第一章 總則
Chapter 1 General Provisions
第一條 為了加強農業技術推廣工作,促使農業科研成果和實用技術盡快應用於農業生產,增強科技支撐保障能力,促進農業和農村經濟可持續發展,實現農業現代化,制定本法。
Article 1 This Law is enacted with a view to strengthening the work of agro-technical popularization, enabling the prompt application of results of agricultural scientific research and practical technologies to agricultural production, enhancing the supporting and safeguarding ability of science and technology, promoting the sustainable development of agriculture and rural economy, and realizing the modernization of agriculture.
第二條 本法所稱農業技術,是指應用於種植業、林業、畜牧業、漁業的科研成果和實用技術,包括:
Article 2 For purposes of this Law, agricultural technologies refer to achievements of scientific research and practical technologies applied to crop cultivation, forestry, animal husbandry and fishery, including:
(一)良種繁育、栽培、肥料施用和養殖技術;
1. Technologies or cultivation of good strains of plants, planting, application of fertilizers, and animal breeding;
(二)植物病蟲害、動物疫病和其他有害生物防治技術;
(II) Technologies for preventing and controlling plant diseases and insect pests, animal epidemic diseases, and other harmful organisms;
(三)農產品收獲、加工、包裝、貯藏、運輸技術;
(III) Technologies for harvesting, processing, packaging, storing and transporting agricultural products;
(四)農業投入品安全使用、農產品質量安全技術;
(IV) technologies on safe use of agricultural inputs and quality safety of agricultural products;
(五)農田水利、農村供排水、土壤改良與水土保持技術;
(V) Technologies for farmland irrigation, water supply and drainage, soil amelioration and water and soil conservation;
(六)農業機械化、農用航空、農業氣象和農業信息技術;
(VI) Technologies for agricultural mechanization, agricultural aviation, agricultural meteorology and agricultural information;
(七)農業防災減災、農業資源與農業生態安全和農村能源開發利用技術;
(VII) technologies on agricultural disaster prevention and reduction, safety of agricultural resources and agro-ecology, and development and utilization of rural energy;
(八)其他農業技術。
(VIII) other agricultural technologies.
本法所稱農業技術推廣,是指通過試驗、示範、培訓、指導以及諮詢服務等,把農業技術普及應用於農業產前、產中、產後全過程的活動。
Popularization of agricultural technology "mentioned in this Law, refers to the dissemination and the application of agro-techniques to the entire process of the pre-inter-post production of agriculture by means of experiment, demonstration, training, and consultation services.
第三條 國家扶持農業技術推廣事業,加快農業技術的普及應用,發展高產、優質、高效、生態、安全農業。
Article 3 The State shall support the promotion of agricultural technologies, speed up the popularization and application of agricultural technologies, and develop eco-friendly and safe agriculture characterized by high yield, high quality, and high efficiency.
第四條 農業技術推廣應當遵循下列原則:
Article 4 The following principles shall be observed in the popularization of agricultural technology:
(一)有利於農業、農村經濟可持續發展和增加農民收入;
1. Benefiting the sustainable development of agriculture and rural economy and increasing farmers' incomes;
(二)尊重農業勞動者和農業生產經營組織的意願;
(II) respecting the will of agricultural workers and agricultural production and operation organizations;
(三)因地制宜,經過試驗、示範;
(III) to adopt measures suitable to local conditions after experimentation and demonstration;
(四)公益性推廣與經營性推廣分類管理;
(IV) Separating non-profit promotion from for-profit promotion;
(五)兼顧經濟效益、社會效益,注重生態效益。
(V) Giving consideration to both economic benefits and social benefits and paying attention to ecological benefits.
第五條 國家鼓勵和支持科技人員開發、推廣應用先進的農業技術,鼓勵和支持農業勞動者和農業生產經營組織應用先進的農業技術。
Article 5 The State shall encourage and support scientific and technical personnel to develop, popularize and apply advanced agro-techniques; encourage and support agricultural labourers and agricultural production and operation organizations to apply advanced agro-techniques.
國家鼓勵運用現代信息技術等先進傳播手段,普及農業科學技術知識,創新農業技術推廣方式方法,提高推廣效率。
The State encourages the application of modern information technology and other advanced communication means to disseminate agricultural scientific knowledge and to innovate the methods and means of agricultural technology promotion so as to improve the efficiency in the promotion.
第六條 國家鼓勵和支持引進國外先進的農業技術,促進農業技術推廣的國際合作與交流。
Article 6 The State shall encourage and support the introduction of advanced agro-techniques from foreign countries and promote the international cooperation and exchanges of agro-technical popularization.
第七條 各級人民政府應當加強對農業技術推廣工作的領導,組織有關部門和單位采取措施,提高農業技術推廣服務水平,促進農業技術推廣事業的發展。
Article 7 Peoples governments at various levels shall strengthen their leadership in the work of agro-technical popularization and organize the relevant departments and units to take measures to raise the level of agro-technical popularization service so as to promote the development of agro-technical popularization.
第八條 對在農業技術推廣工作中做出貢獻的單位和個人,給予獎勵。
Article 8 The units or individuals that have made contributions to the work of agro-technical popularization shall be awarded.
第九條 國務院農業、林業、水利等部門(以下統稱農業技術推廣部門)按照各自的職責,負責全國範圍內有關的農業技術推廣工作。縣級以上地方各級人民政府農業技術推廣部門在同級人民政府的領導下,按照各自的職責,負責本行政區域內有關的農業技術推廣工作。同級人民政府科學技術部門對農業技術推廣工作進行指導。同級人民政府其他有關部門按照各自的職責,負責農業技術推廣的有關工作。
Article 9 The agriculture, forestry, water conservancy and other departments under the State Council (hereinafter referred to as the departments for agricultural technology promotion) shall, according to their respective duties, be responsible for the relevant work of agricultural technology promotion nationwide. The departments for agricultural technology promotion of the local people's governments at or above the county level shall, under the leadership of the people's governments at the corresponding levels, be responsible for the relevant work of agricultural technology promotion within their administrative areas according to their respective duties. The science and technology departments of the people's governments at the corresponding levels shall give guidance to the work of agro-technical popularization. The other relevant departments of the people's government at the same level shall, according to their respective duties, be responsible for the relevant work of agro-technical popularization.
第二章 農業技術推廣體系
Chapter 2 Agricultural Technology Promotion System
第十條 農業技術推廣,實行國家農業技術推廣機構與農業科研單位、有關學校、農民專業合作社、涉農企業、群眾性科技組織、農民技術人員等相結合的推廣體系。
Article 10 In the process of agro-technical popularization, a popularization system of combining national agro-technical popularization setups with institutions of agricultural scientific research, relevant schools or colleges, specialized farmers cooperatives, agriculture-related enterprises, mass organizations of science and technology, and peasant technical personnel, etc. shall be practised.
國家鼓勵和支持供銷合作社、其他企業事業單位、社會團體以及社會各界的科技人員,開展農業技術推廣服務。
The State shall encourage and support supply and marketing co-operatives, other enterprises and institutions, social organizations, and scientific and technical personnel in all walks of life to provide agricultural technology promotion services.
第十一條 各級國家農業技術推廣機構屬於公共服務機構,履行下列公益性職責:
Article 11 State agricultural technology promotion institutions at all levels, as public service institutions, shall perform the following duties for public benefits:
(一)各級人民政府確定的關鍵農業技術的引進、試驗、示範;
1. introduction, experiment and demonstration of key agricultural technologies determined by the people's government at various levels;
(二)植物病蟲害、動物疫病及農業災害的監測、預報和預防;
2. the monitoring, forecasting and prevention of plant diseases and insect pests, animal epidemic diseases and agricultural disasters;
(三)農產品生產過程中的檢驗、檢測、監測諮詢技術服務;
(III) Consultation technology services of inspection, detection and monitoring in the process of agricultural production;
(四)農業資源、森林資源、農業生態安全和農業投入品使用的監測服務;
(IV) Monitoring the safety of agricultural resources, forest resources and agro-ecology, and the use of agricultural inputs;
(五)水資源管理、防汛抗旱和農田水利建設技術服務;
(V) Technical services of water resources management, flood control and drought relief, and farmland water conservancy construction;
(六)農業公共信息和農業技術宣傳教育、培訓服務;
(VI) propaganda and education, training services of agricultural public information and agricultural technologies;
(七)法律、法規規定的其他職責。
(VII) other duties stipulated by laws and regulations.
第十二條 根據科學合理、集中力量的原則以及縣域農業特色、森林資源、水系和水利設施分布等情況,因地制宜設置縣、鄉鎮或者區域國家農業技術推廣機構。
Article 12 State agricultural technology promotion institutions in counties, townships and regions shall be established under the principles of being scientific and reasonable and concentrating efforts, and in light of the characteristics of agriculture in counties, distribution of forest resources, water systems and water conservancy facilities, and other situations.
鄉鎮國家農業技術推廣機構,可以實行縣級人民政府農業技術推廣部門管理為主或者鄉鎮人民政府管理為主、縣級人民政府農業技術推廣部門業務指導的體制,具體由省、自治區、直轄市人民政府確定。
State agricultural technology promotion institutions at township level may be operated under a system of primary management by the departments for agricultural technology promotion of the people's governments at county level or primary management by the people's governments at township level, with the departments for agricultural technology promotion of the people's governments at county level providing business guidance, and the details shall be determined by the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government.
第十三條 國家農業技術推廣機構的人員編制應當根據所服務區域的種養規模、服務範圍和工作任務等合理確定,保證公益性職責的履行。
Article 13 The staffing of a state agricultural technology promotion institution shall be reasonably determined on the basis of the planting and breeding scale, service scope and work tasks of the served areas to ensure the performance of public duties.
國家農業技術推廣機構的崗位設置應當以專業技術崗位為主。鄉鎮國家農業技術推廣機構的崗位應當全部為專業技術崗位,縣級國家農業技術推廣機構的專業技術崗位不得低於機構崗位總量的百分之八十,其他國家農業技術推廣機構的專業技術崗位不得低於機構崗位總量的百分之七十。
The job positions established within a state agricultural technology promotion institution shall be mainly professional technical positions. The posts of state institutions promoting agricultural technologies at township level shall be all professional technical posts, the professional technical posts of state institutions promoting agricultural technologies at county level shall not be less than eighty percent of the total institutional posts, the professional technical posts of other state institutions promoting agricultural technologies shall not be less than seventy percent of the total institutional posts.
第十四條 國家農業技術推廣機構的專業技術人員應當具有相應的專業技術水平,符合崗位職責要求。
Article 14 The professional technical personnel of a state agricultural technology promotion institution shall have corresponding professional skills that meet the requirements of their job positions.
國家農業技術推廣機構聘用的新進專業技術人員,應當具有大專以上有關專業學曆,並通過縣級以上人民政府有關部門組織的專業技術水平考核。自治縣、民族鄉和國家確定的連片特困地區,經省、自治區、直轄市人民政府有關部門批準,可以聘用具有中專有關專業學曆的人員或者其他具有相應專業技術水平的人員。
Any new professional technician employed by a state agricultural technology promotion institution shall have the relevant academic background above the junior college level and have passed the professional skill examination organized by the relevant department of the people's government at county level. Upon the approval of the relevant departments of the people's government of the province, autonomous region or municipality directly under the Central Government, persons with the relevant education background from technical secondary schools or other persons with the corresponding professional and technical level may be employed in the autonomous counties, ethnic townships and the contiguous areas of exceptional poverty as designated by the State.
國家鼓勵和支持高等學校畢業生和科技人員到基層從事農業技術推廣工作。各級人民政府應當采取措施,吸引人才,充實和加強基層農業技術推廣隊伍。
The State encourages and supports graduates from institutions of higher learning and scientific and technical personnel to engage in the work of agricultural technology promotion at the grass-roots level. The people's governments at all levels shall take measures to attract talent for enriching and strengthening the teams for agricultural technology promotion at the grass-roots level.
第十五條 國家鼓勵和支持村農業技術服務站點和農民技術人員開展農業技術推廣。對農民技術人員協助開展公益性農業技術推廣活動,按照規定給予補助。
Article 15 The State encourages and supports village agricultural technology service stations and farmer technicians to carry out promotion of agricultural technologies. Farmer technicians who assist in public agricultural technology promotion activities shall be given subsidies pursuant to relevant provisions.
農民技術人員經考核符合條件的,可以按照有關規定授予相應的技術職稱,並發給證書。
Peasant technical personnel who meet relevant requirements after examinations may according to relevant regulations be awarded with corresponding technical titles and certificates.
國家農業技術推廣機構應當加強對村農業技術服務站點和農民技術人員的指導。
State agricultural technology promotion institutions shall enhance guidance for village agricultural technical service stations and farmer technicians.
村民委員會和村集體經濟組織,應當推動、幫助村農業技術服務站點和農民技術人員開展工作。
Villagers' committees and village economic collectives shall promote and assist the work of village agricultural technical service stations and farmer technicians.
第十六條 農業科研單位和有關學校應當適應農村經濟建設發展的需要,開展農業技術開發和推廣工作,加快先進技術在農業生產中的普及應用。
Article 16 Institutions of agricultural scientific research and relevant schools or colleges shall adapt themselves to the needs of the development of rural economic construction, carry out the work of agro-technical development and popularization, and speed up the dissemination and application of advanced technology to agricultural production.
農業科研單位和有關學校應當將其科技人員從事農業技術推廣工作的實績作為工作考核和職稱評定的重要內容。
Institutions of agricultural scientific research and relevant schools or colleges shall take the actual performance of their scientific and technical personnel in the work of agro- technical popularization as an important component of work examination and determination of professional or technical titles.
第十七條 國家鼓勵農場、林場、牧場、漁場、水利工程管理單位面向社會開展農業技術推廣服務。
Article 17 The State encourages farms, forest farms, pastures, fishing grounds and water conservancy projects management entities to provide agricultural technology promotion services to the public.
第十八條 國家鼓勵和支持發展農村專業技術協會等群眾性科技組織,發揮其在農業技術推廣中的作用。
Article 18 The State shall encourage and support the development of mass organizations of science and technology, such as specialized technical associations in rural areas, to make efforts in promoting agricultural technologies.
第三章 農業技術的推廣與應用
Chapter Three Popularization and Application of Agricultural Technology
第十九條 重大農業技術的推廣應當列入國家和地方相關發展規劃、計劃,由農業技術推廣部門會同科學技術等相關部門按照各自的職責,相互配合,組織實施。
Article 19 The key agro-technical popularization shall be included into relevant national and local development programs and plans, and be carried out with cooperation of the departments of agro-technical popularization together with relevant departments of science and technology according to their respective functions and duties.
第二十條 農業科研單位和有關學校應當把農業生產中需要解決的技術問題列為研究課題,其科研成果可以通過有關農業技術推廣單位進行推廣或者直接向農業勞動者和農業生產經營組織推廣。
Article 20 Agricultural scientific research units and relevant schools shall take up technical problems which need to be solved in agricultural production as their research subjects, and the results of their scientific research may be popularized by the relevant agro-technical popularization units or may be popularized directly to agricultural labourers and agricultural production and operation organizations.
國家引導農業科研單位和有關學校開展公益性農業技術推廣服務。
The State shall guide agricultural scientific research units and relevant schools to provide public agricultural technology promotion services.
第二十一條 向農業勞動者和農業生產經營組織推廣的農業技術,必須在推廣地區經過試驗證明具有先進性、適用性和安全性。
Article 21 agro-techniques to be popularized to agricultural laborers and agricultural production and operation organizations must have been proved to be advanced, applicable and safe by experiments in the areas for popularization.
第二十二條 國家鼓勵和支持農業勞動者和農業生產經營組織參與農業技術推廣。
Article 22 The State shall encourage and support agricultural workers and agricultural production and operation organizations to participate in agro-technical popularization.
農業勞動者和農業生產經營組織在生產中應用先進的農業技術,有關部門和單位應當在技術培訓、資金、物資和銷售等方面給予扶持。
When agricultural labourers and agricultural production and operation organizations apply advanced agro-techniques to their production, the departments and units concerned shall give assistance to them in aspects of technical trainings, funds, materials and sales.
農業勞動者和農業生產經營組織根據自願的原則應用農業技術,任何單位或者個人不得強迫。
Agricultural workers and agricultural production and operation organizations shall apply agricultural technologies on a voluntary basis, and no unit or individual shall force them to apply such agricultural technologies.
推廣農業技術,應當選擇有條件的農戶、區域或者工程項目,進行應用示範。
In promoting agricultural technologies, qualified farmer households, regions and projects shall be selected for application demonstration.
第二十三條 縣、鄉鎮國家農業技術推廣機構應當組織農業勞動者學習農業科學技術知識,提高其應用農業技術的能力。
Article 23 State agricultural technology promotion institutions at county and township levels shall organize agricultural workers to study agricultural scientific technologies and knowledge in order to improve their ability of applying agricultural technologies.
教育、人力資源和社會保障、農業、林業、水利、科學技術等部門應當支持農業科研單位、有關學校開展有關農業技術推廣的職業技術教育和技術培訓,提高農業技術推廣人員和農業勞動者的技術素質。
Education, human resources and social security, agriculture, forestry, water conservancy, science and technology and other departments shall support agricultural scientific research units and relevant schools to carry out professional and technical education and training relating to agricultural technology promotion in order to improve the technical qualification of agricultural technology promotion personnel and agricultural workers.
國家鼓勵社會力量開展農業技術培訓。
The State shall encourage social forces to carry out agro-technical training.
第二十四條 各級國家農業技術推廣機構應當認真履行本法第十一條規定的公益性職責,向農業勞動者和農業生產經營組織推廣農業技術,實行無償服務。
Article 24 State agricultural technology promotion institutions at all levels shall conscientiously perform the public duties prescribed in Article 11 hereof to promote agricultural technologies to agricultural workers and agricultural production and operation organizations, and provide free services.
國家農業技術推廣機構以外的單位及科技人員以技術轉讓、技術服務、技術承包、技術諮詢和技術入股等形式提供農業技術的,可以實行有償服務,其合法收入和植物新品種、農業技術專利等知識產權受法律保護。進行農業技術轉讓、技術服務、技術承包、技術諮詢和技術入股,當事人各方應當訂立合同,約定各自的權利和義務。
Units and scientific and technical personnel other than the state agricultural technology promotion institutions providing agricultural technologies by means of technology transfer, technical services, technical contracting, technical consulting and technology investment, etc. may charge for their services, and their legal incomes and intellectual properties such as patents on new varieties of plants and agricultural technologies shall be protected by law. When conducting agro-technical transfer, technical service, technical contract, technical consultation and technical contribution, the parties concerned shall conclude contracts to define their respective rights and obligations.
第二十五條 國家鼓勵和支持農民專業合作社、涉農企業,采取多種形式,為農民應用先進農業技術提供有關的技術服務。
Article 25 The State encourages and supports farmers' specialized cooperatives and agriculture-related enterprises to provide various forms of technical services to farmers in respect of the application of advanced agricultural technologies.
第二十六條 國家鼓勵和支持以大宗農產品和優勢特色農產品生產為重點的農業示範區建設,發揮示範區對農業技術推廣的引領作用,促進農業產業化發展和現代農業建設。
Article 26 The State encourages and supports the construction of agricultural demonstration areas with the production of staple and characteristic agricultural products as the focus, and gives play to the leading role of demonstration areas in agricultural technology promotion, in order to promote the development of agricultural industrialization and modern agriculture.
第二十七條 各級人民政府可以采取購買服務等方式,引導社會力量參與公益性農業技術推廣服務。
Article 27 The people's governments at all levels may adopt various means such as service procurement to guide the social forces to participate in public agricultural technology promotion services.
第四章 農業技術推廣的保障措施
Chapter 4 Safeguards for Agro-technical Popularization
第二十八條 國家逐步提高對農業技術推廣的投入。各級人民政府在財政預算內應當保障用於農業技術推廣的資金,並按規定使該資金逐年增長。
Article 28 The State shall gradually increase its input to agro-technical popularization. People's governments at various levels shall secure the funds to be used for agro- technical popularization in their financial budgets and increase such funds year by year according to relevant provisions.
各級人民政府通過財政撥款以及從農業發展基金中提取一定比例的資金的渠道,籌集農業技術推廣專項資金,用於實施農業技術推廣項目。中央財政對重大農業技術推廣給予補助。
People's governments at various levels shall, through channels of financial allocation or drawing a fixed proportion of funds from agricultural development fund, raise special funds for agro-technical popularization to carry out projects of agro-technical popularization. The central finance shall grant subsidy to key agricultural technology promotion projects.
縣、鄉鎮國家農業技術推廣機構的工作經費根據當地服務規模和績效確定,由各級財政共同承擔。
The working funds of state agricultural technology promotion institutions of counties and townships shall be determined according to the local service scale and performance and jointly assumed by the finance at all levels.
任何單位或者個人不得截留或者挪用用於農業技術推廣的資金。
No unit or individual may intercept or misappropriate the funds for agricultural technology promotion.
第二十九條 各級人民政府應當采取措施,保障和改善縣、鄉鎮國家農業技術推廣機構的專業技術人員的工作條件、生活條件和待遇,並按照國家規定給予補貼,保持國家農業技術推廣隊伍的穩定。
Article 29 The people's governments at all levels shall take measures to ensure and improve working conditions, living conditions and treatments for the professionals of state institutions promoting agricultural technologies at county and township level, and give subsidies according to state provisions to maintain the stability of the team promoting agricultural technologies.
對在縣、鄉鎮、村從事農業技術推廣工作的專業技術人員的職稱評定,應當以考核其推廣工作的業務技術水平和實績為主。
The determination of titles of professional technical personnel engaged in the work of agro- technical popularization in counties, townships or villages shall be based mainly on their professional technical levels and achievements in the work of popularization.
第三十條 各級人民政府應當采取措施,保障國家農業技術推廣機構獲得必需的試驗示範場所、辦公場所、推廣和培訓設施設備等工作條件。
Article 30 People's governments at all levels shall take measures to ensure that state institutions promoting agricultural technologies have experiment and demonstration places, offices, promotion and training facilities, and other necessary working conditions.
地方各級人民政府應當保障國家農業技術推廣機構的試驗示範場所、生產資料和其他財產不受侵害。
Local people's governments at various levels shall protect the experimental and demonstration places, means of production and other property of state institutions promoting agricultural technologies from infringement.
第三十一條 農業技術推廣部門和縣級以上國家農業技術推廣機構,應當有計劃地對農業技術推廣人員進行技術培訓,組織專業進修,使其不斷更新知識、提高業務水平。
Article 31 The departments for agro-technical popularization and state agro-technical popularization setups at or above the county level shall carry out in a planned way technical trainings for agro-technical popularization personnel and organize them to obtain professional studies so as to update their knowledge and enhance their vocational level.
第三十二條 縣級以上農業技術推廣部門、鄉鎮人民政府應當對其管理的國家農業技術推廣機構履行公益性職責的情況進行監督、考評。
Article 32 The departments for agricultural technology promotion at or above the county level and people's governments at the township level shall supervise and evaluate the performance of duties for public benefits of state agricultural technology promotion institutions under their administration.
各級農業技術推廣部門和國家農業技術推廣機構,應當建立國家農業技術推廣機構的專業技術人員工作責任制度和考評制度。
The departments for agricultural technology promotion and state agricultural technology promotion institutions at all levels shall establish a work responsibility system and evaluation system for the professional technicians of the state agricultural technology promotion institutions.
縣級人民政府農業技術推廣部門管理為主的鄉鎮國家農業技術推廣機構的人員,其業務考核、崗位聘用以及晉升,應當充分聽取所服務區域的鄉鎮人民政府和服務對象的意見。
For the performance evaluation, job employment and promotion of personnel of township state agricultural technology promotion institutions mainly managed by the departments for agricultural technology promotion of the people's governments at the county level, the opinions of the township people's governments and the receivers of service within their service areas shall be fully solicited.
鄉鎮人民政府管理為主、縣級人民政府農業技術推廣部門業務指導的鄉鎮國家農業技術推廣機構的人員,其業務考核、崗位聘用以及晉升,應當充分聽取所在地的縣級人民政府農業技術推廣部門和服務對象的意見。
For the performance evaluation, job employment and promotion of personnel of township state agricultural technology promotion institutions mainly managed by the township people's governments with the departments for agricultural technology promotion of the people's governments at the county level providing service guidance, the opinions of the departments for agricultural technology promotion of the local people's governments at the county level and the receivers of service shall be fully solicited.
第三十三條 從事農業技術推廣服務的,可以享受國家規定的稅收、信貸等方面的優惠。
Article 33 Any entities engaged in agricultural technology promotion services may enjoy taxation, credit and other preferences as prescribed by the state.
第五章 法律責任
Chapter 5 Legal Liabilities
第三十四條 各級人民政府有關部門及其工作人員未依照本法規定履行職責的,對直接負責的主管人員和其他直接責任人員依法給予處分。
Article 34 Where the relevant departments under the people's governments at various levels and their staff fail to perform their duties in accordance with the provisions of this Law, the leading persons directly in charge and the other persons directly responsible shall be given sanctions according to law.
第三十五條 國家農業技術推廣機構及其工作人員未依照本法規定履行職責的,由主管機關責令限期改正,通報批評;對直接負責的主管人員和其他直接責任人員依法給予處分。
Article 35 Where state institutions promoting agricultural technologies and their personnel fail to perform their duties according to this Law, the competent authority shall order a correction within a time limit and circulate a notice of criticism; the direct supervisor and other direct responsible personnel shall be given sanctions according to law.
第三十六條 違反本法規定,向農業勞動者、農業生產經營組織推廣未經試驗證明具有先進性、適用性或者安全性的農業技術,造成損失的,應當承擔賠償責任。
Article 36 Anyone who, in violation of this Law, promotes agricultural technology which has not been proved after experiment to be advanced, applicable and safe to agricultural workers and agricultural production and operation organizations and causes any losses thereby, shall bear the liability for compensation.
第三十七條 違反本法規定,強迫農業勞動者、農業生產經營組織應用農業技術,造成損失的,依法承擔賠償責任。
Article 37 Anyone who, in violation of this Law, compels agricultural workers or agricultural production and operation organizations to apply agro-techniques and causes losses thereby, shall bear the liability for compensation in accordance with law.
第三十八條 違反本法規定,截留或者挪用用於農業技術推廣的資金的,對直接負責的主管人員和其他直接責任人員依法給予處分;構成犯罪的,依法追究刑事責任。
Article 38 Where, in violation of the provisions of this Law, the funds for agricultural technology promotion are withheld or misappropriated, the person directly in charge and the other persons directly responsible shall be given sanctions according to law; if a crime is constituted, criminal liability shall be investigated according to law.
第六章 附則
Chapter 6 Supplementary Provisions
第三十九條 本法自公布之日起施行。
Article 39 This Law shall go into effect as of the date of its promulgation.
