction and housing areas related to housing property rights and housing cadastre shall be surveyed in accordance with the norms for surveying which are set under the charge of the competent department for housing and urban-rural development under the State Council and the competent department for surveying, mapping and geoinformation under the State Council.

水利、能源、交通、通信、資源開發和其他領域的工程測量活動，應當執行國家有關的工程測量技術規範。

Projects for water conservancy, energy, transportation, telecommunications, resource development and in other fields shall be surveyed in accordance with the relevant technical norms of the State for project surveying.

第二十四條   建立地理信息系統，應當采用符合國家標準的基礎地理信息數據。

Article 24 To establish a geographic information system, the basic geographic information and data that meet State standards shall be used.

第二十五條   縣級以上人民政府測繪地理信息主管部門應當根據突發事件應對工作需要，及時提供地圖、基礎地理信息數據等測繪成果，做好遙感監測、導航定位等應急測繪保障工作。

Article 25 The competent departments for surveying, mapping and geoinformation under the people's governments at or above the county level shall, in light of the need to respond to emergencies, provide maps, basic geographic information and data and other surveying and mapping results in a timely manner, and do a good job in providing guarantee for remote sensing, navigation positioning and other emergency surveying and mapping.

第二十六條   縣級以上人民政府測繪地理信息主管部門應當會同本級人民政府其他有關部門依法開展地理國情監測，並按照國家有關規定嚴格管理、規範使用地理國情監測成果。

Article 26 The competent departments for surveying, mapping and geoinformation under the people's governments at or above the county level shall, in conjunction with other relevant departments under the people's governments at the corresponding level, lawfully monitor geographic national conditions, and according to relevant State regulations, strictly administer and regulate the use of geographic national conditions monitoring results.

各級人民政府應當采取有效措施，發揮地理國情監測成果在政府決策、經濟社會發展和社會公眾服務中的作用。

People's governments at all levels shall take effective measures to give play to the role of the national geographic conditions monitoring results in government decision-making, economic and social development and social public services.

第五章 測繪資質資格

Chapter 5 Qualifications for Surveying and Mapping

第二十七條   國家對從事測繪活動的單位實行測繪資質管理制度。

Article 27 With regard to units engaged in surveying and mapping activities, the State applies a control system for the qualifications for surveying and mapping.

從事測繪活動的單位應當具備下列條件，並依法取得相應等級的測繪資質證書，方可從事測繪活動：

Units engaged in surveying and mapping activities shall meet the following requirements and obtain the necessary qualification certificates of surveying and mapping for different grades.

（一）有法人資格；

1. Having the status as a legal person;

（二）有與從事的測繪活動相適應的專業技術人員；

2. be manned with specialized technicians needed for the surveying and mapping they are engaged in;

（三）有與從事的測繪活動相適應的技術裝備和設施；

3. be equipped with the technical equipment and facilities needed for the surveying and mapping they are engaged in;

（四）有健全的技術和質量保證體系、安全保障措施、信息安全保密管理制度以及測繪成果和資料檔案管理制度。

(IV) have a sound technical and quality assurance system, security measures, information security and confidentiality management system and management system for surveying and mapping results and data files.

第二十八條   國務院測繪地理信息主管部門和省、自治區、直轄市人民政府測繪地理信息主管部門按照各自的職責負責測繪資質審查、發放測繪資質證書。具體辦法由國務院測繪地理信息主管部門商國務院其他有關部門規定。

Article 28 The competent department for the geographic information on surveying and mapping under the State Council and competent departments for the geographic information on surveying and mapping under the people's governments of the provinces, autonomous regions, and municipalities directly under the Central Government shall, in compliance with their respective functions and duties, take charge of examining the qualifications for surveying and mapping as well as of issuing qualification certificates. The specific measures in this respect shall be formulated by the competent department for the geographic information on surveying and mapping under the State Council after consultation with other relevant departments under the State Council.

軍隊測繪部門負責軍事測繪單位的測繪資質審查。

The department for surveying and mapping of the army shall be responsible for examination of the qualifications for surveying and mapping of military surveying and mapping units.

第二十九條   測繪單位不得超越資質等級許可的範圍從事測繪活動，不得以其他測繪單位的名義從事測繪活動，不得允許其他單位以本單位的名義從事測繪活動。

Article 29 No surveying and mapping units may engage in surveying and mapping activities by exceeding the scope allowed for their grades of qualification or engage in such activities in the name of other surveying and mapping units, or permit other units to engage in such activities in their names.

測繪項目實行招投標的，測繪項目的招標單位應當依法在招標公告或者投標邀請書中對測繪單位資質等級作出要求，不得讓不具有相應測繪資質等級的單位中標，不得讓測繪單位低於測繪成本中標。

Where bidding and tendering are conducted for a surveying and mapping project, the tendering unit of the project shall specify the requirements for the grade of qualifications of surveying and mapping units in the relevant tendering announcement or the invitation for bids, and shall not allow a unit that does not possess the necessary qualification grade of surveying and mapping to win the bidding or a surveying and mapping unit to win the bidding at a price lower than the cost of surveying and mapping.

中標的測繪單位不得向他人轉讓測繪項目。

The surveying and mapping entity that has won the bid shall not transfer the surveying and mapping project to others.

第三十條   從事測繪活動的專業技術人員應當具備相應的執業資格條件。具體辦法由國務院測繪地理信息主管部門會同國務院人力資源社會保障主管部門規定。

Article 30 Specialized technicians engaged in surveying and mapping activities shall possess the necessary professional qualifications. Specific measures in this respect shall be formulated by the competent department for the geographic information on surveying and mapping under the State Council in conjunction with the competent department for human resources and social security under the State Council.

第三十一條   測繪人員進行測繪活動時，應當持有測繪作業證件。

Article 31 Persons conducting surveying and mapping activities shall hold certificates for surveying and mapping operation.

任何單位和個人不得阻礙測繪人員依法進行測繪活動。

No units or individuals may hinder the surveying and mapping activities conducted by mapping persons in accordance with the law.

第三十二條   測繪單位的測繪資質證書、測繪專業技術人員的執業證書和測繪人員的測繪作業證件的式樣，由國務院測繪地理信息主管部門統一規定。

Article 32 The designs of the qualification certificate for surveying and mapping units, of the professional certificate for specialized surveying and mapping technicians and of the operation certificate for surveying and mapping persons shall all be set by the competent department for the geographic information on surveying and mapping under the State Council.

第六章 測繪成果

Chapter 6 Surveying and Mapping Results

第三十三條   國家實行測繪成果匯交制度。國家依法保護測繪成果的知識產權。

Article 33 The State applies the system of summarizing and submitting surveying and mapping results. The State protects the intellectual property rights of surveying and mapping results in accordance with the law.

測繪項目完成後，測繪項目出資人或者承擔國家投資的測繪項目的單位，應當向國務院測繪地理信息主管部門或者省、自治區、直轄市人民政府測繪地理信息主管部門匯交測繪成果資料。屬於基礎測繪項目的，應當匯交測繪成果副本；屬於非基礎測繪項目的，應當匯交測繪成果目錄。負責接收測繪成果副本和目錄的測繪地理信息主管部門應當出具測繪成果匯交憑證，並及時將測繪成果副本和目錄移交給保管單位。測繪成果匯交的具體辦法由國務院規定。

After a surveying and mapping project is completed, the investor for the project or the surveying and mapping unit undertaking the project invested in by the State shall summarize and submit the materials of the surveying and mapping results to the competent department for surveying, mapping and geoinformation under the State Council or to the competent department for surveying, mapping and geoinformation under the people's government of the relevant province, autonomous region or centrally-administered municipality. If the results belong to a basic surveying and mapping project, they shall be summarized and submitted in the form of a duplicate copy; and if they do not belong to a basic surveying and mapping project, they shall be summarized and submitted in the form of a catalogue. The competent department for the geographic information on surveying and mapping in charge of accepting duplicate copies and catalogs of surveying and mapping results shall produce a voucher for receipt of such copies and catalogs and shall, without delay, hand over such copies and catalogs to the unit in charge of their keeping. Specific measures for summarizing and submitting surveying and mapping results shall be formulated by the State Council.

國務院測繪地理信息主管部門和省、自治區、直轄市人民政府測繪地理信息主管部門應當及時編制測繪成果目錄，並向社會公布。

The competent department for the geographic information on surveying and mapping under the State Council and competent departments for the geographic information on surveying and mapping under the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall timely compile catalogues of the surveying and mapping results and make them known to the general public.

第三十四條   縣級以上人民政府測繪地理信息主管部門應當積極推進公眾版測繪成果的加工和編制工作，通過提供公眾版測繪成果、保密技術處理等方式，促進測繪成果的社會化應用。

Article 34 The competent departments for surveying, mapping and geoinformation under the people's governments at or above the county level shall actively promote the processing and compilation of surveying and mapping results of public versions, and by the provision of surveying and mapping results of public versions and technical confidential treatment, promote the application of surveying and mapping results in society.

測繪成果保管單位應當采取措施保障測繪成果的完整和安全，並按照國家有關規定向社會公開和提供利用。

Units in charge of keeping the surveying and mapping results shall take measures to ensure the completeness and safety of the surveying and mapping results and, in accordance with relevant State regulations, make them known to the public and make them available for use.

測繪成果屬於國家秘密的，適用保密法律、行政法規的規定；需要對外提供的，按照國務院和中央軍事委員會規定的審批程序執行。

If the surveying and mapping results belong to State secrets, the provisions of laws and administrative rules and regulations governing State secrets shall be applied; and in the event they are required to be provided to foreign organizations or individuals, the procedures of examination and approval laid down by the State Council and the Central Military Commission shall be followed.

測繪成果的秘密範圍和秘密等級，應當依照保密法律、行政法規的規定，按照保障國家秘密安全、促進地理信息共享和應用的原則確定並及時調整、公布。

The scope and classification of secrecy of surveying and mapping results shall be determined in accordance with the provisions of secrecy laws and administrative regulations and on the principle of safeguarding the security of State secrets and promoting the sharing and application of geographic information, and be adjusted and published in a timely manner.

第三十五條   使用財政資金的測繪項目和涉及測繪的其他使用財政資金的項目，有關部門在批準立項前應當征求本級人民政府測繪地理信息主管部門的意見；有適宜測繪成果的，應當充分利用已有的測繪成果，避免重複測繪。

Article 35 With respect to the surveying and mapping projects funded by public finance and other projects involving surveying and mapping funded by public finance, the relevant departments shall, prior to giving approval to establishment of such projects, consult with the competent department for the geographic information on surveying and mapping under the people's government at the corresponding level. Where there are surveying and mapping results suitable to the projects, they shall be made full use of so as to prevent duplicate surveying and mapping.

第三十六條   基礎測繪成果和國家投資完成的其他測繪成果，用於政府決策、國防建設和公共服務的，應當無償提供。

Article 36 Where basic surveying and mapping results and other results of surveying and mapping completed with State investment are to be used for decision-making by State organs, building up of national defense and public services, they shall be provided gratis.

除前款規定情形外，測繪成果依法實行有償使用制度。但是，各級人民政府及有關部門和軍隊因防災減災、應對突發事件、維護國家安全等公共利益的需要，可以無償使用。

Except for the situations specified in the preceding paragraph, the use of surveying and mapping results shall be paid for in accordance with the law. However, people's governments at all levels, the relevant departments and the army may use them free of charge in their efforts to meet the needs of such public interests as taking precautions against natural calamities, mitigating disasters, responding to emergencies and safeguarding national security.

測繪成果使用的具體辦法由國務院規定。

Specific measures for use of surveying and mapping results shall be formulated by the State Council.

第三十七條   中華人民共和國領域和中華人民共和國管轄的其他海域的位置、高程、深度、面積、長度等重要地理信息數據，由國務院測繪地理信息主管部門審核，並與國務院其他有關部門、軍隊測繪部門會商後，報國務院批準，由國務院或者國務院授權的部門公布。

Article 37 Significant geographic information and data concerning the positions, elevations, depths, areas and lengths of the territorial air, land and waters, as well as other sea areas under the jurisdiction of the People's Republic of China shall be examined and verified by the competent department for the geographic information on surveying and mapping under the State Council, and then, after consultation with the relevant departments under the State Council and the competent department for surveying and mapping of the army, be submitted to the State Council for approval and published by the State Council or by the department authorized by it.

第三十八條   地圖的編制、出版、展示、登載及更新應當遵守國家有關地圖編制標準、地圖內容表示、地圖審核的規定。

Article 38 The drawing up, publishing, displaying, carrying and updating of maps shall conform to the provisions of the State on the map drawing up standards, expression of map contents and map review.

互聯網地圖服務提供者應當使用經依法審核批準的地圖，建立地圖數據安全管理制度，采取安全保障措施，加強對互聯網地圖新增內容的核校，提高服務質量。

Internet map service providers shall use maps that have been reviewed and approved in accordance with the law, establish a safety management system for map data, take safety guarantee measures, strengthen the review and proofreading of newly added contents on Internet maps, and enhance service quality.

縣級以上人民政府和測繪地理信息主管部門、網信部門等有關部門應當加強對地圖編制、出版、展示、登載和互聯網地圖服務的監督管理，保證地圖質量，維護國家主權、安全和利益。

People's governments at or above the county level and the competent departments for surveying, mapping and geoinformation, departments for cyberspace affairs and other relevant departments shall tighten supervision and control over the drawing up, publishing, displaying and carrying of maps and Internet map services, guarantee the quality of maps and safeguard the sovereignty, security and interests of the State.

地圖管理的具體辦法由國務院規定。

The specific measures in this regard shall be formulated by the State Council.

第三十九條   測繪單位應當對完成的測繪成果質量負責。縣級以上人民政府測繪地理信息主管部門應當加強對測繪成果質量的監督管理。

Article 39 Surveying and mapping units shall be responsible for the quality of the surveying and mapping results they have achieved. The competent departments for the geographic information on surveying and mapping under the people's governments at or above the county level shall exercise strict supervision over the quality of the surveying and mapping results.

第四十條   國家鼓勵發展地理信息產業，推動地理信息產業結構調整和優化升級，支持開發各類地理信息產品，提高產品質量，推廣使用安全可信的地理信息技術和設備。

Article 40 The State encourages the development of the geographic information industry, promotes its restructuring, optimization and upgrading, supports the development of various geographic information products, enhances product quality, and promotes the use of safe and reliable geographic information technologies and equipment.

縣級以上人民政府應當建立健全政府部門間地理信息資源共建共享機制，引導和支持企業提供地理信息社會化服務，促進地理信息廣泛應用。

People's governments at or above the county level shall establish and improve the mechanism for joint-development and sharing of geographic information resources among government departments, guide and support enterprises to provide socialized services related to geographic information, and promote the wide application of geographic information.

縣級以上人民政府測繪地理信息主管部門應當及時獲取、處理、更新基礎地理信息數據，通過地理信息公共服務平臺向社會提供地理信息公共服務，實現地理信息數據開放共享。

The competent departments for surveying, mapping and geoinformation under the people's governments at or above the county level shall timely obtain, dispose of, and update the basic geographic information and data, and provide society with public services of geographic information through public service platforms for geographic information so as to achieve the opening and sharing of geographic information and data.

第七章 測量標志保護

Chapter 7 Protection of Survey Marks

第四十一條   任何單位和個人不得損毀或者擅自移動永久性測量標志和正在使用中的臨時性測量標志，不得侵占永久性測量標志用地，不得在永久性測量標志安全控制範圍內從事危害測量標志安全和使用效能的活動。

Article 41 No units or individuals may damage, destroy or, without authorization, remove permanent surveying markers or temporary surveying markers in use, or seize or occupy the land used for permanent surveying markers; nor may they, within the security control area of a permanent surveying marker, conduct activities which endanger the safety and impair the effective use of the surveying markers.

本法所稱永久性測量標志，是指各等級的三角點、基線點、導線點、軍用控制點、重力點、天文點、水準點和衛星定位點的觇標和標石標志，以及用於地形測圖、工程測量和形變測量的固定標志和海底大地點設施。

For purposes of this Law, permanent surveying markers include signals and stone markers established at triangulation points, baseline points, traverse points, military control points, gravimetric points, astronomic points, leveling points and satellite positioning points of various orders and classes, as well as fixed markers used for topographic mapping, engineering surveying and deformation measurement, and installations at seabed geodetic points.

第四十二條   永久性測量標志的建設單位應當對永久性測量標志設立明顯標記，並委托當地有關單位指派專人負責保管。

Article 42 A unit that establishes permanent surveying markers shall set up distinct signs for such markers, and entrust an appropriate local unit with the designation of persons specially for taking care of them.

第四十三條   進行工程建設，應當避開永久性測量標志；確實無法避開，需要拆遷永久性測量標志或者使永久性測量標志失去使用效能的，應當經省、自治區、直轄市人民政府測繪地理信息主管部門批準；涉及軍用控制點的，應當征得軍隊測繪部門的同意。所需遷建費用由工程建設單位承擔。

Article 43 In carrying out engineering construction, the construction unit shall seek to get around permanent surveying markers; where it is absolutely impossible to get around such markers and necessary to have them removed or rendered ineffective, the matter shall be subject to approval by the competent department for the geographic information on surveying and mapping under the people's government of the relevant province, autonomous region or municipality directly under the Central Government. Where a military control point is involved, the matter shall be subject to consent by the department for surveying and mapping of the army. All the necessary costs shall be born by the project owner.

第四十四條   測繪人員使用永久性測量標志，應當持有測繪作業證件，並保證測量標志的完好。

Article 44 When employing permanent surveying markers, the surveying and mapping persons shall hold their certificates for surveying and mapping operations and ensure that the markers remain in good condition.

保管測量標志的人員應當查驗測量標志使用後的完好狀況。

Persons responsible for taking care of the surveying markers shall inspect and examine whether they are intact after employment.

第四十五條   縣級以上人民政府應當采取有效措施加強測量標志的保護工作。

Article 45 People's governments at or above the county level shall take effective measures to improve protection of the surveying markers.

縣級以上人民政府測繪地理信息主管部門應當按照規定檢查、維護永久性測量標志。

The competent departments for the geographic information on surveying and mapping under the people's governments at or above the county level shall, in accordance with relevant regulations, inspect and maintain the permanent surveying markers.

鄉級人民政府應當做好本行政區域內的測量標志保護工作。

People's governments at the township level shall properly protect the surveying markers within their own administrative areas.

第八章 監督管理

Chapter 8 Supervision and Administration

第四十六條   縣級以上人民政府測繪地理信息主管部門應當會同本級人民政府其他有關部門建立地理信息安全管理制度和技術防控體系，並加強對地理信息安全的監督管理。

Article 46 The competent departments for surveying, mapping and geoinformation under the people's governments at or above the county level shall, in conjunction with other relevant departments under the people's governments at the corresponding level, establish a safety management system and a technology control system for geographic information, and strengthen the supervision of the safety of geographic information.

第四十七條   地理信息生產、保管、利用單位應當對屬於國家秘密的地理信息的獲取、持有、提供、利用情況進行登記並長期保存，實行可追溯管理。

Article 47 Entities that produce, keep or make use of geographic information shall register the acquisition, holding, provision and utilization of the geographic information that belongs to State secrets, keep the same for a long period of time, and conduct traceability management.

從事測繪活動涉及獲取、持有、提供、利用屬於國家秘密的地理信息，應當遵守保密法律、行政法規和國家有關規定。

Where any surveying and mapping activity involves the acquisition, possession, provision or use of the geographic information that is in the nature of a State secret, relevant confidentiality laws, administrative regulations and provisions of the State shall be complied with.

地理信息生產、利用單位和互聯網地圖服務提供者收集、使用用戶個人信息的，應當遵守法律、行政法規關於個人信息保護的規定。

Where entities producing and using geographic information and Internet map service providers collect and use the personal information of users, they shall comply with the provisions on the protection of personal information in laws and administrative regulations.

第四十八條   縣級以上人民政府測繪地理信息主管部門應當對測繪單位實行信用管理，並依法將其信用信息予以公示。

Article 48 The competent departments for surveying, mapping and geoinformation under the people's governments at or above the county level shall conduct credit management of surveying and mapping entities, and make public their credit information in accordance with the law.

第四十九條   縣級以上人民政府測繪地理信息主管部門應當建立健全隨機抽查機制，依法履行監督檢查職責，發現涉嫌違反本法規定行為的，可以依法采取下列措施：

Article 49 The competent departments for the geographic information on surveying and mapping under the people's governments at or above the county level shall establish and perfect a random inspection mechanism, and fulfill supervision and inspection duties in accordance with the law. Where any of such departments finds out any behavior suspected of violating this Law, it may take the following measures in accordance with the law:

（一）查閱、複制有關合同、票據、賬簿、登記臺賬以及其他有關文件、資料；

1. consult and copy relevant contracts, bills, account books, registration ledgers and other relevant documents and materials;

（二）查封、扣押與涉嫌違法測繪行為直接相關的設備、工具、原材料、測繪成果資料等。

(II) seal up and detain the equipment, tools, raw materials, surveying and mapping results and data and so on directly related to the illegal surveying and mapping acts.

被檢查的單位和個人應當配合，如實提供有關文件、資料，不得隱瞞、拒絕和阻礙。

The inspected units and individuals shall cooperate and truthfully provide relevant documents and materials, and shall not conceal them, or refuse or obstruct the inspection.

任何單位和個人對違反本法規定的行為，有權向縣級以上人民政府測繪地理信息主管部門舉報。接到舉報的測繪地理信息主管部門應當及時依法處理。

All entities or individuals shall have the right to report any violation of this Law to the competent department for the geographic information on surveying and mapping under the people's government at or above the county level. The competent department for the geographic information on surveying and mapping shall, upon receipt of a report, timely handle the case in accordance with the law.

第九章 法律責任

Chapter 9 Legal Liabilities

第五十條   違反本法規定，縣級以上人民政府測繪地理信息主管部門或者其他有關部門工作人員利用職務上的便利收受他人財物、其他好處或者玩忽職守，對不符合法定條件的單位核發測繪資質證書，不依法履行監督管理職責，或者發現違法行為不予查處的，對負有責任的領導人員和直接責任人員，依法給予處分；構成犯罪的，依法追究刑事責任。

Article 50 Where a staff member of the competent department for surveying, mapping and geoinformation or any other relevant department under the people's government at or above the county level, in violation of the provisions of this Law, and by taking advantage of his position, accepts another person's money or things of value or other benefits, or neglects his duties, verifies and issues a qualification certificate for surveying and mapping to a unit that does not meet the statutory requirements, fails to perform his duty of supervision in accordance with law, or fails to investigate and punish the violations of law discovered, the person in charge and the persons directly responsible shall be given sanctions in accordance with law; and if a crime is constituted, he shall be investigated for criminal liability in accordance with law.

第五十一條   違反本法規定，外國的組織或者個人未經批準，或者未與中華人民共和國有關部門、單位合作，擅自從事測繪活動的，責令停止違法行為，沒收違法所得、測繪成果和測繪工具，並處十萬元以上五十萬元以下的罰款；情節嚴重的，並處五十萬元以上一百萬元以下的罰款，限期出境或者驅逐出境；構成犯罪的，依法追究刑事責任。

Article 51 Any foreign organization or individual that, in violation of the provisions of this Law, engages in any surveying and mapping activities without approval or cooperates with a relevant department or entity of the People's Republic of China shall be ordered to desist from the violation, the illegal gains, surveying and mapping results and tools shall be confiscated, and it/he shall be fined not less than 100,000 yuan but not more than 500,000 yuan; if the circumstances are serious, it/he shall be fined not less than 500,000 yuan but not more than one million yuan and shall be ordered to leave the country within a specified time limit or expelled from the country; and if a crime is constituted, it/he shall be investigated for criminal liability in accordance with the law.

第五十二條   違反本法規定，未經批準擅自建立相對獨立的平面坐標系統，或者采用不符合國家標準的基礎地理信息數據建立地理信息系統的，給予警告，責令改正，可以並處五十萬元以下的罰款；對直接負責的主管人員和其他直接責任人員，依法給予處分。

Article 52 Where any entity, in violation of the provisions of this Law, establishes without approval, a relatively independent plane coordinate system, or establishes a geographic information system by adopting the basic geographic information and data which do not conform to the norms of the State, it shall be given disciplinary warning, ordered to make rectification, and may, in addition, be fined not more than 500,000 yuan; and the person directly in charge and the other persons directly liable shall be given sanctions in accordance with the law.

第五十三條   違反本法規定，衛星導航定位基準站建設單位未報備案的，給予警告，責令限期改正；逾期不改正的，處十萬元以上三十萬元以下的罰款；對直接負責的主管人員和其他直接責任人員，依法給予處分。

Article 53 Where any entity in charge of the construction of a base station for satellite navigation positioning, in violation of the provisions of this Law, fails to report it for the record, it shall be given disciplinary warning and ordered to make rectification within a time limit; if it fails to do so at the expiration of the time limit, the entity shall be fined not less than 100,000 yuan but not more than 300,000 yuan; and the person directly in charge and the other persons directly liable shall be given sanctions in accordance with the law.

第五十四條   違反本法規定，衛星導航定位基準站的建設和運行維護不符合國家標準、要求的，給予警告，責令限期改正，沒收違法所得和測繪成果，並處三十萬元以上五十萬元以下的罰款；逾期不改正的，沒收相關設備；對直接負責的主管人員和其他直接責任人員，依法給予處分；構成犯罪的，依法追究刑事責任。

Article 54 Where, in violation of the provisions of this Law, the construction, operation or maintenance of a base station for satellite navigation positioning fails to conform to national standards or requirements, the relevant entity shall be given disciplinary warning and ordered to make rectification within a time limit, its unlawful gains and surveying and mapping results shall be confiscated, and such entity shall be fined not less than 300,000 yuan but not more than 500,000 yuan; if the entity fails to make rectification at the expiration of the time limit, the relevant equipment shall be confiscated; the person directly in charge and the other persons directly liable shall be given sanctions in accordance with the law; and if a crime is constituted, the entity shall be investigated for criminal liability in accordance with the law.

第五十五條   違反本法規定，未取得測繪資質證書，擅自從事測繪活動的，責令停止違法行為，沒收違法所得和測繪成果，並處測繪約定報酬一倍以上二倍以下的罰款；情節嚴重的，沒收測繪工具。

Article 55 Anyone who, in violation of the provisions of this Law, and, without obtaining qualification certificates for surveying and mapping, engages in surveying and mapping activities shall be ordered to desist from the violation; his unlawful gains and surveying and mapping results shall be confiscated; and, in addition, he shall be fined not less than the amount of, but not more than two times the amount of, the remuneration for surveying and mapping agreed upon; and if the circumstances are serious, surveying and mapping tools shall be confiscated.

以欺騙手段取得測繪資質證書從事測繪活動的，吊銷測繪資質證書，沒收違法所得和測繪成果，並處測繪約定報酬一倍以上二倍以下的罰款；情節嚴重的，沒收測繪工具。

Where a person engages in surveying and mapping activities with his qualification certificate for surveying and mapping obtained by fraudulent means, his certificate shall be revoked, his unlawful gains and surveying and mapping results shall be confiscated, and, in addition, he shall be fined not less than the amount of, but not more than two times the amount of, the remuneration for surveying and mapping agreed upon; and if the circumstances are serious, surveying and mapping tools shall be confiscated.

第五十六條   違反本法規定，測繪單位有下列行為之一的，責令停止違法行為，沒收違法所得和測繪成果，處測繪約定報酬一倍以上二倍以下的罰款，並可以責令停業整頓或者降低測繪資質等級；情節嚴重的，吊銷測繪資質證書：

Article 56 Where a surveying and mapping unit, in violation of the provisions of this Law, commits one of the following acts, it shall be ordered to desist from the violation, its unlawful gains and surveying and mapping results shall be confiscated, it shall be fined not less than the amount of, but not more two times the amount of, the remuneration for surveying and mapping agreed upon, and it may, in addition, be ordered to suspend operation for shake-up or its qualification may be downgraded; and if the circumstances are serious, its qualification certificates for surveying and mapping shall be revoked:

（一）超越資質等級許可的範圍從事測繪活動；

1. engaging in surveying and mapping activities by exceeding the scope allowed for its grade of qualification;

（二）以其他測繪單位的名義從事測繪活動；

2. engaging in surveying and mapping activities in the name of another surveying and mapping unit; and

（三）允許其他單位以本單位的名義從事測繪活動。

(III) permitting another unit to conduct surveying and mapping activities in its name.

第五十七條   違反本法規定，測繪項目的招標單位讓不具有相應資質等級的測繪單位中標，或者讓測繪單位低於測繪成本中標的，責令改正，可以處測繪約定報酬二倍以下的罰款。招標單位的工作人員利用職務上的便利，索取他人財物，或者非法收受他人財物為他人謀取利益的，依法給予處分；構成犯罪的，依法追究刑事責任。

Article 57 Where any entity offering bid invitation for a surveying and mapping project, in violation of this Law, allow an entity that does not possess the necessary qualification grade to win the bid or allow a surveying and mapping entity to win the bid at a price lower than the cost of surveying and mapping, it shall be ordered to put it right, and it may be fined not more than two times the amount of the remuneration for surveying and mapping agreed upon. Where a staff member of the tendering unit, taking advantage of his position, extorts or illegally accepts money or things of value from another person or seeks benefits for another person, he shall be given sanctions in accordance with law; and if a crime is constituted, he shall be investigated for criminal responsibility in accordance with law.

第五十八條   違反本法規定，中標的測繪單位向他人轉讓測繪項目的，責令改正，沒收違法所得，處測繪約定報酬一倍以上二倍以下的罰款，並可以責令停業整頓或者降低測繪資質等級；情節嚴重的，吊銷測繪資質證書。

Article 58 Where a surveying and mapping unit winning the bidding, in violation of this Law, transfers a surveying and mapping project to another unit, it shall be ordered to put it right, its unlawful gains shall be confiscated, it shall be fined not less than the amount of, but not more two times the amount of, the remuneration for surveying and mapping agreed upon, and it may, in addition, be ordered to suspend operation for shake-up or its qualification may be downgraded; and if the circumstances are serious, its qualification certificate for surveying and mapping shall be revoked.

第五十九條   違反本法規定，未取得測繪執業資格，擅自從事測繪活動的，責令停止違法行為，沒收違法所得和測繪成果，對其所在單位可以處違法所得二倍以下的罰款；情節嚴重的，沒收測繪工具；造成損失的，依法承擔賠償責任。

Article 59 Anyone who, in violation of the provisions of this Law and without being qualified for the practice of surveying and mapping, engages in surveying and mapping activities shall be ordered to desist from the violation; his unlawful gains and surveying and mapping results shall be confiscated; and, in addition, his unit may be fined not more than two times the amount of his unlawful gains; if the circumstances are serious, surveying and mapping tools shall be confiscated; and if losses are caused, he shall bear the responsibility to pay compensation in accordance with law.

第六十條   違反本法規定，不匯交測繪成果資料的，責令限期匯交；測繪項目出資人逾期不匯交的，處重測所需費用一倍以上二倍以下的罰款；承擔國家投資的測繪項目的單位逾期不匯交的，處五萬元以上二十萬元以下的罰款，並處暫扣測繪資質證書，自暫扣測繪資質證書之日起六個月內仍不匯交的，吊銷測繪資質證書；對直接負責的主管人員和其他直接責任人員，依法給予處分。

Article 60 Where any entity or individual, in violation of the provisions of this Law, fails to summarize and submit the materials of its/his surveying and mapping results, it/he shall be ordered to summarize and submit the materials within a specified time limit; if the investor for the surveying and mapping project fails to do so at the expiration of the time limit, the investor shall be fined not less than the amount of, but not more than two times the amount of, the expenses entailed by resurveying and remapping of the project; if the entity undertaking the surveying and mapping project invested by the State fails to do so at the expiration of the time limit, the entity shall be fined not less than 50,000 yuan but not more than 200,000 yuan and its qualification certificate for surveying and mapping shall be temporarily suspended; if the entity still fails to do so within six months from the date its qualification certificate is temporarily suspended, its qualification certificate shall be revoked; and the person directly in charge and the other persons directly responsible shall be given sanctions in accordance with law.

第六十一條   違反本法規定，擅自發布中華人民共和國領域和中華人民共和國管轄的其他海域的重要地理信息數據的，給予警告，責令改正，可以並處五十萬元以下的罰款；對直接負責的主管人員和其他直接責任人員，依法給予處分；構成犯罪的，依法追究刑事責任。

Article 61 Where any entity, in violation of the provisions of this Law, publishes, without authorization, significant geographic information and data concerning the territorial air, land and waters, as well as other sea areas under the jurisdiction of the People's Republic of China, it shall be given disciplinary warning, ordered to make rectification, and may, in addition, be fined not more than 500,000 yuan; the person directly in charge and the other persons directly liable shall be given sanctions in accordance with the law; and if a crime is constituted, it shall be investigated for criminal liability in accordance with the law.

第六十二條   違反本法規定，編制、出版、展示、登載、更新的地圖或者互聯網地圖服務不符合國家有關地圖管理規定的，依法給予行政處罰、處分；構成犯罪的，依法追究刑事責任。

Article 62 Where, in violation of the provisions of this Law, the drawing up, publishing, displaying, carrying or updating of a map or any Internet map service does not conform to the relevant regulations of the State on map management, administrative penalties and sanctions shall be imposed in accordance with the law; if a crime is constituted, criminal liability shall be investigated in accordance with the law.

第六十三條   違反本法規定，測繪成果質量不合格的，責令測繪單位補測或者重測；情節嚴重的，責令停業整頓，並處降低測繪資質等級或者吊銷測繪資質證書；造成損失的，依法承擔賠償責任。

Article 63 Where a surveying and mapping unit, in violation of the provisions of this Law, achieves unqualified results, it shall be ordered to conduct make-up surveying and mapping or to resurvey and remap the project; if the circumstances are serious, it shall be ordered to suspend operation for shake-up, and its qualification be downgraded, or its qualification certificate for surveying and mapping be revoked; and if losses are caused, it shall bear the responsibility to pay compensation to the others in accordance with law.

第六十四條   違反本法規定，有下列行為之一的，給予警告，責令改正，可以並處二十萬元以下的罰款；對直接負責的主管人員和其他直接責任人員，依法給予處分；造成損失的，依法承擔賠償責任；構成犯罪的，依法追究刑事責任：

Article 64 Any unit or individual that, in violation of the provisions of this Law, commits one of the following acts shall be given disciplinary warning, ordered to make rectification, and may, in addition, be fined not more than 200,000 yuan; the persons directly in charge and the other persons directly liable shall be imposed sanctions in accordance with the law; if losses are caused, it/he shall, in accordance with the law, bear the liability to pay compensation; and, if a crime is constituted, criminal liability shall be investigated in accordance with the law:

（一）損毀、擅自移動永久性測量標志或者正在使用中的臨時性測量標志；

1. damages, destroys or, without authorization, removes permanent surveying markers or temporary surveying markers in use;

（二）侵占永久性測量標志用地；

2. seizing or occupying the land used for permanent surveying markers;

（三）在永久性測量標志安全控制範圍內從事危害測量標志安全和使用效能的活動；

(III) within the security control area of a permanent surveying marker, conducting activities which endanger the safety and impair the effective use of the surveying markers;

（四）擅自拆遷永久性測量標志或者使永久性測量標志失去使用效能，或者拒絕支付遷建費用；

(IV) without authorization, dismantle permanent surveying markers or render them ineffective, or refuse to pay the expenses entailed by the removal and reestablishment of the markers; and

（五）違反操作規程使用永久性測量標志，造成永久性測量標志毀損。

(V) damaging or destroying permanent surveying markers through violation of the operating rules.

第六十五條   違反本法規定，地理信息生產、保管、利用單位未對屬於國家秘密的地理信息的獲取、持有、提供、利用情況進行登記、長期保存的，給予警告，責令改正，可以並處二十萬元以下的罰款；泄露國家秘密的，責令停業整頓，並處降低測繪資質等級或者吊銷測繪資質證書；構成犯罪的，依法追究刑事責任。

Article 65 Where any entity producing, keeping or using geographic information, in violation of the provisions of this Law, fails to register the acquisition, holding, provision and utilization of the geographic information that belongs to State secrets or fails to keep the same for a long period of time, it shall be given disciplinary warning, ordered to make rectification, and may, in addition, be fined not more than 200,000 yuan; if any State secrets are divulged, it shall be ordered to suspend operation for shake-up, and its qualification be downgraded, or its qualification certificate for surveying and mapping be revoked; and if a crime is constituted, the entity shall be investigated for criminal liability in accordance with the law.

違反本法規定，獲取、持有、提供、利用屬於國家秘密的地理信息的，給予警告，責令停止違法行為，沒收違法所得，可以並處違法所得二倍以下的罰款；對直接負責的主管人員和其他直接責任人員，依法給予處分；造成損失的，依法承擔賠償責任；構成犯罪的，依法追究刑事責任。

Where any entity, in violation of the provisions of this Law, acquires, holds, provides or makes use of the geographic information that belongs to State secrets, it shall be given disciplinary warning and ordered to desist from the violation, its unlawful gains shall be confiscated, and it may, in addition, be fined not more than two times the amount of its unlawful gains; the person directly in charge and the other persons directly liable shall be given sanctions in accordance with the law; if losses are caused, it shall, in accordance with the law, bear the liability to pay compensation; and if a crime is constituted, criminal liability shall be investigated in accordance with the law.

第六十六條   本法規定的降低測繪資質等級、暫扣測繪資質證書、吊銷測繪資質證書的行政處罰，由頒發測繪資質證書的部門決定；其他行政處罰，由縣級以上人民政府測繪地理信息主管部門決定。

Article 66 The administrative penalties involving the downgrading of qualifications for surveying and mapping, temporary taking away of the qualification certificates for surveying and mapping and revoking of such certificates, as provided for by this Law, shall be decided on by the department that issues such certificates; and the other administrative penalties shall be decided on by the competent departments for the geographic information on surveying and mapping under the people's governments at or above the county level.

本法第五十一條規定的限期出境和驅逐出境由公安機關依法決定並執行。

The order for leaving the country within a specified time limit and expulsion from the country, as provided for in Article 51 of this Law, shall be decided on by the public security organ.

第十章 附 則

Chapter 10 Supplementary Provisions

第六十七條   軍事測繪管理辦法由中央軍事委員會根據本法規定。

Article 67 Administrative measures for military surveying and mapping shall be formulated by the Central Military Commission in accordance with the provisions of this Law.

第六十八條   本法自2017年7月1日起施行。

Article 68 This Law shall come into force as of July 1, 2017.
